The City Council award the bid to Bechtold Paving in the amount of $271,507.75 for Paving District 485, adopt the proposed resolution declaring the official intent for financing this project; and further authorize the Mayor to sign the contract on the City’s behalf. (3741) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 2. The City Council award the bid to Keller Paving and Landscape in the amount of $358,925 for the 1 st St. SE Street Improvements; and further authorize the Mayor to sign the contract on the City’s behalf. (3878) ************** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 3. The City Council award the bid to Tecta America Dakotas, LLC in the amount of $59,729 for the City Hall/Police Department roof repair, plus $1.10 per board foot for insulation repair if any is encountered during the project. (4064) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 4. The City Council place and pass a proposed ordinance on first reading amending the 2015 Annual Budget to increase the Street Improvement expenditures and decrease the Street Seal expenditures and transfer funds from cash reserves. The Public Works Committee forwarded the item regarding the award of bid for the 2015 Street Improvements District (4008) to Council without a decision due to a late bid opening of March 2, 2015. (4008) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 6. The Public Works Committee forwarded the item regarding the award of bid for the 2015 Street Seal District (4007) to Council without a decision due to a late bid opening of March 2, 2015. (4007) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 7. The City Council award the bid to SPX Genfare in the amount of $295,592.63 for the contract for Project #3978 Validating Bus Farebox, Revenue and Data Collection System for the Bus Department. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 8. The City Council award the bid be awarded to Flexible Pipe Company in the amount of $189,498.50 for the purchase of a high pressure sewer jetter. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 9. The City Council award the bid to Butler Machinery in the amount of $147,954.38 per year for the lease of a new landfill compactor; and further place and pass a proposed ordinance on first reading amending the 2015 Annual Budget to increase the Landfill Equipment Rental expenditures for the lease of a compactor and transfer funds from cash reserves. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 10. The City Council award the bid to Westlie Motors for the purchase of multiple pickup trucks; and further place and pass a proposed ordinance on first reading amending the 2015 Annual Budget to increase the Landfill capital purchases expenditures and decrease the Garbage Capital Purchases expenditures for the purchase of two ½ ton 4X4 extended cab pickups and transfer funds from Garbage Capital Purchases. (WS0028, WS0029, WS0034, LF0009, LF0013, PM0003, STR031) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 11. The City Council deny the request by Linda McDaniel of 1019 5 th Ave. SE for a permit for additional animals. Pursuant to City ordinance, a public hearing on the additional animal permit has been scheduled for the March 2nd City Council meeting. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. PUBLIC WORKS AND SAFETY COMMITTEE February 25, 2015 Page 3 12. The City Council approve the grant application, adopt a resolution authorizing the filing of an application with the Department of Transportation for a Section 5311 State Aid Bus Grant; and further authorize the Mayor to sign the grant application. ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 13. The City Council adopt a resolution to approve the plans and specifications for Paving District 493 and call for bids; and further adopt a resolution declaring the intent for financing this project. (3935) ************** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 14. The City Council approve the plans and specifications and call for bids for the Victoria Pedestrian Bridge- Phase III project. (3572) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 15. The City Council approve the recommendation of the selection committee for the Public Works Building Expansion, authorize the Public Works Director to negotiate the contracts for architectural services for the projects; and further authorize the Mayor to sign the contracts on the City’s behalf. (4060 & WS0023) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 16. The City Council approve the contract amendment for the additional services for the Landfill Master Plan estimated at $59,000; and further authorize the Mayor to sign the contract on the City’s behalf. (3700) ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 17. The City Council approve the amendment to the engineering services contract with Ackerman- Estvold for the 6th St. Underpass Reconstruction, 6th St. Underpass Pump Station, 3rd Ave Storm Sewer, 2nd Ave Storm Sewer Outfall approve the use of general obligation bonds and revenues as needed; and further authorize the Mayor to sign the amendment. The City Council place and pass the following ordinances on second reading: a. Ordinance No. 4934 – Amending 2015 Annual Budget – Increase Capital Equipment Purchase Revenues and Expenditures – Reduce Library Budgeted Revenues and Expenditures – Capital Purchase – Boiler (LIB013) b. Ordinance No. 4935 – Amending 2014 Annual Budget – Increase Information Technology Contract Agreements Expenditures and Revenues in General Fund – New World Software Upgrade – Decrease Capital Purchases Equipment Revenues and Expenditures – Noncapital Purchases (PD0025) c. Ordinance No. 4936 – Amending 2014 Annual Budget – Increase Department Budgets for Funds Spent Using Cash Reserves and Corresponding Revenues ********** The above motion by Alderman Lehner, seconded by Alderman Jantzer, and carried unanimously. 19. The Public Works Committee moved to hold the item concerning ADA Taxi Cab Compliance updates until the April 1st Public Works Committee meeting. ********** Alderman Hatlelid moved the Committee and Council in order to ensure Minot taxi companies are in compliance with the ADA requirements, each taxi company shall certify, in writing, the company is currently in compliance with the ADA. If, after investigation, the City learns a taxi company is not in compliance, the City would have the option to suspend or revoke the taxi company license pursuant to section 30-58 of the City of Minot Ordinances. Motion seconded by Alderman Schuler. Brandon Rowenhorst appeared before the Committee to provide a memo to show that North Dakota has expanded ADA protection. Alderman Lehner addressed the lack of time the Committee has had to review the information provided by Mr. Rownhorst and stated he would like more time to review the information that was just provided. Assistant City Attorney Kelly Hendershot stated she also just received the information from Mr. Rowenhorst and has not had time to review it. Alderman Jantzer moved the Committee hold this item until the April 1 st Public Works Committee meeting. Motion seconded by Alderman Hatelid and was carried by the following roll call vote: ayes: Berg, Hatlelid Jantzer, Lehner, Schuler, Shomento. nays: none 20. The City Council place and pass the proposed ordinance on first reading, thereby amending Chapter 23 (Offenses – Miscellaneous), Article IV ( Weapons Offenses), Division II (Other Weapons), Section 23-67 of the Code of Ordinances relating to offenses- miscellaneous. ********** The above motion by Alderman Hatlelid, seconded by Alderman Lehner. Upon questioning by Alderman Schuler in regards to if a special permit would be available to individuals or is this for special events only, Police Chief Jason Olson stated individuals would be able to apply for special permits but it would only be for special events and not continuous use. Alderman Schuler stated residents have contacted her with concern that archery will not be allowed in backyards and said she could not support the ordinance. She noted most people who practice archery are responsible and this ordinance would penalize those individuals. Alderman Connole stated the problem is not with the lawful citizens, but that laws are passed for a reason. He said those who wish to practice archery, should do so outside City limits.
