CALL TO ORDER
Chair Hunter called the meeting to order at 4:01 p.m. Recording Secretary Barrera provided
information to the public about how to participate by calling in to give public comment on the live
web meeting.

Action: Approved as submitted.
On a motion by Vice-Chair Tregenza, seconded by Committee Member Schmidt, and
carried by the following vote, the Architectural Review Committee approved the March
15, 2023, minutes as submitted:

PUBLIC COMMENTS
Robert Ashmore shared concern over an approved project at 222 Via Del Rey. Mr. Ashmore
stated the conditions of opaque lower windows are not being met and would like to know how
to proceed.
Lorna Moffat stated she appealed the project at 2 Upper Ragsdale Drive and thanked the
Architectural Review Committee (ARC) for their help.

Preliminary and Final Architectural Review of a New Two-Story Single-Family
Dwelling, and Tree Removal Permit ART-23-0052 for the Removal of One Tree;
Applicant Mark Ellis, Ellis Architecture Inc.; Owner Maria Costa; R-1-12 Zoning
District; Low Density Residential General Plan Designation (Exempt from CEQA
per Article 19, Section 15301, Class 1, and Section 15303, Class 3)
Action: Approved with Conditions Architectural Review Permit ARP-21-0149 for
Preliminary and Final Architectural Review of a New Two-Story Single-
Family Dwelling, and Tree Removal Permit ART-23-0052 for the Removal of
One Tree at 50 Ave Maria Road.
Staff Presentation/Committee Member Questions
Principal Planner Roveri presented the Agenda Report and answered Committee
Members’ questions.
Committee Member Ostovar asked if there are concerns about the number of trucks
going in and out, if it will be a disturbance to the community, and if the arborist reviewed
the impact on existing trees. Ms. Roveri answered the city forester has reviewed the
recommended replacement tree but is unsure if they reviewed the impact of trees.
Applicant
Mark Ellis, architect and applicant, clarified only one tree will be impacted and the
grading volume will be balanced by settling the house into ground and having a side
retaining wall.
Committee Member Ostovar asked for clarification on the design of the driveway and
what kind of protection measures are being taken for the three large oaks. Mr. Ellis
explained the existing driveway was steeper than the current standards and the trees will
not be impacted near the top of the driveway but near the garage, and careful retaining
will need to be done.
Public Comments
Lorna Moffat asked the applicant to explore alternative options than removing the tree.
Committee Member Comments
Vice-Chair Tregenza suggested a 3:1 tree replacement ratio. Committee Member
Schmidt asked about standard tree replacement. Ms. Roveri clarified that the standard
tree replacement is outlined in the city code.
Committee Member Ostovar spoke in favor of design and tree replacement. Committee
Member Ostovar expressed concern about the large oak near the driveway due to the
amount of cutting.
Committee Member Pauly noted the width of the driveway is narrow and in a critical root
zone.
Vice-Chair Tregenza questioned if the city forester looked at the oak and if it is safe. Ms.
Roveri clarified the forester looked at the removal and replacement tree.

would be to save the oak tree. Committee Member Pauly suggested bridge footing.
Committee Member Carter asked if there is a concern about oak roots growing under a
home. Committee Member Ostovar answered yes but if it is impacted by the roadway, it
shouldn’t be an issue.
Vice-Chair Tregenza asked if the proposed driveway material is pavers. Ms. Roveri
confirmed they are proposed to be pavers.
Chair Hunter reopened public comment.
Mr. Ellis explained the grading plan in more detail and expressed a desire to save the
oak trees.
Lorna Moffat thanked the Committee for bringing up the issue of the oak tree and
commended the applicant for wanting to save them.

Vice-Chair Tregenza stated the applicants seem to be putting a good faith effort to save
the oaks and suggested a condition that the applicants take necessary steps to make
sure the trees survive.
Committee Member Pauly spoke in favor of the design of the house and pointed out the
clay tiles in the drawings are plastic tiles. Committee Member Pauly noted the plastic tiles
will not achieve the desired appearance and encouraged the applicants to use clay tiles.
Vice-Chair Tregenza suggested the applicant obtain a report from a licensed arborist on
how to mitigate the trees.
Committee Member Carter made a motion to approve with the added condition that the
applicant submit a certified arborist’s report which details best practices to preserve
onsite oak trees.
On a motion by Committee Member Carter, seconded by Vice-Chair Tregenza, and carried by
the following vote, the Architectural Review Committee approved Architectural Review Permit

Staff Presentation/Committee Member Questions
Principal Planner Roveri presented the Agenda Report and answered Committee Members’
questions.
Committee Member Pauly questioned if the building is historic. Ms. Roveri clarified that the
wharf decking is potentially historic, but the building does not qualify to be designated
historic.
Vice-Chair Tregenza asked clarifying questions about the business next door and if there
has been any public comment. Ms. Roveri stated the tenants have not complained to the
Planning Office and no public comments have been received.
Committee Member Carter asked clarifying questions on the location and use of the storage.
Committee Member Schmidt asked if building on top of the deck affects historic preservation.
Committee Member Ostovar asked for confirmation that the proposed project is the same
footprint. Ms. Roveri answered proposed project will not affect the historic preservation and
the footprint will be the same.
Applicant
Ryan Cornelsen, applicant and architect, explained the goal and location of the project and
answered Committee Member’s questions.
Ms. Roveri added that the ceiling next door is vaulted, and it is not two stories.
Committee Member Carter asked if the storage is meant to be refrigerated. Mr. Cornelsen
said the goal is to clean up the area, provide additional storage, and it is not meant to be
refrigerated.
Committee Member Pauly asked if there was room to get a cricket out. Mr. Cornelsen said
the space is small but there is room to get a cricket out.

to the next regularly scheduled Architectural Review Committee Meeting, or continued to
a Special Meeting.
Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office,
or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the
meeting.
Members of the public have the right to address the Committee on any Agenda items. The Chair will
formally open the floor for public comment. However, if you wish to speak to items during "Consent
Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that
item and you will be recognized. Notification as much in advance as possible is appreciated.
Information distributed to the Committee at the meeting becomes part of the public record. A copy of
written material, pictures, etc. should be provided to the Secretary for this purpose.
Architectural Review Committee decisions may be appealed within ten (10) days from the date of the
decision on forms available in the Planning Division during business hours. When the tenth day falls
on a weekend or a holiday, the appeal deadline date is the next working day following the holiday or
