CITY OF MINOT ZONING ORDINANCE STEERING COMMITTEE Meeting Minutes October 2, 2019 8:00 am – 10:00 am City Council Chambers City Hall I. ATTENDANCE AND ROLL CALL Committee: Rolly Ackerman, Josh Wolsky, Rusten Roteliuk, Tim Baumann, Pat Graner, Gloria Larsgaard Absent: Tyler Neether Staff: Brian Billingsley, Community & Economic Development Director Lance Lang, Principal Planner Peter Baumgartner, Planner I Stefanie Stalheim, Assistant City Attorney Emily Huettl, Assistant City Engineer Glenda Sorensen, Planning Assistant Consultant: Scott Harmstead – SRF Consulting Tim Magnusson – SRF Consulting (via conference call) Guests: Cindy Snay, Coughlin Construction Rolly Ackerman called the meeting to order at 8:00 am. II. APPROVAL OF MINUTES Motion by Baumann to approve the September 4, 2019 meeting minutes, second by Graner. Ayes: all, nays: none Motion passes III. REVIEW AND APPROVAL OF AGENDA Motion by Wolsky to approve the agenda, second by Larsgaard. Ayes: all, Nays, none. Motion passes IV. INTRODUCTION OF GUESTS Ackerman acknowledged Emily Huettl (staff member) in attendance. V. PLANNED UNIT DEVELOPMENTS A. Presentation of Chapter 13 PUD Ordinance by Consultants and Staff Zoning Ordinance Steering Committee Minutes October 4, 2019  Billingsley asked Harmstead to go over the changes made to Chapter 13 PUD Ordinance.  Harmstead advised the committee members that legal and Emily Huettl had looked at the document.  Changes noted by Harmstead and comments (if any) from committee members:  Section 13-9 – The last sentence has been removed.  Section 13-9 – If no work has begun within that year, the city may (which replaces the verbiage “shall”) start the revocation process. Motion made by Wolsky, second by Roteliuk to approve the above changes. Ayes: all, nays: none. Motion passes.  Baumann reiterated keeping the revocation process in the ordinance in case it is needed.  Ackerman asked about the finance piece to this issue. Example: 20 units are in the PUD, and only 8 are completed, will financing be an issue for the developer? Ackerman stated that projects are typically 3-5 years before completion.  Principal Planner Lang asked if the developer can give the city a plan of action after 1 year and no completion on the project. The city would then be assured that the developer is still working on the project and has not abandoned it.  Wolsky suggested that the following verbiage be added to the end of the sentence (13-9, a.), “city may require a plan of action”. All committee members were in agreement.  It was decided that if a revocation is to be initiated, it would be the city who contacts the applicant. 13-1 General Descriptions  Last sentence removed in paragraph.  Roteliuk asked if there’re is a process for the Developer’s Agreement, and if the developer is out of town, will they know the process? Discussion was tabled. USE TABLE RURAL & AGRICULTURAL USES  No Changes HOUSING  Assisted Living Facility – Change from Conditional Use to Permitted by Right in C1 Zone  Nursing Home – Changed from Conditional Use to Permitted by Right in RH Zone PUBLIC AND INSTITUTIONAL USES changed to PUBLIC AND PRIVATE INSTITUTIONAL USES  Convention Center/Civic Center – Permitted by Right added in C2, Public & GMU Zones  Library – Permitted by Right added in C2 and GMU Zones  Public Assembly changed to Public or Religious Assembly 2 Zoning Ordinance Steering Committee Minutes October 4, 2019  Public or Religious Assembly – Conditional Use changed to Permitted by Right in AG Zone  Public or Religious Assembly – Permitted Use by Right added in Public Zone  Public or Religious Assembly – Conditional Use changed to Permitted by Right in GMU Zone  Religious Assembly stricken (added to Public Assembly)  Hospital – Permitted by Right added to CBD Zone and deleted from M1 Zone  Outpatient Services – Permitted by Right added to CBD Zone and deleted from M1 Zone  Campground (Tent and RV) – Conditional Use added to C2 Zone  Cemetery – Conditional Use added to AG and RR Zones  Golf Course – Conditional Use added in AG Zone  Emergency Residential Services – Permitted by Right added in CBD Zone  College and University Services – Conditional Use added in C1 Zone and Permitted Use by Right added in C2 Zone.  Educational Facilities (Primary) changed to Educational Facilities (Primary & Secondary)  Educational Facilities (Primary & Secondary) changed from Conditional Use to Permitted Use by Right in CBD Zone.  Educational Facilities (Secondary) deleted and added to Educational Facilities (Primary & Secondary)  Pre-schools added under Use Type and Conditional Use added in R1, R1S, RM, R3C & RH Zones.  Pre-schools added as Permitted Use by Right in C1, C2 & CBD Zones. COMMERCIAL USES  Commercial Recreation Indoor added as Conditional Use in AG Zone.  Brew Pub, Cocktail Lounge, Bar changed to Brew Pub, Cocktail Lounge, Bar and Winery  Brew Pub, Cocktail Lounge, Bar and Winery – Conditional Use added in AG, RR and P Zones.  Restaurant (Dine-In Only) – Conditional Use added in AG Zone and Permitted Use by Right in M3 Zone.  Restaurant (Drive in or fast food) changed to Restaurant (Drive through) and added as Permitted Use by Right in M3 Zone.  Auto Repaid will be circled back to at the next ZOSC meeting.  Car Wash – Conditional Use added in GMU Zone  Convenience Store/Fuel Station – Conditional Use added in GMU Zone  Commercial Parking Lot – Permitted Use by Right added in P Zone  General Merchandise – Permitted Use by Right added in GMU Zone  Green House/Nursery – Permitted Use by Right added in AG Zone and Conditional Use added in RR Zone  Supermarket – Permitted Use by Right changed to Conditional Use in C1 Zone.  Truck Stops – Permitted Use by Right changed to Conditional Use in C2 Zone.  Funeral Services – Conditional Use added in AG Zone.  Crematories – Conditional Use added in AG Zone.  Animal Clinic (Small) – Conditional Use added in AG Zone  Kennels – Conditional Use changed to Permitted Use by Right in AG Zone and Permitted Use by Right changed to Conditional Use in C2 Zone. 3 Zoning Ordinance Steering Committee Minutes October 4, 2019 VI. NEXT MEETING Billingsley gave an assignment to the committee members to go through the next 2 pages of the Use Table and send any questions/concerns directly to him so they might be addressed prior to the meeting. The next meeting will be October 16, 2019 from 8:00 am – 10:00 am in Council Chambers, City Hall. VII. ADJOURNMENT Billingsley called the meeting adjourned at 10:15 am. 4
