MINUTES CITY COUNCIL CITY OF MONTEREY Wednesday, September 23, 2015 4:00 – 6:00 p.m. MONTEREY, CALIFORNIA Councilmembers Present: Councilmembers Barrett, Downey, Haffa, Smith, Roberson Absent: None City Staff City Manager, City Attorney, Director of Information Resources/City Clerk, Present: Assistant City Manager, Deputy City Manager, Plans and Public Works, Community Services Director, Finance Director, Fire Chief, Police Chief, Human Resources Director, Chief of Planning, Engineering, and Environmental , Housing & Property Manager, Principal Planner, Human Resources Analyst, Communications and Outreach Manager CALL TO ORDER Mayor Roberson called the meeting to order at 4:00 p.m. PUBLIC COMMENTS Mayor Roberson opened the floor for public comment on items not on the agenda, had no requests to speak, and closed public comments. CONSENT ITEMS Other 1. Appoint Agency Negotiators for Conference with Real Property Negotiators Pursuant to Government Code Section 54956.8 Property: 1 Portola Plaza (APN 001-567-016-000), 2 Portola Plaza (APN 001-567-019-000) and Portola Plaza (APN 001-567-015-000) Negotiators: Kim Bui-Burton, Bob Cowdrey Chip Rerig and Rick Marvin Negotiating Parties: Portola Hotel and Spa Under Negotiation: Terms and Conditions for Shared Facility Ingress and Egress Access Easement and Fountain Equipment Easement over 2 Portola Plaza, Pedestrian and Vehicle Ingress and Egress Easement and Port-Cochere Encroachment Easement over Portola Plaza, and Amendment to DeAnza Ballrooms Monterey Conference Center Lease (Plans & Public Works - 206-03) Action: Appointed agency negotiators It was moved by Councilmember Smith, and seconded by Mayor Roberson, to appoint agency negotiators Kim Bui-Burton, Bob Cowdrey Chip Rerig and Rick Marvin for conference with real property negotiators regarding property located at 1 Portola Plaza, 2 Portola Plaza, and Portola Plaza to negotiate terms and conditions for shared facility ingress and egress access easement and fountain equipment easement over 2 Portola Plaza, pedestrian and vehicle ingress and egress easement and port-cochere encroachment easement over Portola Plaza, and amendment to DeAnza Ballrooms Monterey Conference Center Lease. Councilmember Downey asked the motion maker to amend the motion to include direction to staff to consult with a professional, and Councilmember Smith declined, saying that provision might be an appropriate consideration at a later date.  City Council Minutes Wednesday, September 23, 2015 City Attorney Davi said that this motion does not preclude staff from hiring a consultant if one is needed. She clarified that the item is only to appoint negotiators, and hiring a consultant is not agendized for this meeting. Councilmember Haffa said that he will support the motion, but if a recommendation comes back without a consultant's review, he will be unlikely to support that recommendation. Councilmember Downey agreed and asked to include that statement in the meeting minutes. Councilmember Smith said that this is step one in a process, and any time a consultant is necessary, he is open to that. Presentation on Draft Monterey Regional Airport Master Plan (Plans & Public Works - 201-12) Action: Received and discussed report Mayor Roberson introduced the item, and indicated that several members of the public are in the audience to address this issue. City Manager McCarthy gave a brief overview, and Chief of Planning and Engineering Rerig presented the staff report and answered Councilmembers' questions. Monterey Peninsula Airport General Manager Mike La Pier and Deputy General Manager Mark Bautista presented the Monterey Regional Airport Master Plan. On question, Fire Chief Panholzer explained how the proposed plan for the Airport fire station would help reduce response times. Mr. La Pier answered Councilmembers' questions regarding traffic impacts and access that might result from this plan, funding, and working in conjunction with other jurisdictions. On question, Mr. La Pier said that the Airport has finished night-time construction on the runway safety project. Mayor Roberson opened public comment on the item. Robert Yoha, Monterey Resident, voiced concerns regarding two inner turning zones in the proposed Master Plan that allow aircraft to take off over the Casanova Oak Knoll neighborhood. He asked the City to consider the public safety consequences of the early turn zones, and requested that the pilots be required to go to the end of the runway before liftoff. Richard Ruccello, President of Casanova Oak Knoll Neighborhood, said that the recent construction noise has been a huge problem for his neighborhood. He said that the preferred and safe flight pattern is over the golf course, with a turn after the plane is over the bay. He urged Council to work with the FAA and hold them accountable. 2 City Council Minutes Wednesday, September 23, 2015 Mike Brassfield, CONA resident, said that the 800 pound gorilla in the room is the FAA. He asked that the City continue to send Mr. Bennett to the Airport meetings. He agreed with the previous speaker regarding safety concerns. He said that the Airport needs to work more closely with the community. He encouraged the City have the Regional Manager of the FAA meet with the City’s Airport Subcommittee. Lisa Duggan, Monterey resident, voiced concerns regarding noise, safety, and public health. A neighborhood resident who did not identify herself voiced concerns regarding the fear she has due to the change of the flight path of airplanes taking off. She said that the small planes barely clear the tree tops. She referenced an agreement signed when the FAA installed new windows for area residents where they agreed not to raise the noise level, and said that the noise has increased greatly. Having no further requests to speak, Mayor Roberson closed public comment. Mr. La Pier said that he appreciates the comments, and the concerns will be carried forward as the Master Plan proceeds. He said that the Airport would continue to hound the FAA. On question, City Manager McCarthy explained that there are no specific decisions to be made by the City with regard to the Master Plan. Councilmember Haffa suggested inviting a senior FAA official to a joint meeting between the Council and Airport Board. Mayor Roberson agreed, saying that staff will work with Mr. La Pier on an action plan. On question, Mr. La Pier said that the next Airport Board Meeting is October 14 at 10:00 a.m. Mayor Roberson opened the floor for comments on the closed session items, had no requests to speak, closed the floor, and adjourned the meeting to closed session at 5:32 p.m. ANNOUNCEMENTS FROM CLOSED SESSION Information Resources Director/City Clerk Gawf announced that in a conference with labor negotiators for all labor groups, the City Council received and discussed the report. Ms. Gawf announced that confidential direction was given to negotiators in a conference with real property negotiators regarding terms and conditions for shared facility ingress and egress access easement and fountain equipment easement over 2 Portola Plaza, pedestrian and vehicle ingress and egress and port-cochere encroachment easement over Portola Plaza, and amendment to DeAnza Ballrooms Monterey Conference Center lease. She said that the roll call vote on that item was unanimous.
