Community Human Services 50th Anniversary Presentation (Not a Project Under CEQA per Article 20, Section 15378, and Under General Rule Article 5, Section 15061) (City Manager - 101-13) Action: Received presentation Robin McCrae, Community Human Services, presented a plaque of appreciation to the City, gave a brief presentation on Community Human Services’ history and operations, and answered Councilmembers’ questions. She invited all to a partner appreciation breakfast, and to learn how to administer Narcan at an upcoming training. 2. Recognition of Defense Language Institute Quarterly Joint Service Awards (Not a Project Under CEQA per Article 20, Section 15378, and Under General Rule Article 5, Section 15061) (City Manager - 701-17) Action: Recognized award recipients Mayor Roberson presented proclamations to Sergeant Matthew Lucenti and Lance Corporal Devon Keith, who each made brief comments. PUBLIC COMMENTS Mayor Roberson opened the floor for public comments on non-agendized matters. Renee Leonard, citing a bus driver whom she said was attacked, said something needs to be done about violence and drug and alcohol issues at the transit center. With no further requests to speak, Mayor Roberson closed public comments.  City Council Minutes Tuesday, April 16, 2019 CONSENT ITEMS Mayor Roberson opened public comments on the Consent Agenda. Bob Evans, Museums and Cultural Arts Commission, answered Council’s questions about Item 15, clarifying that the applications will be received open-ended, but calls for sculptures and murals for the Monterey 250 celebration will have deadlines. With no further requests to speak, Mayor Roberson closed public comments. Museum & Cultural Arts Manager Copeland answered Council’s questions about Item 9, clarifying that it is not a purchase. He stated that the collection was commissioned and is already owned by the City, but it has since been in the storage of the directing archaeologist for the project. He said that the funds would be used to repackage the collection using contemporary methods and transport it to the City. Housing and Community Development Manager Caraker gave a brief report and answered Councilmembers’ questions. The Council discussed the matter, noting that the Coastal Commission’s requirements for short- term rentals in coastal zones may be ruled out by Monterey’s Visitor Accommodation Facility (VAF) zones. It was stated that Monterey has very low home ownership and that pursuing affordable ownership opportunities is a goal. The following was read aloud from the staff report: “the City will examine other approaches to intensify existing lower density residential areas and “missing model” typologies to encourage significantly more residential development (e.g., duplexes, triplexes) in lower density residential areas.” Citing concern, it was stated that a lot of public comment and conversation would be needed to consider such a strong policy statement, and wording like “explore” or “get community buy-in to analyze” might be better. Community Development Director Cole agreed that finding the right fit for the community will be important. It was observed by Council that owning a home is the only way to avoid rent increases, and that having a portfolio of options and being aware of return on investment will be beneficial. CONTINUED PUBLIC COMMENTS Mayor Roberson opened the floor for continued public comments on non-agendized matters. 5  City Council Minutes Tuesday, April 16, 2019 Bruce Zanetta thanked Council for approving a special events grant to the NextGen Jazz Festival, and spoke favorably about jazz and the festival. Lorna Moffat spoke against what she said were illegal sales of wild horses and burros in Modoc, asserting that these animals make positive impact on environment, and urged all to contact their representatives on the matter and reduce consumption of meat on behalf of the environment. Draft State Route 218 Corridor Study Presentation by TAMC (Not a Project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061) (City Manager - 813-03) Action: Received presentation Rich Deal and Stefania Castillo, Transportation Agency for Monterey County (TAMC), gave a brief presentation about recommended safety improvements for the Canyon Del Rey Corridor, and answered Councilmembers’ questions. The Council made positive remarks about the proposed enhancements to the Corridor. Mayor Roberson opened public comments. Lorna Moffat said that the most dangerous intersection for bicyclists is at Figueroa Street and Del Monte Boulevard, and cited an urgent need for greater safety for bicyclists. Bruce Zanetta, Veloclub, spoke about the need for safer bicycle connections between Fort Ord and the Peninsula. With no further requests to speak, Mayor Roberson closed public comments. PUBLIC HEARING 20. Open a Public Hearing to Receive Protests of Proposed Rates Effective May 1, 2019, for Residential and Commercial Solid Waste and Recyclables Collection and Adopt a Resolution Increasing Rates if a Majority Protest Does Not Exist (Not a project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061) -- Continued from April 2, 2019 (Public Works - 802-06) Action: Adopted Resolution No. 19-053 C.S. City Manager Uslar gave the staff presentation, addressing questions that he said were asked by the public during the public hearing on April 2, 2019 about the process by which Monterey City Disposal Service (MCDS) gained the waste hauling contract, franchise fees, and why the City doesn’t own its own waste hauling service. Mayor Roberson opened public comments and asked any protesters to come forward with a written protest. With no requests to speak and no further written protests presented, Mayor Roberson closed the public hearing. With 70 total written protests received, there was not a majority protest. Provide Direction on Potential Citywide Bicycle Share, Electric Scooter Share, and Pedicab Programs (Not a Project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061) (Public Works - 701-18) Action: Received presentation, Directed staff to pursue the possibility of pedicabs in the City and restrict e-share scooters and e-share bicycles at this time City Manager Uslar asked Council to consider the presentation and give clear direction about which, if any, transportation options the City should pursue. Associate Planner Roveri gave the staff presentation and, together with City Manager Uslar, asked Councilmembers’ questions. Mayor Roberson opened public comments. Sean Marshall, Evie Ellington, and Katie Stevens, Lime, answered Councilmembers’ questions and provided details about the company’s operations and safety enhancements, wireless requirements, environmental impacts, access, and local status, and spoke in favor of expanding Lime’s e-scooter business into Monterey. Robert Cepella, bicycle mechanic, spoke in favor of e-bikes, which he said are an important option for commuters, and said they shouldn’t create an enforcement burden for the Police Department. Bruce Zanetta cautioned against e-scooters, citing issues with the vendor in Marina, and said that leaning toward people-powered modes would be better for the City, though taking cars off the road would outweigh other negatives. Frank and Michelle Knight, Adventures by the Sea, asked the Council to carefully analyze the impacts of any considered programs and think about safety and existing congestion on the Recreational Trail (Rec Trail), cited clutter concerns, and stated that bike share programs are not a good fit and won’t make economic sense for the City. Pete Wynn, recreational cyclist, and Marc Kelley, West Franklin Street, cited safety concerns associated with motorized vehicles such as e-scooters and e-bicycles on the Rec Trail, and asked Council to be cautious. Nina Beety cited environmental, traffic, accessibility, liability, and safety concerns about e-bikes and e-scooters, saying that the vehicles’ wireless emissions impinge on her ability to use the right-of-way. Tammy Jennings said that the City of Monterey is not a good fit for the discussed methods of transportation, citing safety and legal concerns. Matthew McCluney, California State University Monterey Bay (CSUMB), stated that the e- scooters on campus are being used for commuting, and offered that CSUMB’s experience with e-scooters could help provide answers for the City. Robert McKay said that his main concern is safety on streets and the Rec Trail, and discussed high speeds and lack of use of bike lights. With no further requests to speak, Mayor Roberson closed public comments. The Council recessed at 8:54 p.m. and reconvened at 9:06 p.m. They began a discussion about the differences between, and positives and negatives of, the three vehicle types. A comment was made in favor of trying all three in a limited and restricted way and seeing how it goes, noting that the City is in control and these modes of transport would help to achieve goals of the Monterey Multi Modal Plan, by getting people out of their cars. Concerns were raised about e-scooters with regard to congestion and safety issues, the business model, sidewalk clutter, and the number of rental share companies that could possibly operate at once. Concerns were raised about the City’s ability to enforce restrictions for e-bikes 7  City Council Minutes Tuesday, April 16, 2019 and/or e-scooter share programs. It was stated that Monterey residents do not want e-scooters in their community. It was observed that local companies are already renting e-bikes. A comment was made in support of pedicabs, with observations that they would be driven by professional drivers and could be limited in numbers and held accountable, with requirements such as seatbelts and drivers’ licenses and possibly required trainings. It was suggested that staff gather more information about pedicabs, information which could include suggesting areas allowed and discouraged for pedicab operations, suggested hours of operation, details on how they mix with traffic, whether or not to allow them on the Rec Trail, and how many pedicabs could operate as compared with how many bike surreys are in use. It was stated that the Rec Trail is at maximum capacity and is a lifestyle for many people It was suggested that the City find a way to address congested areas of the trail and consider widening it to allow separate paths for walkers and bikers, particularly between Fisherman’s Wharf and the basketball courts, which was cited as a dangerous area. It was stated that pedicabs may not create additional traffic on the Rec Trail. It was stated that the shared rental programs are being tested in other communities, and that the Council would need to see more proof from vendors and other cities about whether safety and clutter issues can be addressed before they would consider such programs. It was stated that a program with docking by bus stops for first and last trips, and prohibited use on the Rec trail and other unsafe places, could be of interest in the future. Adjourn to City Council Meeting COUNCIL COMMENTS Councilmember Albert reported on a recent Monterey Conference Center Advisory Committee meeting, shared successes and positive economic impacts of the Conference Center, and thanked the hotels for helping with funding the renovation. He thanked the City and the Council for committing to youth by supporting the NextGen jazz festival. 8 City Council Minutes Tuesday, April 16, 2019 Councilmember Haffa shared highlights from volunteering with Kiwanis at the Sea Otter Classic. He reported on the Fort Ord Reuse Authority (FORA) South Boundary Road improvement, which he said includes infrastructure that the City will need when the time comes to develop its property. He provided an update on a lawsuit which he said was recently resolved in FORA’s favor, and on pending legislation introduced by Senator Monning that would extend a limited FORA for two years, with membership limited to the five land-use jurisdictions. Councilmember Williamson gave an update on the Monterey Regional Housing Coalition, which he said identified opportunities on which the region can collaborate, and said he will keep Council informed about the group’s progress. Councilmember Smith reported on the recent Monterey Police awards event, and said that Cannery Row Rotary would hold a fundraiser on May 5 to benefit the Monterey County Free Library Foundation. He said he attended the Monterey County Hospitality quarterly luncheon, the Panetta Lecture Series, and a victims recognition event sponsored by the District Attorney’s office. He announced that the U.S. Open will have attendance in excess of 100,000. He provided brief updates about recent meetings of the Association of Monterey Bay Governments (AMBAG) and Transportation Agency for Monterey County (TAMC), and reported on the status of a planned rail station in Salinas at Market Street. CITY MANAGER REPORTS City Manager Uslar reminded Council that Wednesday, April 24, will be a joint study session with the Library Board. He reported that Osio Cinema hosted a movie night playing the film “The Public” with revenues donated to Pacific Grove and Monterey libraries. He promoted the upcoming egg hunt on April 20. He said that a successful evacuation exercise was conducted at the Presidio on April 13. He invited all to help plant trees at Laguna Grande Park’s Arbor Day event on April 27.
