MINUTES CITY COUNCIL REGULAR MEETING CITY OF MONTEREY Tuesday, July 17, 2012 Afternoon Only 4:00 - 5:30 p.m. COUNCIL CHAMBER, FEW MEMORIAL HALL OF RECORDS MONTEREY, CALIFORNIA Councilmembers Present: Councilmembers Downey, Selfridge, Sollecito, Della Sala Absent: Councilmember Haferman City Staff City Manager, City Attorney, Director of Information Resources/City Clerk, Present: Assistant City Manager, Finance Director, Community Services Director, Chief of Planning, Engineering, and Environmental Compliance, Interim Deputy City Manager, Plans & Public Works, Housing & Property Manager, City Engineer, Police Lieutenant, Associate Planner, CALL TO ORDER Mayor Della Sala called the meeting to order at 4:00 p.m. PRESENTATIONS 1. Recognize the 20th Anniversary of the Monterey Bronco World Series and Support the Monterey Bronco All Star Team (Human Resources - 701-17) Action: Recognition given Mayor Della Sala gave a presentation, recognizing and congratulating the members of Monterey's All Star Team. 2. Receive a Presentation from the Transportation Agency for Monterey County on Highway 156 (Plans & Public Works - 803-12) Action: Received and discussed presentation Debbie Hale, TAMC Executive Director, gave a presentation on the possibility of creating a toll road in order to obtain funding for the needed improvements on Highway 156. Mayor Della Sala opened the floor for public comments on the item. Jan Mitchell, Prunedale Preservation Alliance representative, said that her group has requested but not received a list of options for the 156-101 interchange. She opposed the Highway 156 improvement project, saying that the congestion is a weekend problem only. Hank Armstrong, Monterey Bay Aquarium, said that the congestion on Highway 156 has been an ongoing problem. He supported the proposed project, as well as studying tolling as a potential funding option. Ed Mitchell, Prunedale Neighbors group and Prunedale Grange representative, spoke in opposition to the project, saying that it would negatively impact neighborhoods in the North County with no benefit. He suggested retaining the toll funds for improvements to mitigate issues in North County. Joan Ellis, Castroville resident, voiced concerns about the traffic on Highway 156, and said that she and her husband want to be involved with any solutions. Having no further requests to speak, Mayor Della Sala returned the discussion to the dais. On question from Council, Ms. Hale explained that the use of tolls and any sunset would be  City Council Minutes Tuesday, July 17, 2012 determined by the TAMC board. On further question, She explained that a toll road is not required to be put before a public vote and that the traffic study will take weekdays and weekends into account. She said that the TAMC board would determine how the toll road would be operated, whether public or private. CONSENT ITEMS City Manager Meurer asked Council to table Item 11, and suggested that Council receive a presentation on Item 10. Councilmember Downey asked for a staff report on Item 9 as well. (4-0-1; Haferman absent) On question from Councilmember Downey, Chief of Planning and Engineering Rerig explained the funding is a combination of grant funds and NIP "matching" funds. Mayor Della Sala opened the floor for public comments, and having no requests to speak returned the discussion to the dais. On a motion by Councilmember Downey, seconded by Councilmember Sollecito, and carried by the following vote, the City Council adopted Resolution No. 12-115, authorizing the City Manager to enter into a sub-grantee agreement for the Areas of Special Biological Significance Refined 2006 Feasibility Study of Alternative Management Plan with the Monterey Peninsula Water Management District: AYES: 4 COUNCILMEMBERS: Downey, Selfridge, Sollecito, Della Sala NOES: 0 COUNCILMEMBERS: None ABSENT: 1 COUNCILMEMBERS: Haferman ABSTAIN: 0 COUNCILMEMBERS: None RECUSED: 0 COUNCILMEMBERS: None 10. (4-0-1; Haferman absent) ***End of Consent Agenda*** PUBLIC COMMENTS Mayor Della Sala opened public comments on items not on the agenda, and having no requests to speak, closed public comments. COUNCIL COMMENTS Councilmember Selfridge congratulated Assistant City Manager McCarthy and welcomed him to his new role. Councilmember Downey seconded that comment and welcomed Deputy City Manager Uslar to his new position. She gave a brief update on a recent meeting about the water supply. Councilmember Sollecito reported on a League meeting regarding redevelopment and pension reform. He said that he appreciated that Monterey has already done everything and more on pension reform that was suggested at that meeting, and he is proud of the City and employees for moving ahead with these reforms. Mayor Della Sala agreed and clarified that Monterey's new safety employees would start with a 2% at 50 pension plan and non-safety employees would start at 2% at 60. He further explained that all Monterey employees pay all of their own share of the PERS rates, plus a portion of the City's share. He reported that Monterey's employees have done their fair share in working with management to run the City as cost-effectively as possible. The Mayor reported that he recently received an email from a gentleman thanking him for the quick remedy of a problem with trash receptacles that had been previously reported to the Council. CITY MANAGER REPORTS City Manager Meurer reported that the City Attorney and Finance Director were able to use the City’s SIRE content management system while they worked from home over the weekend to put together an important letter along with documentation that helped the City avoid having to immediately pay $3.5 million to the State. Mr. Meurer reported that the nomination period has opened for the November election of two City Council members and the Mayor, and that it would close on August 10th, or if an incumbent chooses not to run, August 15th. ***Adjourn to Closed Session*** Mayor Della Sala opened the floor for comments on the closed session items, and having no requests to speak, closed the floor. Mayor Della Sala adjourned the meeting to closed session at 5:28 p.m. ANNOUNCEMENTS FROM CLOSED SESSION Information Resources Director/City Clerk Gawf announced that the City Council received a report on the litigation update on the cases listed in Item cs1. She said that the City Council gave confidential direction to their legal counsel regarding Item cs2, a conference with legal 4 City Council Minutes Tuesday, July 17, 2012 counsel to decide whether to initiate litigation regarding City of Monterey versus State of California, Auditor-Controller of the County of Monterey and Real Party in Interest Successor Agency to the Redevelopment Agency of the City of Monterey. The vote was 4-0-1, with Haferman absent.
