PUBLIC HEARING - TAXI LICENSE DENIAL – ROBERT WUNDER – UPHELD Page | 5  October 1, 2018 Regular City Council Meeting The City Council held a public hearing to allow Robert Wunder, an applicant for a taxi license, to appeal the decision made by the Police Chief to deny the application based on the qualifications and background examination. No one appeared on behalf of the public hearing. Whereupon Alderman Olson moved the public hearing be closed and the decision by the Police Chief be upheld. PERSONAL APPEARANCES Scott Burlingame, representing Independence, Inc. and a group of Independent Living Ambassadors, came forward to talk about the efforts to make Minot accessible specifically efforts around snow removal. He thanked the City Manager and Police Chief for meeting with him to discuss the current laws and enforcement mechanisms relating to snow removal. He reminded citizens, the law says that within 24 hours following a winter weather event all alleys, sidewalks, ramps, intersections and parking spaces must be cleared of snow. He said, this does not happen and oftentimes snow is dumped in those places making it difficult to get around. He said he plans to raise public awareness around the issue and let businesses know what the laws are. Mayor Sipma commended Mr. Burlingame for bringing this to the attention of the residents of Minot. He mentioned an idea for an Adopt-A-Sidewalk program to help maintain the sidewalks now owned by the City. He said, he hopes to continue to make the community more accessible. Patti Eisenzimmer, of Afton Township, came forward to discuss the surcharge for building permits in the extraterritorial zone. She distributed information to the Council about the research she has done regarding building permit fees in other cities. She asked why it was implemented and what can be done to justify it. She said, she does not believe they should pay higher fees because they do not benefit from City services like water, sewer, garbage or street sweepers. The City Manager explained that when her request was brought to their attention, he assembled staff to find out the history behind the fee structure. He said, in 1986, Resolution no. 555 established the building permit fees. The intent behind the 100% surcharge was to discourage rural development which would have a detrimental effect on City growth and to cover the increased costs incurred from doing inspections in the two-mile zone. He continued by saying, the Building Department is subsidized by property tax so the increased fee for the two-mile is to pass along the costs that would otherwise be absorbed by the City tax payers. Ms. Eisenzimmer said, in the County, the fee is $4.50 per $1,000 of construction value, in the City, it is $5.00 per $1,000 of construction value but in the extraterritorial zone it is $10.00 per $1,000 of construction value. She asked if that is fair and if the fees were set up in 1986, if it is still relevant today. Mayor Sipma said the Planning Department and City staff can look into the issue further. City Manager Barry said, they celebrated the Trinity groundbreaking which was an opportunity to see the progress that has been made at the new facility. He said how grateful Minot is for the investment in the community and that the City appreciates the relationship between the two entities. He discussed the North Dakota League of Cities Conference that took place in September and said, he was appointed to the NDLC Board of Directors. In that position, he will work to bring the NDLC Conference to Minot. He then announced, the City of Minot won the award for 2018 City of the Year. He listed the notable accomplishments that helped Minot earn the award including the Hazard Mitigation Project at the Water Treatment Plant, the Mouse River Enhanced Flood Protection Project, ongoing NAWS work and the Downtown Infrastructure project. Mr. Barry also said, the Downtown Improvement project received another award of excellence which makes it the fourth award for this project. It was awarded the ND American Public Works Association (APWA) Project of the Year for being considered the best public improvement project. The City Manager said, the Governor will be visiting Minot on October 22nd in relation to his Main Street Initiative. There will be a tour and listening meeting to educate Governor on ideas and comments of community regarding infill and the Main Street Initiative. He moved on to describe the FEMA Flood preparation tabletop exercise where representatives from all levels of government focused on five main objectives on preparation and mitigation in case of a flood event. The exercise allows us to prepare, integrate, plan, and collaborate with other agencies. Page | 7  October 1, 2018 Regular City Council Meeting Mr. Barry announced there will be a public input meeting to discuss the future of the Landfill. He explained that the expansion of the landfill was put on hold in order to form a focus group to analyze alternative options. The group has formulated their information and is ready to present it to the public for feedback. The meeting will take place October 11th at 6:30 pm in the Auditorium, Room 301. He gave a brief update on the Gap Financing program by saying, the first successful closing had taken place. There are ten other applicants processing and if residents are interested in qualifying for the program, they can contact the NDR Program Manager or Federal Compliance Officer. The City Manager then mentioned construction updates. He said, 2nd Ave SW is now open to two-lane traffic. It was closed for work on MI-2 of the Mouse River Enhanced Flood Protection Project. The Broadway Bridge deck is being poured as well as the US 83 Bypass. The foundations, footings and walls for the Broadway Pump Station continue to be poured. Projects are on track to finish up this year, pending weather conditions. He then talked about the Norsk Hostfest, which took place September 26-29. He described what an impressive event it was and he discussed Minot’s Sister City, Skien, Norway. Mr. Barry, the Mayor, and Rolf Haugen, a representative of the City Council of Skien, discussed opportunities to strengthen the relationship between the two cities. He said, he and the Mayor were invited to visit Norway to reengage and improve their educational, cultural, and economic benefits. He said there was an agreement signed last year between Skien and the different entities in Minot and he will bring that agreement to be ratified by the City Council. He emphasized the value that having a sister City, brings to Minot and to Skien. He talked about the legislative timeline that was presented during the Committee of the Whole meeting. He encouraged the community to identify legislative topics for the Council to direct their focus. The City Manager concluded his report by acknowledging staff members for outstanding achievements. He and the Mayor recognized Mitch Flanagan, the Building Official, after receiving a letter from Konrad Johnson, Superintendent of Adolf & Peterson, who worked on the Ward County Jail and Courthouse. Motion seconded by Alderman Pitner. Mayor Sipma explained that this was previously brought before the Council but was held in order to further discuss the structure with the community stakeholders. They came to an understanding that the technical teams will conduct a majority of the work developing the plans. Tim Mihalek will act as the Project Manager, to oversee the technical teams and report back to the stakeholders. Mayor Sipma said, he believes they have address a majority of the concerns raised by stakeholders when it was first brought to the Council. Alderman Wolsky said he has issues with the Steering Committee serving as decision makers who set policy and provide direction to the interagency team and said he would like to see the City Council in that role. Economic Development is a contentious issue among residents and he wants the process to be transparent and inclusive for the whole community. He also emphasized the need to create an entrepreneurial ecosystem. Mayor Sipma responded by saying, the technical teams are smaller groups intended to discuss issues openly. It is difficult to start discussions with large audiences and it would slow things down to have too many involved from the beginning. He said, the recommendations will come forward for approval after those groups have worked out the details. He also said, the members of the Steering Committee have not been set yet. Alderman Straight commented that he is working with a technical team that is developing an incubator concept in town which will likely address the entrepreneur aspect. They have tasked the Library staff to look for cost savings while maintaining the current service to Minot and surrounding areas. Mayor Sipma said the Parks & Recreation committee has not met but they have obtained the information they were looking for and should be meeting again soon. He also said, the Mayor’s Committee on Addiction will meet again soon to reassess and figure out how to move forward. Page | 16  October 1, 2018 Regular City Council Meeting Alderman Wolsky brought up the MADC Board and said they meet October 11th. He will continue to offer a Council related push on the IEDC issue. He also mentioned the Renaissance Zone Board by saying, they have been rewriting the development plan and hope to create better incentives for development and improvement. Lastly, the Zoning Ordinance Steering Committee will be scheduling regular meetings to revise the Zoning Code. Alderman Pitner described some updates from the Recreation Commission. He said, the Auditorium floor has been completed and some lighting replaced. They are also planning to install a sand volleyball court near the Dreamcatchers field to potentially start a volleyball league. The tennis court resurfacing is also taking place. OTHER BUSINESS Alderman Wolsky brought up an issue regarding a special event permit for Atypical Brewery and Barrelworks. He said, they were granted conditional approval for a retail beer and wine license, pending the inspections by the Fire Marshal and Building Official. Their premises is not ready for a certificate of occupancy yet and therefore has not received the inspections for final approval of their license. They would like to transfer their license for an event October 6th but the Police Chief denied it because they do not yet have a license to transfer. Due to an oversight, they were granted an event permit for the same location in August and he would like them to be granted another permit for this event. Mayor Sipma explained, according to State Century Code and City ordinance, the premises has not yet been defined and cannot be issued a license. He said, another establishment can use their license in order to issue the permit for this event. The Police Chief added, the inspections should take place prior to going to the City Council for approval but they have been granted conditional approval in order to expedite the process. The license has not yet been issued for Aytpical Brewery so he cannot approve an event permit. He suggested to the owners that they operate under another license for this event. Upon questioning by Alderman Straight, the Police Chief said there were no issues reported during their last event. Alderman Wolsky said they have a Brewery and Tap Room license from the State and requested some clarity why that license could not grant them an event permit. He asked if there was another option besides using a license from an existing license holder Chief Olson stated, they need to pass the inspection in order to obtain a license and he cannot expedite an inspection if the property is not ready. Alderman Wolsky suggested reviewing the ordinance to make it more business oriented. Mayor Sipma reminded, there was an ad hoc committee that discussed making changes but most issues need to be addressed on the state level.
