Councilmembers commented briefly on Item 4, noting the great amount of work that has been done on this matter. PUBLIC COMMENTS Mayor Della Sala opened the floor for public comments on items not on the agenda, no one came forward, and public comments were closed. 2  City Council Minutes Tuesday, September 20, 2011 PUBLIC HEARING 11. 1st Reading - Amend Ordinance No. 3376 Establishing the Monterey County Tourism Improvement District and Changing the Use of Proceeds and the Assessment Amount (Finance - 407-08) Action: Held Public Hearing; received report that there was no majority protest; passed Ordinance to print (3-0-2; Downey and Haferman absent) Finance Director Rhoads presented the staff report. Mayor Della Sala opened the Public Hearing. John Lambeth, Civitas, congratulated Council on their existing district and noted that the new district would be even more advantageous. Rene Boskoff, General Manager of Monterey Marriott, said that there are many people from the hotel and tourism industry present and in support of the item. He asked those individuals to stand to show support, and a majority of the audience stood. Having no further requests to speak, Mayor Della Sala closed the hearing. John Koostra, owner and applicant, gave a brief history of the architecture of house and its ownership. Having no further requests to speak, Mayor Della Sala closed the hearing. Approve Final Architectural Review for Construction of a New Ticket Kiosk at 90 Fisherman’s Wharf No. 1 (Plans & Public Works - 701-18) Action: Accepted the ARC recommendation and approved Final Architectural Review (3- 0-2; Downey and Haferman absent) Senior Planner Ebbs presented the staff report. Mayor Della Sala opened the floor to the applicant. Anthony Lombardo, applicant's representative, asked Council to approve the recommendation. Anthony "Nino" Palma, holder of the master lease for Isabella's, said that he does not believe that any building, no matter how small, should be built on the wharf. He asked Council to delay their decision until a master plan is completed and all Councilmembers are present. Chris Palma, Limited Partner of Wharfside, Inc, said that a previous ticket stand was removed. He said that the new stand will block views, and he protested having this structure built. Having no further requests to speak, Mayor Della Sala closed public comment on the item. Councilmember Sollecito said that while there are always differences of opinion and there is no right or wrong on this issue, he sees no reason to overrule the ARC, Planning Commission, and staff recommendations. On a motion by Councilmember Sollecito, seconded by Councilmember Selfridge, and carried by the following vote, the City Council accepted the ARC recommendation and approved the Final Architectural Review for construction of a new ticket kiosk at 90 Fisherman’s Wharf No. 1: AYES: 3 COUNCILMEMBERS: Selfridge, Sollecito, Della Sala NOES: 0 COUNCILMEMBERS: None ABSENT: 2 COUNCILMEMBERS: Downey, Haferman ABSTAIN: 0 COUNCILMEMBERS: None RECUSED: 0 COUNCILMEMBERS: None COUNCIL COMMENTS 14. Request to Agendize a Discussion of the Potential for the City of Monterey to Operate the Dry Boat Storage Yard (Councilmember - 904-01) Action: Agendized by consensus Councilmember Selfridge said that she observed how much the City has done to make the parking areas look good at the waterfront and she believes that staff could make the boat storage yard better. She clarified that this could be a temporary measure. On question, staff clarified that if this matter were taken up by the Council before the end of the year, it would dovetail with the Waterfront Master Plan. Councilmembers agreed by consensus to agendize the matter before the end of the year. 15. Councilmember Request to Agendize City Support for a Veterans' Day Concert at the Golden State Theater (Councilmember - 302-06) Action: Withdrawn Councilmember Selfridge withdrew her request due to the concert sponsor’s agreement to postpone the concert to another occasion. 4 City Council Minutes Tuesday, September 20, 2011 Councilmember Selfridge reminded people of the upcoming Art in the Adobes event. Mayor Della Sala said that he had the honor to visit a group of reserve soldiers on their way to a tour in Afghanistan. He thanked those soldiers and their families for their sacrifice. He noted that less than one percent of the population is serving in the armed forces and protecting the rest of us. CITY MANAGER REPORTS City Manager Meurer reported that an update on part of the Downtown Plan, jointly funded by property owners and the City, would be presented at the September 28th Study Session, and that a Water Forum would be held on October 26th. Council adjourned to Closed Session at 4:46 p.m. ANNOUNCEMENTS FROM CLOSED SESSION Information Resources Director/City Clerk Gawf reported that on a roll call vote, the City Council gave confidential direction to their Legal Counsel regarding existing litigation, City of Monterey versus Riina. She said that the vote was 3-0-2, with Councilmembers Downey and Haferman absent.
