CONSENT ITEMS Approval of Minutes 2. May 6, 2020 Action: Approved as submitted. Mr. Schmidt referenced a photo submitted by the owner of 442 Archer and explained new design elements. No other correspondence from neighbors was received. Committee Member Conner asked where in each house the views and privacy would be impacted. Mr. Schmidt explained the photos were mostly taken outside on backyards or patios and not within the dwellings. Vice Chair Bluth referenced the Planning Commission (PC) appeal hearing and asked whether the commented-on items remained relevant. Mr. Schmidt described how the design may still have an impact on views, though the proposal meets zoning criteria. Committee Member Tregenza asked how much the design was lowered. Mr. Schmidt believed each plate had been lowered 1.5 feet. Applicant and Owner Robert Gularte mentioned the proposed ceiling heights are 8 feet each and hopefully will not need to be shorter. The Applicant described difficulties with property topography that could hinder construction lower than the proposed amount and claimed everything has been done to render the plate height as low as possible. Committee Member Pauly referenced a plan pdf and asked for details regarding the cantilever. Mr. Gularte explained the deck is proposed to cantilever because the structure initially looked top-heavy. Applicant Mr. Gularte joined the teleconference to answer Committee Members’ questions. Public Comments Glen Mathys, owner at 442 Archer Street, stated he is on the edge of losing his whole view and requested that the ARC recommend levelling off the top floor to preserve it and retain Mr. Gularte’s new and existing views. Committee Member Comments Committee Member Tregenza commended the amount of work the applicant had done and suggested considering the applicant is adding to a view rather than gaining a new one while taking views from four other people. The Committee Member added that the new proposal meets all guidelines and will be an asset to the neighborhood. Vice Chair Bluth agreed, stating all homes have a right to a second story and this proposed project meets all guidelines. Committee Member Tregenza asked Staff for guidelines on factoring in existing views. Mr. Schmidt referenced the Agenda Report to cite a goal of shared views, asserting that with a second story 415 Spencer could get a view likely comparable to neighbors’ first- story views because the existing first story is much lower than those of the neighbors. The Planner explained that the applicant has identified impacts to neighbors and mitigated them much more equitably than previously designed, and further stated construction permitted by Monterey’s development standards also should have access to views. Mr. Schmidt mentioned the applicant is establishing views while trying to preserve existing views, and reiterated the current project proposal conforms to existing development guidelines, such as lowering the plates by 1 foot, abiding by setback rules, and limiting view impacts by creating a view between structures. The Committee Member expressed satisfaction with the design and follow-through of design guidelines and mentioned the lower roof height improves views that may have been lost with the original design. Committee Member Pauly acknowledged the applicant fundamentally changed the house’s look and feel with the redesign, but surmised the views remain blocked and the privacy concerns still exist. The Committee Member did not see tremendous benefits to the new change, apart from views at 442 Archer. Mr. Schmidt referenced photos from that property to show view impact differences. Mr. Gularte affirmed the total building height was lowered 3.5 feet between the raised corners, and claimed the new design meets all guidelines provided by the PC. The Applicant suggested replacing the Carmel stone with stucco, advising several houses in the neighborhood have similar architecture. Committee Member Tregenza mentioned the PC requested better neighborhood integration and suggested the new proposal looks like it could have been the original design. Additionally, Mr. Tregenza agreed the Carmel stone would match better. Committee Member Conner agreed that the applicant invested a lot of work toward the new design and supplied that if it were built directly on top of the existing structure views would be more impacted. The Committee Member believed the view impacts were minimized and everyone’s rights were balanced, considering all PC guidelines had been followed. Committee Member Carter agreed with the majority, stating there is a significant change in design and the applicant had gone quite far to meet the requests of the PC. On a motion by Committee Member Rath, seconded by Vice Chair Bluth, and carried by the following vote, the Architectural Review Committee approved Architectural Review Application ARP-20-0072 for preliminary and final architectural review to allow 1st and 2nd story additions and a 2nd story deck at 415 Spencer Street.
