COUNCIL COMMENTS 1. Councilmember Request to Agendize a Discussion on Hiring a Facilitator to Work with Council and City Manager (Downey - 701-01) Action: Withdrawn Councilmember Downey explained that she was thinking that agendizing this item would present an opportunity to discuss priorities, but now believes that it would be better to wait for a new City Manager to be hired. She withdrew her request. Councilmember Downey apologized for not pre-committing water for the 595 Munras project. She said that the Wharf Marketplace is open at the Train Depot, and it looks great. She said that she is delighted to have the Lyceum presentation today. Councilmember Haffa referenced the Lapis Study regarding beach erosion, and saying that he has provided Council with an information packet on the topic. He expressed great concern and said that he is looking into the matter. Councilmember Selfridge said she had the pleasure of hosting a group of Chinese media during this year's Concours. Councilmember Sollecito said that CalAm is sending out a survey, and it is very important that people fill it out so they are placed in the proper category. Mayor Della Sala noted the end of a successful car week, saying that the impact on the local economy ranked in the hundreds of millions of dollars. He said that there were, however, some negative impacts caused by the increased traffic in the area. PRESENTATIONS 2. iLead+Design Student Presentation - Simoneau Plaza Redesign Project (Plans & Public Works - 201-15) Action: Received presentation  City Council Minutes Tuesday, August 20, 2013 Senior Associate Planner Hopper introduced the item. The iLead Design Team from York School summarized the program to redesign the Simineau Plaza. Mayor Della outlined the elements of the plan that most impressed him. Councilmember Downey thanked the team, saying they are the planners of tomorrow. Kerry Ann, citizen of Carmel, thanked the Monterey Firefighters Association. She recounted how they had retrieved a piece of steel from the World Trade Center that she had obtained. She invited the City Council to a September 7th reception, and invited the entire City to be in Carmel on September 11th for the unveiling. Having no further requests to speak, Mayor Della Sala closed public comment. 2  City Council Minutes Tuesday, August 20, 2013 PUBLIC APPEARANCE 8. Receive Presentations of Proposals from Selected Recruitment Agencies Regarding the City Manager Recruitment, with Award of Contract to Chosen Agency (Human Resources - 502-11) Action: Adopted Resolution No. 13-138 C.S. Paul Kimura gave a presentation, explaining the value that his firm would bring to the City Manager recruitment process. He noted that Monterey is a unique, world-class city, that is complex and there are not a lot of people who can do this job. He said that there is a very competitive market, giving examples of Bay Area cities that are recruiting City Managers. He said that his firm has never experienced this type of market in his history with them. On question, Mr. Kimura said that the greatest challenges would be the limitation in the number of candidates, the high cost of living locally, and questions about why a second search is being conducted. On further question, Mr. Kimura said that the salary should range from $200,000 to $235,000, with consideration of housing assistance. He said that a key part of Avery's approach is to identify individuals who might be right for the job and market the position to them in an ongoing basis. He said that the marketing generally includes at least two interviews, one of which is face to face. Councilmember Downey said that she appreciates the response. Councilmember Haffa asked if there is value in waiting to do the recruitment. Mr. Kimura said that sufficient time has passed since the first attempt, and a different recruiter should help alleviate that obstacle. On further question, he explained the process for setting the salary, and said that it is important that his firm know the Council has consensus on a range. Councilmember Haffa asked Mr. Kimura to explain how he would market the City of Monterey to potential candidates. Mr. Kimura said that the complexity and vibrancy would be key factors. He explained how he would communicate with the City Council by providing a weekly status report and coordinating calendars for meetings to receive recommendations from Avery and to interview candidates. He suggested that the City Council do the initial interviews to identify the top three candidates, and then conduct another meeting to interact with the community. On question, Mr. Kimura said he believes that it would be OK to list salary as "DOQ" in the brochure, but it is absolutely essential to have an agreement among the Councilmembers about the amount of the range. He explained that his firm offers a service to provide negotiation of the terms of the contract. In answer to a question, Mr. Kimura said that a number of candidates will call the City staff to gain information about the City. He said that while his firm can be a contact, staff can give more detailed information. He noted that staff is generally very positive. Councilmember Sollecito said that during the last recruitment, the salary was set too low, and it is important not to make that mistake again. He favored placing the salary range in the brochure, and not hiding it. He said it is important to do everything correctly at the beginning. Councilmember Haffa agreed, but said it is complicated due to the difference in benefits offered. He asked if Avery would be able to give information on total compensation. Mr. Kimura said that information is available. He said that Council can focus on the key factors to negotiate. Councilmember Sollecito asked how to combat rumors regarding the "toughness" of the Council. Mr. Kimura said that a strategic planning session is a powerful offset of negative perceptions. On question, He said that currently they are seeing severance packages ranging from 6 to 18 months. 3  City Council Minutes Tuesday, August 20, 2013 It was moved by Councilmember Selfridge, and seconded by Mayor Della Sala, to adopt Resolution No. 13-138 C.S., awarding the contract to Avery Associates: On question, City manager Meurer said that he had asked both of the other finalists to reconsider their withdrawal from this selection process, and neither of them would reconsider. Councilmember Selfridge said that she was disappointed because she felt the presentation was negative. Mayor Della Sala said that the Council and staff continue to seek excellence, even though it might get messy at times. Discussion and Direction on Compensation and Benefits Package for City Manager Recruitment (Human Resources - 502-11) Action: Set a base salary range of $200,000 to $235,000 with standard executive Management Benefits Package to be listed on the flyer as negotiable for the City Manager recruitment Paul Kimura gave a presentation regarding Avery Associates' recruitment program. Mayor Della Sala said that he heard Mr. Kimura suggest a salary range of $200,000 to $235,000. On question by Councilmember Downey, Mr. Kimura said that his preference is to have the compensation information in the brochure, as that gives additional information to potential candidates. Mayor Della Sala said that it is beneficial to establish as much information as possible. On question, Mr. Kimura clarified that a candidate would not necessarily be offered the maximum. Councilmember Haffa expressed concerns regarding total compensation, particularly regarding management incentive pay. Mr. Kimura said that a definitive, stated range creates the certainty for candidates. He reviewed the four major areas that candidates focus on most: base pay, severance, time off, and retirement. He explained that after base pay is negotiated, other considerations are brought in to the discussion. It was moved by Councilmember Sollecito, and seconded by Councilmember Haffa, and carried by the following vote, to set the compensation at $200,000 - $235,000 annually, with benefits negotiable for the City Manager Recruitment: AYES: 5 COUNCILMEMBERS: Downey, Haffa, Selfridge, Sollecito, Della Sala NOES: 0 COUNCILMEMBERS: None ABSENT: 0 COUNCILMEMBERS: None ABSTAIN: 0 COUNCILMEMBERS: None RECUSED: 0 COUNCILMEMBERS: None Realizing that public comment on the item had not yet been taken, Mayor Della Sala opened the floor. Nelson Vega said that it is important that the public hears what the amount is before it is set. With no further requests to speak, Mayor Della Sala closed public comment on the item. City Attorney Davi explained that the negotiations are done in closed session, but the final 4 City Council Minutes Tuesday, August 20, 2013 contract must be approved in open session. Mr. Kimura said that generally the standard benefits that are received by executive management are listed on the brochure, but all are subject to negotiation. He said that the brochure will be returned to the Council before it is sent out. It was moved by Councilmember Sollecito, and seconded by Councilmember Haffa, to rescind the previous action on this item and set a base salary range of $200,000 to $235,000 with the standard executive management benefits package listed on the flyer as negotiable for the City Manager Recruitment. Councilmember Selfridge asked to postpone the matter. Mayor Della Sala said that Council will have an opportunity to review the brochure before it goes out so there is no need to postpone it. WATER UPDATE Jim Cullem, Executive Director of the Mayors' Water Authority gave an update on the settlement agreements with CalAm and the three interveners, saying that a follow-up conference will be held. He outlined the upcoming process. He said that CalAm's agreement to accept public funds is an important agreement because it will save a great deal of money for the rate payers, but likely will require special legislation. Mr. Cullem said that a third op-ed in The Herald will explain the anticipated change in rates. He reported that on August 7th, he and City Manager Meurer toured the Poseidon facility and had an opportunity to speak in depth with the staff. On question, he explained how the reduction in CalAm's equity position would affect the water rates. Councilmember Haffa said that he is not comfortable with an unidentified body negotiating on his behalf a rate that cannot be revisited. Mr. Cullem said that the Division of Ratepayer Advocates was very aggressive in trying to get the best possible rate. Chief of Planning and Engineering Rerig gave an update on Pacific Grove's idea regarding waste water, the potential to route storm water runoff to the David Avenue reservoir, and the Integrated Regional Water Grant. Mayor Della Sala opened public comment on the item. Frank Pierce, registered engineer, reported on an article in today's Wall Street Journal about cities across the United States taking their water systems back from private ownership. Nelson Vega said that the Water Management District failed us, and CalAm did not ask to be in this position. He suggested that if the CDO were extended, there would be more time to address the issues. He asked people to remember that some things are beyond CalAm's control. Mayor Della Sala closed public comment because there were no further requests to speak. 5  City Council Minutes Tuesday, August 20, 2013 CONTINUED PUBLIC COMMENTS Mayor Della Sala reopened public comments on items not on the agenda. Henry Ruhnke, Garden Road business owner, made a presentation regarding numerous concerns of the businesses about increased storing of RVs on Garden Road. He presented a petition from those business owners asking Council to restrict parking in that area. Ernie Loestrom, property owner and commercial real estate broker, said that the buildings on Garden Road are becoming harder to lease, largely due to the parking situation. He said that some of the business owners are willing to help pay for signs limiting parking on the street. Having no further requests to speak, Mayor Della Sala closed public comment. 10. Receive Report on Hiring a Professional Negotiator for Employee Labor Relations and Give Direction to Staff (Human Resources - 507-01) Action: No action taken; motion to hire a professional negotiator for employee labor relations failed (1-4; Haffa, Selfridge, Sollecito, Della Sala voting no) Benefits Manager Maloney presented the staff report, reviewing the pros and cons of hiring an outside negotiator. City Manager Meurer said that the Council and staff have achieved a lot through the meet and confer process. He said that the ability to negotiate those accomplishments is a direct result of a relationship of trust between the employees and management and a sense of team. He strongly recommended against hiring an outside negotiator. Assistant City Manager McCarthy said that the leadership of the groups and their relationship and trust in the Human Resources Department have enabled the recent successful negotiations. Ms. Downey noted that MPA continues to have a sunset clause on the added employee contribution to PERS. Councilmember Downey voiced concerns that when staff negotiates, the end result affects them, so it is difficult to remain neutral. She said that it is important to allow Council the option to use a professional negotiator. Councilmember Sollecito said that the timing seems strange because the Council just "won three Superbowls." He said that the City has been very successful, and why would we now change direction? Councilmember Haffa asked why some neighboring cities have used negotiators for specific groups, and Mr. McCarthy said that some cities do not have the staffing available to conduct all negotiations. City Manager Meurer said that the ultimate decision lies with the City Council whether a professional negotiator is used or not. Mayor Della Sala opened the floor for public comments. Nelson Vega said that for many years every dollar has been spent and the roads have not been fixed. He said that someone from the outside would bring a new perspective. Having no further requests to speak, Mayor Della Sala closed public comments. Councilmember Sollecito said that he has been on both sides of the table, and he explained that past negotiations were confrontational when the City hired a professional negotiator. He said that the Police did very well under that scenario. He said that in the end it is up to the Council to look at the evidence and make a decision on compensation issues. He stated that recent negotiations been very pleasant, but in the past there was friction between the groups. He said that he would hate to go back to the old confrontational days. 6  City Council Minutes Tuesday, August 20, 2013 Councilmember Downey said that she served on the Waste Management Board, and there was no confrontation in their employee negotiations process with an outside negotiator. It was moved by Councilmember Downey, and seconded by Councilmember Selfridge to direct staff to approve an option to hire a professional negotiator for employee labor relations: Councilmember Sollecito said that he does not understand this motion because the Council already has that option. Councilmember Downey said that she does not believe that last negotiations were entirely successful. On question, City Attorney Davi explained the process for hiring a negotiator on individual negotiations. Councilmember Selfridge said that she is still upset that the tree crew was laid off last year. Councilmember Sollecito said that had nothing to do with the negotiations process and this subject was brought up unnecessarily and represents poor leadership. Councilmember Haffa said that he would not support the motion, but does not think it is fair to say this is bad leadership. He said that the comments from the member of the public, right or wrong, represent a common perception. He said that he would not support the motion because he believes that the City has a good process in place, and he does not think an outside negotiator is needed at this time. Mr. Haffa said that he would like to see how Monterey's salaries compared to a statewide benchmark. He said that he does not have a comfort level with them at this time. Councilmember Sollecito said that those studies can be done, but considering that many staff members wear two or more hats, those surveys might have surprising results. Assistant City Manager McCarthy explained that the City has done many comprehensive benchmark studies, but not statewide because Monterey is not comparable to many cities in the state that have a similar population. City Manager Meurer explained that the City Council hired a professional to select cities and do a focused study last year, but the results were not as expected by some. Councilmember Selfridge said that she is not going to support the motion because she trusts the employees. Resolution Amending Salary and Benefits for Executive Management Employees, The Assistant Police Chief, and The Assistant Fire Chief (Human Resources - 507-08) Action: Tabled until additional information can be received Benefits Manager Maloney presented the staff report, saying that the City's past practice and policy has been for the City to grant similar salary and benefit increase to Executive Management as have been granted to MEA. Ms. Maloney reviewed the proposed costs and funding source for the salary and benefit increases for the unrepresented employees. 7 City Council Minutes Tuesday, August 20, 2013 On question, Ms. Maloney said that the costs outlined include the added costs for pensions. On question, Interim Finance Director Lefebvre explained that a PERS actuarial report would be coming out in October and would outline the City's unfunded liabilities. On question, City Manager Meurer said that the typical process has been for Executive Managers to receive the same as the managers that are represented by MEA. Mayor Della Sala opened public comment on the item. Nelson Vega said that the information presented tonight should have been on the website in advance. He said that the report is confusing, and PERS is woefully under funded. He said that the roads must be fixed. Having no further requests to speak, Mayor Della Sala closed public comment. Councilmember Haffa said he is not comfortable approving this at this time and he would be interested in looking at the management incentive pay. He said that he is not opposed to looking at this proposal later. City Manager Meurer asked Council to take him out of the mix and grant the raise to everyone else. It was moved by Councilmember Downey, and seconded by Councilmember Haffa, to adopt a resolution amending the salary and benefits for the Assistant Police Chief and the Assistant Fire Chief. On further discussion, Ms. Downey withdrew her motion. Mayor Della Sala said that he understands the concerns about more information. He said that when the City of Monterey employees work, they work together He said he does not want to separate groups. It was moved by Mayor Della Sala, and seconded by Councilmember Sollecito, to adopt the Resolutions amending salary and benefits for Executive Management employees, the Assistant Police Chief, and the Assistant Fire Chief. Councilmember Haffa said that he could not support the motion at this time. Councilmember Downey said that she would like to negotiate in closed session with the Executive Managers. Councilmembers discussed agendizing a closed session item for negotiations with the unrepresented employees. Councilmember Haffa said he would like to see a survey of every city in the state. Assistant City Manager McCarthy explained that would not present a good comparison for purposes of setting compensation. City Manager Meurer said that it is unfair to the Executives to treat them differently than every other City employee. Councilmember Haffa said that the State Comptroller's website numbers show that some of the City's people are in the top ten in the state. He asked to meet with the Assistant City Manager to verify those numbers. Amend Hourly Wages for Part-Time Positions (Human Resources - 507-08) Action: Adopted Resolution No. 13-139 C.S. Benefits Manager Maloney presented the staff report and answered Councilmember questions. Mayor Della Sala opened public comment on the item. Nelson Vega supported the recommendation because these people are on the bottom rung, however, he said that care should be taken not to cause compaction. Having no further requests to speak, Mayor Della Sala closed public comment. Authorize City Manager to Enter into Agreements for the Holman Highway / Highway One Southbound Off-ramp Interchange Roundabout: 1) a Professional Services Agreement with Omni Means Limited for $1,371,120 for Preliminary Engineering, Final Design and Bid and Construction Phase Support Services; 2) a Professional Services Agreement with the Transportation Agency for Monterey County for $50,000 to Conduct a Public Education and Outreach Program; and, 3) a Reimbursement Agreement with the Pebble Beach Company to Allow Reimbursement of Costs Incurred to the City for Preliminary Engineering, Final Design and Bid and Construction Phase Support Services (Plans & Public Works - 405-04) Action: Adopted Resolution 13-140 C.S. Traffic Engineer Deal presented the staff report and answered Councilmembers' questions. Councilmember Haffa said that this is an unusual intersection and asked that the signage be explicit. Mayor Della Sala opened the item for public comment. Jim Cullem, Skyline Forest Neighborhood Association representative, spoke in support of the staff recommendation. Frank Pierce, Pacific Grove resident, spoke in support of the recommendation, saying that roundabouts work well. Todd Muck, Deputy Executive Director of TAMC, said that his agency looks forward to working with the City on the project. Mayor Della Sala closed public comments. On a motion by Councilmember Downey, seconded by Councilmember Sollecito, and carried by the following vote, the City Council adopted Resolution No. 13-140 C.S., authorizing the City Manager to enter into agreements for the Holman Highway/Highway One off-ramp interchange roundabout: a professional services agreement with Omni Means for preliminary engineering, final design and bid and construction phase support; a professional services agreement with the Transportation Agency for Monterey County to conduct a public Education and outreach program; and a reimbursement agreement with the Pebble Beach Company to allow reimbursement of costs incurred to the City for preliminary engineering, final design and bid and construction phase support: AYES: 5 COUNCILMEMBERS: Downey, Haffa, Selfridge, Sollecito, Della Sala NOES: 0 COUNCILMEMBERS: None ABSENT: 0 COUNCILMEMBERS: None ABSTAIN: 0 COUNCILMEMBERS: None 9 City Council Minutes Tuesday, August 20, 2013 RECUSED: 0 COUNCILMEMBERS: None CITY MANAGER REPORTS City Manager Meurer referenced a brochure with information from Stephanie Meeks regarding the Cooper Molera adobe project and said that a Town Hall meeting will be scheduled before the Council. Mayor Della Sala opened the floor for comments regarding the Yacht Club closed Session item. Ron Blue, Commodore and Monterey resident, said that the Yacht Club has taught over 1,000 kids to sail. He outlined several events and programs that are hosted by the club. He said that based on their data they are asking for a rent of twenty-five cents per square foot. He said that the food and beverage activity is part of the Yacht Club, and the City's appraisal is flawed. He noted that it does not take into account the club's liability for maintaining the pilings. He said that if the rent is increased in the amount that the City is asking, it will affect the membership. Allen McMasters, Monterey resident, said that his daughter learned to sail at the Yacht Club, which motivated him to learn. He supported a fair rent for the facility. Bob Evans said that he and his wife were members of Mission Bay Yacht Club where his children learned to sail. He supported the Yacht Club's request for a lower rent, saying that the club is a revenue generator. David Potter, Monterey resident and past Commodore of the Monterey Peninsula Yacht Club, supported the club's request for a lower rent. Frank Pierce, past Commodore of the Yacht Club, supported the club's request for lower rent, saying that it helps youth to learn responsibility and safety. The City Council adjourned to closed session at 10:15 p.m. ANNOUNCEMENTS FROM CLOSED SESSION Information Resources Director/City Clerk Gawf announced that the Council gave unanimous confidential direction to their legal counsel in a conference with counsel to discuss an existing workers' compensation litigation: Roohbakhsh vs. City of Monterey. Ms. Gawf said that in a second conference with legal counsel regarding a discussion of whether to initiate litigation in the case of City of Monterey vs. County of Monterey (Property Tax Administration Fees Claim), the City Council gave confidential direction to the legal counsel on a unanimous roll call vote. Ms. Gawf announced that in a conference with real estate negotiators to provide negotiating direction to respond to the Monterey Peninsula Yacht Club Municipal Wharf No. 2 lease renewal counter offer, the City Council gave confidential direction to their negotiators. The roll call vote was 4-1, with Selfridge voting no.
