April 17, 2013 ACTION: Approved as Amended. Committee Member Hill requested item #4, reflect the correct titles for members Vice Chair Bartram and Committee Member Sullivan. Committee Member Hill also requested the motion for 1375 Josselyn Canyon Road Agenda Item be altered to reflect that the findings for approval would be returned to the Architectural Review Committee for approval. Committee Member Jacoubowsky said he would like the minutes to reflect that he recused himself from the item and Committee Member Latasa was absent. 2. May 1, 2013 ACTION: Approved as Amended.  Architectural Review Committee Minutes Wednesday, May 15, 2013 Committee Member Hill requested item #9 be altered to reflect that Committee Member Dawson's motion was seconded by Committee Member Davis. ***End of Consent Agenda*** PUBLIC COMMENTS None. PUBLIC APPEARANCE 3. Adopt Resolution with Findings for Approval of a New Vehicle Oriented Freestanding Sign at 1375 Josselyn Canyon Road ACTION: Adopt Resolution with Findings for Approval of a New Vehicle Oriented Freestanding Sign at 1375 Josselyn Canyon Road Committee Member Jacoubowsky recused himself from the item. Committee Member Dawson said approval of this resolution is not binding for future projects and will not set a precedent. He said the proposed location of the sign is a unique corner with numerous vertical elements. Committee Member Latasa said, had he been present for the meeting, he would have voted against the item. He said approving signage that points toward a scenic highway is serious. He said the resolution needs to reflect this will not set precedence and he noted the applicant’s name needs to be altered from Dennis Hodgin to Daryl Hawkins. Committee Member Davis made a motion to adopt the Resolution with the following amended findings: Freestanding Signs – Vehicle Oriented A. There should be no more than one vehicle-oriented freestanding sign per street frontage. This property already has two such signs. However, the corner of the site is uniquely a frontage because it delineates itself separately from the frontages of the other two streets. Therefore, the location of the sign on the corner is appropriate. Committee Member Sullivan seconded the motion. Committee Member Dawson said he still has trouble considering the cross as a sign. Consider 867 Pine Street; AR Application 13-119 for Preliminary Architectural Review and Tree Permit for the Removal of Three Coast Live Oak Trees; Applicant Roy Poss; Owner Philip and Kristine Edington; R-1-5 Zoning District; Exempt from CEQA Requirements. ACTION: Continued the item with direction to the applicant relocate the house approximately 10 feet toward the rear of the property and redesign as necessary to accommodate retention of the trees on the site, reduce the width of the front stairs to four feet at each flight, redesign the chimney for the direct vent fireplaces to look like a true chimney and direct the venting up toward the roof, add more windows on the south elevation to create more articulation to break up the unrelieved wall and to take advantage of the southern sun exposure. Staff Presentation/Committee Member Questions: Christine Hopper Presented the Agenda Report and answered Committee Members' questions. Applicant: Roy Poss, applicant, said the home is currently three feet and six inches away from the tree in question, moving further toward the rear of the property would result in the loss two trees in the backyard. Public Comment: Sharon Dwight, President of the New Monterey Neighborhood Association, said, in genera,l properties in the New Monterey Area have 20 foot setbacks. She said setting the house back further would make the property more consistent with the character of the neighborhood. She expressed that the New Monterey Neighborhood Association would rather see a loss in square footage than to see the loss of trees. Ms. Dwight also suggested that design incorporate additional interest and lighting. Committee Member Comments: Committee Member Jacoubowsky said the large oak tree in the front yard has a greater positive impact on the neighborhood than the trees located in the rear of the property, therefore, moving the house back should be one of the primary considerations. Committee Member Latasa suggested narrowing the front staircase to help mitigate the need to remove the tree. Committee Member Jacoubowsky concurred with Committee Member Latasa's suggestion and said making alterations to the staircase would result in an easier transformation and avoid a major redesign. Committee Member Sullivan said the fireplace should be built as an element within the house. Committee Member Davis said he would like the item to return to the Architectural Review Committee (ARC) for further review if the staircase were to be altered. Consider 843 Via Mirada; Tree Removal Permit 13-166 for Removal of One Monterey Pine Tree; Applicant Wendy and David LaRiviere; Owner Tom and Laura Hibert; R-E-20-D1 Zoning District; Exempt from CEQA Requirements Mike Dawson recused himself from the item due to a conflict of interest. Staff Presentation: Christine Hopper presented the Agenda Report and answered Committee Members' questions. Applicant: Dave and Wendy LaRiviere requested that a tree, located on the neighboring property, be removed. Mr. LaRiviere said that their master bedroom is being threatened by the presence of the tree, which is leaning toward their property. He said the tree has caused significant uplift causing their gate to scrape, and fallen limbs have resulted in loss of television and internet service. Committee Member Davis asked the applicant if they had considered pruning back the branches. In response to Committee Member Davis' question, the Mr. LaRiviere said they had requested the removal of a large tree branch but the City Forester denied their request. Public Comment: None. Committee Member Comments: Committee Member Latasa said although the tree is prominent and aesthetically appealing, he cannot ignore the anxiety of the applicant and is therefore in support of granting the appeal. Committee Member Hill asked for further detail about the applicant owning the neighboring property and not the lot that contains the tree in question. In response to Committee Member Hill's inquiry, Ms. Hopper said approval will not require that the property owner remove the tree, it will simply allow them to do so. Committee Member Davis made a motion to approve the appeal to remove the tree with the finding that due to the extent of the concern and anxiety and the degree of damage 4  Architectural Review Committee Minutes Wednesday, May 15, 2013 the tree roots are causing to the neighboring property, approval to remove the tree is appropriate. and added Condition of Approval: Special: 1. That, the Monterey Pine tree approved for removal will require a one-for-one replacement, the size (container size and/or diameter of tree) and location to be determined by the City’s Urban Forester. Committee Member Latasa seconded the motion. On a motion by Committee Member Davis, seconded by Committee Member Latasa, and carried by the following vote, the Architectural Review Committee approve the appeal to remove the tree with added Conditions of Approval. Davis; Owner Andrea Olsen; R-1-6-D1 District; Exempt from CEQA Requirements. ACTION: Adopted a resolution approving Preliminary and Final Architectural Review with Conditions of Approval. Applicant: Paul W. Davis, on behalf of Andrea Wilson, said the intention is to update the house from T1-11 siding to a low maintenance option. He said the reason for the reverse floor plan is that the property owner wants to take advantage of the view of the peninsula. Public Comment: None. Committee Member Comments: Committee Member Latasa said the project is of great design and there are no obvious view issues. Consider 763 Wave Street; Sign Permit 13-129 for a Multitenant Sign Program; Applicant Anjanette Adams for Monterey Signs; Owner Cannery Row Company; C- 2 Zoning District; Exempt from CEQA Requirements. ACTION: Adopted a Resolution approving a Sign Permit for a multitenant sign program with added Conditions of Approval. Staff Report/Committee Member Questions: Christine Hopper presented the Agenda Report and answered Committee Members' questions. Applicant: John Pisto said he has occupied this property for 45 years, over these years they have included additions to the business designating it as a true steakhouse. Mr. Pisto said they would like to highlight the food choices at their business with new signs. Frank Donangelo, Cannery Row Company, said they support the new signs. Mr. Donangelo said the site is unique in that there is not heavy foot traffic and the building is isolated from many of the other attractions on Cannery Row. Public Comment: Sharon Dwight, New Monterey Neighborhood Association President, said that the Neighborhood Association has historically taken opposition to signs that exceed City standards, but in this case they think the scale is appropriate. Ms. Dwight noted the neighborhood association would like to see greater rational in the resolution as to why the signs are being approved outside the standards. Committee Member Comments: Committee Member Davis said the additional signage is justifiable due to the double frontage of the building. Committee Member Hill made a motion to adopt a Resolution approving a Sign Permit for a multitenant sign program with added Conditions of Approval as follows: Special: 6. That the proposed signs for The Whaling Station are approved as part of this project. Committee Member Sullivan said he is not in favor of the aluminum store front on the Regency Theater building on Alvarado Street. INFORMATIONAL REPORTS & STAFF COMMENTS Christine Hopper reminded the Committee Members that the Council Chamber would undergo Americans with Disabilities Act (ADA) upgrades beginning June 5, 2013. 8. June 11, 2013- Joint Planning Commission/ Architectural Review Committee Meeting Ms. Hopper notified the committee that the June 11, 2013 Planning Commission evening session would be a joint meeting with the ARC to discuss the Van Buren Senior Housing Project.
