CITY OF MINOT ZONING ORDINANCE STEERING COMMITTEE Meeting Minutes December 04, 2019 8:00 am – 10:00 am City Council Chambers City Hall I. ATTENDANCE AND ROLL CALL Committee: Rolly Ackerman, Josh Wolsky, Tim Baumann, Pat Graner, Gloria Larsgaard, Rusten Roteliuk, Tyler Neether Absent: None Staff: Brian Billingsley, Community & Economic Development Director Lance Lang, Principal Planner Peter Baumgartner, Planner I Margie Zietz, Code Enforcement Officer Stefanie Stalheim, Assistant City Attorney Emily Huettl, Assistant City Engineer Glenda Sorensen, Planning Assistant Consultant: Scott Harmstead Guests: No external guests present Rolly Ackerman called the meeting to order at 8:01 am. II. APPROVAL OF MINUTES Motion by Wolsky to hold over approval of the November 20, 2019 meeting minutes until the next meeting, second by Graner. ayes: all, nays: none Motion passes III. REVIEW AND APPROVAL OF AGENDA Motion by Larsgaard to approve the agenda, second by Baumann. ayes: all, nays: none. Motion passes IV. INTRODUCTION OF GUESTS No external guests present. V. CHAPTER 26 (SUPPLEMENTAL REGULATIONS) Scott Harmstead gave updates on Chapter 26: Zoning Ordinance Steering Committee Minutes December 04, 2019 Chapter 26 – Supplemental Use Regulations Section 26.1 – Purpose  No comments/changes Section 26.2 – Using this Chapter  No comments/changes Section 26.3 – Rural and Agricultural Uses  Horses and hoofed animals will be specified in this section.  Consider other barnyard animals, hoofed, poultry,rabbits. Quantity allowed?  Lang asked Margie Zietz, Code Enforcement Officer, who enforces animal laws in the two-mile ETJ? She said the Animal Control Officer does not enforce except in rare instances within one-half mile of the City if it is a big deal.  Referral to Article XXX will be specified in final draft.  Baumann noted that commercial stables will be added to this section – to include therapeutic riding.  RR (Rural Residential) & MH (Manufactured Home Residential District) can have 2 horses, but there must be 2 acres and must be outside the City limits. Section 26.4 – Housing A. All Housing Units – under C1 District – strike # 3. B. Group Homes – # 2 will be simplified.  Lang added that above 6 occupants requires a CUP in the current ordinanace.  Baumann added that manufactured homes and townhomes be added to Group Homes. C. Apartments RM District – strike # 1. RH District – strike # 1. GMU District – modify # 2 to 60’. Strike 2nd sentence. Strike # 3. CBD District – strike # .2 Is there a reference to Chapter 26 in the Use Matrix for Townhomes and Multi- Family? D. Single Family Attached (Townhomes) Strike R3C as number of units per structure is not restricted in R3c, only in RM and RH Strike “or no more than eight (8) dwelling units if back to back” Is everyone comfortable with the definition for townhome? E. Accessory Dwelling Units  Strike # 1.  Modify # 3 to read “shall be” in place of “is”. 2 Zoning Ordinance Steering Committee Minutes December 04, 2019  Strike # 4.  #7 shall read: The entrance for an accessory dwelling unit shall be separate from the primary entrance and shall not be placed on the building front.  Strike # 9. Section 26-5 – Public and Institutional Uses Baumann noted Columbarium and Portable Class Rooms to be added to the matrix. A. Religious/Public Assembly  The restriction of no more than fifty persons limited to residential zones. More than fifty persons is ok in commercial zones. Many churches are located in R zones and have more than 50 people in attendance at a given time? Problem? B. C. Columbarium  Take out “Location”.  b. Take out “Setback”.  c. Take out ‘Signage”  d. Take out “Left Objects”. Section 26-6 – Commercial Uses B. Restaurants (Drive-thru) CBD District  Strike #s 1 & 2 C1 District  Strike #s 1 & 2  Revisit # 3 C. Restaurants (Dine-in)  Strike entirely D. Auto Repair and Auto Maintenance C2 District  Add open storage commercial screening requirements to # 3 as an option. F. Truck Stops  # 3 – take out “twenty feet”  # 5 – take out “fifteen feet”  # 7 – take out “forty feet”  Truck stops in Use Matrix? G. Car Wash  Baumann suggested discussing vehicle stacking space in Parking Chapter  # 4 – change verbiage from “no” (typo) to “nor”. 3 Zoning Ordinance Steering Committee Minutes December 04, 2019  Car Wash in Use Matrix? H. Motor Vehicle Sales C2 District  #2 – change Planning Staff to City Staff in last sentence. M1 District  Add Auto Auction to use Matrix?  # 1- add an additional sentence; “Industrial site development standards are required of the adjacent lot(s) to the primary business before the lot(s) can be used for display/storage of inventory. I. General Office  # 1 – change forty-five feet (45’) to sixty feet (60’).  # 2 – strike entirely J. Financial Offices/Institutions CBD and M3 Districts – strike M3 Districts  # 1 – Drive-thru facilities are not permitted – would require a CUP. K. Retails Sales and Services (Small) All Districts Where Permitted  # 1 – strike “Section 19-24.1 (it may change) CBD District  Strike # 1 L. Mixed Use Building C1, C2 and GMU District  #1 – strike entirely M. Off-Street Parking (Non-Commercial)  Strike section in it’s entirely. Move to Parking chapter. N. Day Care Centers  # 2 – hours of operation between changed from 6:00 a.m. to 9:00 p.m. Section 26-7 – Industrial Uses A. Sales or Service of Industrial, Agricultural, and Construction Equipment and Semi- trucks 4 Zoning Ordinance Steering Committee Minutes December 04, 2019 All Districts Where Permitted  # 1 – Change second sentence starting with “Typical commercial . . . to C2 district.  # 4 – expand on “c” – no auctions shall be permitted abutting residential uses or zoning.  I1 & I2 exempt? B. Construction Batch Plant (Permanent) All Districts Where Permitted  #2 – Delete sentence C. Construction Batch Plant (Temporary)  Delete entire section D. Construction Yards  Delete All Districts Where Permitted and limit to C2  # 1 – All open are areas should read all outdoor open storage E. Mining or Extraction of Oil and Related Resources Change “A” to “E”. All Districts Where Permitted  # 3 – Change verbiage to match # 2  # 4 – Change verbiage to match # 2  # 5 – Add “screening and security” before fence. F. Mining or Extraction of Mineral and Aggregate Resources All Districts Where Permitted  Subject to requirements of the Engineering Department.  Add financial surety section for reclamation of the site (i.e. bond). Lang thinks we need a section on Cargo Containers as individual units- Tackle in Temporary or Accessory uses. Start with “Cargo Container Yards” next meeting… A. Date/Time/Location. 1.
