To the Honorable Mayor and All Aldermen: Following are the recommendations of the Public Works and Safety Committee meeting called to order at 4:15 p.m. on May 2, 2012: 1. That the City Council declare the bid for the 2012 Street Improvement Project by Bechtold Paving in the amount of $1,097,212.62 to be the lowest and best bid, and authorize the Mayor to sign any documents on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 2. That the City Council declare the bid by Astech Corporation for the 2012 Street Seal project in the amount of $1,086,186.97 to be the lowest and best bid, and further, authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 3. That the City Council declare the bid by Steen Construction to be the lowest and best bid for the 2012 Watermain Replacement project in the amount of $418,509; and further, authorize the Mayor to sign any documents on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE May 2, 2012 Page 2 4. That the City Council declare the bid by Minot Paving, Inc. to be the lowest and best bid for the 2012 Sidewalk, Curb, and Gutter project in the amount of $230,675; and further, authorize the Mayor to sign any documents on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 5. That the City Council declare the bid by Traffic Control Corporation to be the lowest and best bid for the traffic signal cabinets and controllers for the Flooded Signal Restoration Project in the amount of $112,875; further, authorize the City Engineer to complete the purchase; and further, authorize the Mayor to sign any documents on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 6. That the City Council declare the quote by Mlazgar Associates in the amount of $21,988 for nine signal mast arms, to be the lowest and best quote; and further, authorize the Traffic Engineer to complete the purchase. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 7. That the City Council declare the bid by Main Electric Construction, Inc. for the installation of nine replacement signal mast arms at the intersections of Broadway at Burdick, Central Avenue, and Second Avenue in the amount of $57,815 to be the lowest and best bid, and further, authorize the Mayor to sign the contract on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 8. That the City Council declare the bid by Westlie Motors for a new 2013 Ford Explorer 4WD in the amount of $26,463 to be the best received; and further, authorize the Public Works Director to complete the purchase. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 9. That the City Council declare the quote by Great American Marine of Bloomington, MN for a Zodiac Rescue Watercraft in the amount of $20,723 to be the best received; and further, authorize the Fire Chief to complete the purchase. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE May 2, 2012 Page 3 10. That the City Council place and pass an ordinance amending the 2012 budget in the amount of $169,978 for the acceptance of Fire Department State Homeland Security Program grant monies, on first reading. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 11. That the City Council authorize the participation in the Minnesota Cooperative Purchasing Venture; and further, authorize the Mayor to sign the agreement between the Administration, Materials Management Division of the State of Minnesota and the City of Minot on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 12. That the City Council approve the Community Action Opportunities, Inc. application in the amount of $20,000 to the North Dakota Division of Community Services Emergency Shelter Program; further, authorize the Mayor to sign the Certification of Local Approval for Nonprofit Organizations for the application on the City’s behalf; and further, authorize acceptance of any grant funding awarded. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 13. That the City Council approve the Edward Byrne Justice Assistance Grant Program application by Domestic Violence Crisis Center, Inc. in the amount of $15,000; further, authorize acceptance of any grant funding awarded; and further, authorize the Mayor to sign any necessary grant documentation on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 14. That the City Council ratify the Mayor’s signature on a Memorandum of Understanding with Ward County for the application for an Edward Byrne Memorial Justice Assistance Grant to be used for overtime expenses and the purchase of law enforcement equipment, further, accept any grant funds awarded, and further, authorize the completion of all documentation necessary for the acceptance of the grant. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE May 2, 2012 Page 4 15. That the City Council authorize the acceptance of the North Dakota Department of Transportation Safe Routes to School grant in the amount of $198,700 to install multiple blocks of sidewalk near Lewis and Clark Elementary School; and further, authorize the Mayor to sign the grant documentation on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 16. That the City Council authorize the acceptance of the North Dakota State Land Department Energy Infrastructure and Impact Office grant in the amount of $19,509 to be used for police communication system enhancements. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 17. That the City Council authorize the acceptance of the State Land Department Energy Infrastructure and Impact Office grant in the amount of $88,000 to be used for the purchase of a foam trailer and foam for the Minot Fire Department, further, authorize the Mayor to sign any grant documents on the City’s behalf, and further, place and pass an ordinance amending the 2012 annual budget in the amount of $88,000, on first reading. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 18. That the City Council ratify the Mayor’s signature on the application for a State Land Department Energy Infrastructure and Impact Office grant to be used for trunk sewer infrastructure. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 19. That the City Council place and pass an ordinance amending the Traffic Ordinance to add the intersections of 39th Avenue SE/SW and South Main Street to the list of stop controlled intersections, on first reading. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 20. That the City Council approve the donation of a 1954 American LaFrance Fire Truck to the Minot Rural Fire Department for restoration as a parade unit. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE May 2, 2012 Page 5 21. That the City Council approve a special use permit for Robert Gasmann to allow two draft horses into City limits on May 14, 2012 for the purpose of showing them to Central Campus Students. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 22. That the City Council approve the application from Candi Brown, 109 23rd Street NW, for a permit for one additional animal (five dogs) beyond the four dog and/or cat ordinance limit. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 23. That the City Council remove the Condition No. 4, regarding variety of lot size and park dedication, from the list of conditions for the subdivision of Northern Lights Addition, Block 1 into 251 lots to be known as Statesboro Addition , Block 1, Lots 1A-13B, Block 2, Lots 1A-14B, Block 3, Lots 1A-14B, Block 4, Lots 1A-13B, Block 5, Lots 1A-21B, Block 6, Lots 1A- 18B, Block 7, Lots 1A-18B, Block 8, Lots 1A-14B & 15. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 24. That the City Council place and pass the following ordinances on second reading: a. Ordinance No. 4460 – Rezoning Swanston Addition Lot 1 from C-2 (General Commercial District) and M-2 (Heavy Industrial District) to M-1 (Light Industrial District). b. Ordinance No. 4470 – Rezoning Greenland Addition, Lots 1 & 2 from AG (Agricultural District) to C-2 (General Commercial District). c. Ordinance No. 4488 – Rezoning Polar Bear Ridge Addition, Lot 1 from R-4 (Planned Residence District) to P (Public). d. That the City Council authorize the acceptation of the grant funds from the North Dakota Department of Transportation for the operation of the public transit system in the amount of $58,546; further, place and pass an ordinance amending the annual budget, on first reading; and further, authorize the Mayor to sign the grant documentation on the City’s behalf. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 26. That the City Council approve the request from Shaun Wallace to relocate a 1978 model 26' X 52' manufactured home with attached back entry from 19700 Highway 83 South, Minot, ND to 220 16th Street SE (Lot 69, Lenox Park Addition); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. Screen door at front entrance of the home needs to be replaced. 5. Two wall hydrants for water need to be protected with vacuum breakers. 6. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 7. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. All work associated with the request to be complete within four months. ********** The above motion by Alderman Hatlelid and seconded by Alderman Lehner. Discussion was held on the aesthetics of manufactured homes and how they fit in established neighborhoods. The City Manager provided information on HUD regulations for manufactured homes placed inside city limits. Aldermen Lehner and Hatlelid indicated their support for the request and commented manufactured homes don’t bring down values of neighboring homes. Alderman Connole expressed his hesitancy in granting the request. The City Assessor stated new manufactured homes are built better now and are selling for more than they did in the past. He further stated that if the home did not fit in the neighborhood, the Assessor’s Office would reflect that opinion. Tom Ripplinger, representing Iseman Homes, explained the differences between a manufactured home versus a stick built home and anchoring systems for manufacturing homes. Discussion was held on the anchoring of the home to the foundation. Alderman Knudsvig indicated the placement of the home on 4-foot deep piers should be a condition of the request. Upon questioning, the Building Official stated the condition would limit it to only being placed on piers, not a crawl space or basement. Alderman Knudsvig requested Alderman Hatlelid add to the motion a condition that the home must be placed on a permanent foundation. Alderman Hatlelid agreed to add the condition to the motion and Alderman Lehner agreed to second the change. Whereupon, a vote was taken on the above motion by Alderman Hatlelid, seconded by Alderman Lehner, and carried unanimously. 27. That the City Council approve a request from Levi Tande to relocate a 1976 model 24' x 56’ manufactured home with attached back entry from Iseman Homes Inc, Minot to 6311 54th Avenue SE (Lot 2, Tryhus 2nd Subdivision, within the extraterritorial jurisdiction of the City of Minot); subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. Home to be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. That the City Council approve a request from Dale Schlag to relocate a 2012 model 27' X 44’ manufactured home from Iseman Homes Inc, Minot, ND to 415 17th Street NW (Lot 3 less the south 45’ and all of Lot 4, Block 12, Blaisdell Bird Addition) to replace a flood- damaged home; subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home to be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c. That the City Council approve a request from Wallace Holter to relocate a 2012 model 27' X 40’ manufactured home from Iseman Homes Inc, Minot, ND to 714 2nd Avenue NW (East 60’ of Lot 7, Block 6, Parkland Addition) to replace a flood-damaged home; subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. That the City Council approve a request from Barry Hime to relocate a 2012 model 27' X 56’ manufactured home from Iseman Homes Inc, Minot, ND to 318 7th Avenue NW (Center 46’ of Lot 7, Block 2, North Minot Addition) to replace a flood-damaged home; subject to the following conditions: 1. A ten-thousand dollar performance bond must be posted with the City prior to start of any work at site or relocation of the manufactured home. 2. All work at the new location must be performed in compliance with the applicable state and local codes and ordinances for residential zones. 3. Permits for all work must be obtained from the City of Minot. 4. The property must be properly drained, and landscaped in a manner similar to surrounding properties. 5. Home to be placed on a permanent foundation. 6. Work shall be accomplished generally in accordance with the following schedule: a. Foundation to be complete within one month. b. Relocation of structure to be complete within two months. c.
