CALL TO ORDER
Mayor Della Sala called the meeting to order at 7:00 p.m.
CONSENT ITEMS
City Manager Meurer said that there is a request to remove Item 4 from the Consent Agenda.
He recommended that, because of a school district meeting tonight, Council continue that item
to the next meeting. Councilmember Haferman recused himself from voting on Item 2 because
he was not present at the meeting. Councilmember Downey asked to amend the January 4
meeting Minutes on page 6 under Council Comments to read, "indicating why a member voted
against the decision."
On a motion by Councilmember Haferman, seconded by Councilmember Selfridge, and carried
by the following vote, the City Council approved the Consent Agenda, except item 4, which was
removed for discussion, and with an amendment to Item 1, and with Councilmember Haferman
abstaining from Item 2:

On a motion by Councilmember Sollecito, seconded by Councilmember Downey, and carried
by the following vote, the City Council continued the item to February 1, 2011:

PUBLIC COMMENTS
Mayor Della Sala opened the floor for public comment on items not on the agenda. Michael
Stansbury, owner of Easy Street Billiards, voiced concerns regarding the requirement for him to
install a grease trap, saying that it will be a hardship for him, his business is not a restaurant,
and he has very few food sales. He asked Council to create an exemption based on volume or
the dollar amount of food sold. Christine Bettencourt voiced concerns regarding the use of
pesticides and supported the City's pest management plan. She said that she has been
homeless for over five years due to the use of pesticides by her neighbor. Having no further
requests to speak, Mayor Della Sala closed public comment.
COUNCIL COMMENTS
Councilmember Downey reported on a meeting with Fisherman's Wharf Association, and urged
people to attend Whalefest on January 22. She asked to add lights to the trees downtown that
would cover the trunks down to the ground. Councilmember Selfridge asked for an update on
opening the adobes. She said that she is holding off agendizing Executive Management pay for
two weeks.
Councilmember Sollecito said that he will be serving on the League's Public Safety Committee.
Councilmember Haferman asked to institute a practice of acknowledging the service of Board
and Commission members who are stepping down. Mayor Della Sala agreed that those
volunteers are deserving of recognition. Councilmember Haferman noted that the City
responded to an earlier speaker with a letter on how to resolve his concerns regarding the
grease trap requirement at his business.
Councilmember Selfridge announced that the Library would be holding Wine and Chocolate
Night on February 18.
Mayor Della Sala noted that even with the upcoming budget cuts that the State is proposing,
the City is making some progress on keeping the State-owned adobes open. He thanked the
Board and Commission volunteers. He said that the Mayors of Monterey and Carmel have
been appointed the municipal advisors for the regional desal plant project.

CITY MANAGER REPORTS
City Manager Meurer reminded Council that they have several upcoming meetings, including a
Study Session, Retreat, and performance evaluations for him and the City Attorney.
Mayor Della Sala adjourned the meeting to closed session at 7:34 p.m.
ANNOUNCEMENTS FROM CLOSED SESSION
Information Resources Director/City Clerk Gawf announced that the City Council received a
report and gave unanimous confidential direction to their legal counsel in a conference with
legal counsel regarding the City Attorney's Year-end Litigation Report. She reported that in a
conference with the City's real property negotiators regarding an extension of the Tidelands
Leases adjoining 400 Cannery Row (Monterey Plaza Hotel) for the purpose of refinancing, the
City Council gave confidential direction to their negotiators on a roll call vote of 3-2, with
Downey and Selfridge voting no. Ms. Gawf said that in a second conference with the City's real
property negotiators regarding a request to sell 570 Munras Avenue (Uptown Monterey) to the
tenant, GLC/Foothill Monterey, the City Council gave confidential direction to their negotiators
on a roll call vote of 4-0-1, with Della Sala not participating due to a potential conflict of interest.

PUBLIC COMMENTS
PUBLIC COMMENTS allows you, the public, to speak for a maximum of three minutes on any
subject which is within the jurisdiction of the Monterey City Council and which is not on the
agenda. Any person or group desiring to bring an item to the attention of the City Council may do
so by addressing the Council during Public Comments or by addressing a letter of explanation to:
City Clerk, City Hall, Monterey, CA 93940. The appropriate staff person will contact the sender
concerning the details. NOTE: Public Comments are taken during the afternoon session and
continued at the evening session. Individuals may choose to speak once for up to three minutes at
either session, but not both.

COUNCIL COMMENTS
Councilmembers may ask a question for clarification, make a brief announcement or make a brief
report on his or her activities. In addition, Council may provide a referral to staff or other resources
for factual information, request staff to report back to the body at a subsequent meeting
concerning any City matter, or direct staff to place a request to agendize a matter of business on a
future agenda (G.C. 54954.2).
CITY MANAGER REPORTS
The City Manager may make a brief report on his activities or a brief announcement. He may also
ask for clarification or direction regarding scheduling of Council meetings and study sessions.

Members of the public have the right to address the City Council on any item on the Agenda, before or
during its consideration [G.C. §54954.3(a)]. The Mayor will formally open the floor for public comment on
items such as "Public Appearance" and "Public Hearings." If you wish to speak to items in any other
categories, for example "Consent Agenda," please advise the City Clerk or the Mayor prior to the
Council's action on that item, and you will be recognized. Notification as much in advance as possible is
appreciated.
The City Council meeting packet may be reviewed by the public in the Library or the City Clerk's Office.
Any writings or documents pertaining to an open session item provided to a majority of the City Council
less than 72 hours prior to the meeting, shall be made available for public inspection at the front counter
at the City Clerk's Office, Room 6 at City Hall, Madison & Pacific Streets, Monterey, California 93940
during normal business hours
Information distributed to the Council at the Council meeting becomes part of the public record. A copy of
written material, pictures, etc. should be provided for this purpose.
