Amend the 2012-2013 Position Control List for Plans and Public Works Department by Adding One (1) Senior Engineer and One (1) Engineering Technician in the Capital Projects Division for Three (3) Year Contracts and Approve a Temporary Overfill of One (1) Administrative Analyst in Housing and Property Management Office until June 30, 2013 (Plans & Public Works - 502-03) Action: Removed from Consent; discussed; adopted Resolution No. 12-164 C.S. (5-0) and Resolution No. 12-165 C.S. (4-1; Selfridge voting no) Deputy City Manager Plans and Public Works Uslar presented the staff report and answered Councilmembers' questions. Councilmember Selfridge voiced concerns regarding the request for an overfill and whether this action could be delayed and considered as part of the budget cycle. She asked staff to be sure to conduct the recruitment correctly, and Mr. Uslar assured her that it would be, as usual. Ms. Selfridge asked to bifurcate the motion. Chief of Planning and Engineering Rerig presented the staff report and answered Councilmembers' questions. 2  City Council Minutes Tuesday, November 6, 2012 Councilmember Downey voiced concerns about cleanliness. Councilmember Sollecito added that it would be required to keep the area clean. Mayor Della Sala opened public comments on the item. Rick Johnson, Executive Director of OMBA, said that his board looked at this, but did not take a vote on it. He encouraged Council to move forward on this proposal to encourage Downtown vitality. Mike Miele said that he has conducted this type of business in Monterey in the past, and this area presents a unique opportunity. He said that if he were the vendor, he would clean the entire area of the Plaza. Having no further requests to speak, Mayor Della Sala returned the discussion to the dais. On a motion by Councilmember Sollecito, seconded by Councilmember Selfridge, and carried by the following vote, the City Council adopted Resolution No. 12-167 C.S., directing staff to issue a Request for Proposal (RFP) for a food vendor use of Simoneau Plaza: AYES: 5 COUNCILMEMBERS: Downey, Haferman, Selfridge, Sollecito, Della Sala NOES: 0 COUNCILMEMBERS: None ABSENT: 0 COUNCILMEMBERS: None ABSTAIN: 0 COUNCILMEMBERS: None RECUSED: 0 COUNCILMEMBERS: None 7. Approve Request for Use of City Property, Services and Street Closure for First Night Monterey Event on Saturday, December 31, 2012 (Recreation & Community Services - 302-02) Action: Adopted Resolution No. 12-168 C.S. 8. Authorize the City Manager to Reimburse the City of Salinas for Monterey's Share of the Cost for a Community Engagement Consultant. (City Manager - 101-04) Action: Adopted Resolution No. 12-169 C.S. Recommendation for Appointments to the Administrative Appeals Hearing Board (City Clerk - 701-06) Action: Approved ***End of Consent Agenda*** PUBLIC COMMENTS Mayor Della Sala opened public comments on items not on the agenda. Gordon Smith, Villa Del Monte neighborhood, showed a video, saying that it shows a violation of the rules regarding the use of the Helvic gate. He asked what the City is going to do with regard to the vacant Fresh & Easy property. Mayor Della Sala noted that the Fresh & Easy site is privately owned property, and the City does not control it. He said that the owners are going to build a fence around it. City Manager Meurer explained some history of the Helvic gate and suggested that it might be possible to alter the conditions of approval. Having no further requests to speak, Mayor Della Sala closed public comments. COUNCIL COMMENTS Councilmember Sollecito voiced support for the recently revitalized Sister City Program. He asked to agendize an item to elevate the program and give it more exposure, such as developing a commemorative area in a park around that theme. 3  City Council Minutes Tuesday, November 6, 2012 Councilmember Selfridge said that three people from Monterey visited Kusadasi Turkey and she will give a more detailed report on the trip in the future. She presented a badge to Police Chief Penko from the Police Chief of Turkmenistan Councilmember Haferman asked to agendize a discussion on the Helvic gate for a future Council meeting. Councilmember Downey voiced concerns regarding increased litter, especially on the highways and ramps. She asked everyone to think about this issue and teach their children about it. She said that she hopes to see political signs as an issue that comes to the Council in the near future. She reported that an electric trolley will be traveling to the Aquarium thanks to MST. Mayor Della Sala gave an update on the Water Authority, saying that the report by SPI was received today. He said that the report indicates that there are no fatal flaws in any of the projects and the TAC will review the report and take a recommendation to the Water Authority. He clarified that no project was recommended over the others, rather the report reviews the strengths and weaknesses of each one. Mayor Della Sala said that he has heard concerns regarding congestion on Lighthouse Avenue. He clarified that the project that is currently underway is being conducted by MST. He asked how soon the project would be completed, and Mr. Uslar said the City is working with MST, and it will be about one month before it is completed. Councilmember Sollecito said that the businesses have requested that the red curbs be minimized after the construction so the parking spaces can be reinstalled. Councilmember Selfridge reminded people that the businesses are still open and she encouraged everyone to continue to do business there. 10. Councilmember Request to Agendize a Presentation from The City of Pacific Grove Regarding the Status of Their Water Supply Projects (Haferman - 706-08) Action: Agendized Councilmember Haferman said that he is only asking for an update from Pacific Grove so he can better understand their water project. He clarified that this would be a presentation, not an action item. City Manager Meurer cautioned Council that if they receive a presentation on this project, they should be prepared to hear presentations on other projects. By consensus, the City Council agreed to agendize the item. 11. Councilmember Request to Agendize Receiving an Update From the Monterey Peninsula Regional Water Authority (Downey - 706-04) Action: Agendized Councilmember Downey asked Council to agendize a regular update so the Council can discuss items that are coming up on the Water Authority's agenda. Mayor Della Sala said that having each of the City Councils agree on the items prior to the Authority taking action would create delays. Ms. Downey said that she only wants an update and discussion of items, not necessarily a vote on every issue.
