Brown Act, Calif. Government Code section 54953(e)(1)(C) and the Monterey City Council’s Resolution authorizing virtual participation in public meetings given the COVID-19 pandemic. 1. Meeting Procedures CALL TO ORDER Chair Smith-Crivello called the meeting to order at 4:01 p.m. and Recording Secretary Barrera provided information to the public about how to participate by calling in to give public comment on the live web meeting. CONSENT ITEMS Approval of Minutes 2. October 13, 2022 Commissioner Rath clarified that she attended the previous meeting in person. ACTION: Approved with corrections. On a motion by Commissioner O’Neil, seconded by Commissioner Dawson, and carried by the following vote, the Historic Preservation Commission approved with corrections the October 13, 2022 HPC minutes as submitted, by the following vote: Smith-Crivello, Collum, Dawson, Hambaro, AYES: 6 MEMBERS: O’Neil, Rath NOES: 0 MEMBERS: None ABSENT: 0 MEMBERS: None ABSTAIN: 1 MEMBERS: Rodriguez RECUSED: 0 MEMBERS: None PUBLIC COMMENTS None. Chair Smith-Crivello questioned why a plaque wouldn’t be installed. Mr. Buggert said it is not included in the maintenance plan however some homeowners may have forgotten. Chair Smith-Crivello asked if annual tours of the interior of the homes would be a possibility. Ms. Roveri stated it is a requirement to make the home available for inspections but it’s possible to bring back tours. Commissioner Rodriguez sought clarification on the penalties of not complying with the Mills Act and asked if there is a one-time penalty fee. Mr. Buggert said no property has been removed from the Mills Act program to date. Ms. Roveri reiterated that a Mills Act contract has not been cancelled therefore we cannot speak to the procedure. Ms. Roveri asserted the procedure would involve the property owner, the city, and the reassessment of property taxes through the County Assessor. Ms. Roveri stated the penalty for being out of compliance is a one-time fee. Commissioner Dawson questioned what the consequences are for the properties that have not completed the majority of the maintenance plan. Mr. Buggert answered this year’s inspections serve as a reminder and next year progress is desired. Mr. Buggert said there is no penalty for not completing maintenance items, short of cancellation of the Mills Act contract. Chair Smith-Crivello asserted the City of Carmel holds open houses and has a remarkable history of having no issues. Commissioner O’Neil commented that the report is fantastic, and it appears non-compliant properties are nearly compliant. Commissioner Hambaro questioned if homes that receive Mills Act must have historic interiors. Mr. Buggert said several of the Mills Act properties have a portion of the interior that is considered historic and is a part of their maintenance plan; however, the majority of Mills Act homes do not have historic interiors. Commissioner Hambaro and Chair Smith-Crivello agreed that not every home fits the criteria for an interior tour. Commissioner O’Neil added the interior does not determine whether it is historic. Commissioner Rath interjected that a tour is a good way to advertise Mills Act and would help continue to preserve buildings. Public Comments Nancy Soulé, owner of a Mills Act Home, spoke in favor of having an exterior tour like the one she and Phyliss Bussey put together for the Old Town Neighborhood Association. Ms. Soulé mentioned the Old Monterey Historic Homes Walk is made up of photos and history and is found on the Old Town Neighborhood Association’s website (Historic Homes Walk – Old Town Neighborhood Association (oldtownmonterey.org)) Ms. Soulé suggested including it on the City’s website. Consider Providing Input on Updates to the Mills Act Public Handout (Not a Project under CEQA per Article 20, Section 15378 and under General Rule Article 5, Section 15061) ACTION: Received Report and Held Discussion Regarding Input on Updates to the Mills Act Public Handout (Not a Project under CEQA per Article 20, Section 15378 and under General Rule Article 5, Section 15061) Staff Presentation/Committee Member Questions Associate Planner Buggert presented the Agenda Report and answered Commissioner questions. Chair Smith-Crivello suggested homes without a plaque be required to add one at the ten-year renewal. Vice-Chair Collum questioned if the plaque is required to be visible. Ms. Roveri confirmed it must be visible from the public right of way. Commissioner Rodriguez suggested it may be a good idea to run the handout by a couple of active Mills Act participants to ensure it’s clear. Mr. Buggert agreed. Chair Smith-Crivello noticed the handout reads “may be” required to have a plaque instead of “shall be” required to have a plaque. Ms. Roveri said they will correct the form to read “shall be” required to have a plaque. Commissioner Rath asked clarifying questions about the appeal process on the handout. Ms. Roveri stated only actions that become final can be appealed therefore the appeal box has been crossed off. Commissioner Hambaro reiterated that it’s important to make the open house optional. Commissioner Dawson suggested property owners should have the option of offering a public tour for only the exterior of the home if they aren’t comfortable with people looking at the interior of the home. Mr. Buggert noted the contract says “property” rather than “interior”. Commissioner Hambaro suggested the tour be negotiated during the maintenance plan and asked for details regarding the plaque. Ms. Roveri clarified the plaque usually has the date of construction, the architect, and the history of ownership. Ms. Roveri clarified most features that deem a home historic are exterior rather than interior features. Commissioner Rodriguez left the meeting at 5:33 p.m. Public Comments None. Chair Smith-Crivello suggested having some historic preservation training for ARC if potentially historic homes are being presented to them. Commissioner Dawson stated potentially historic homes should go before the Historic Preservation Commission (HPC) rather than the ARC and requested to agendize an item on the topic. Ms. Roveri said we can bring the topic back to HPC for clarification. Commissioner Dawson asked for clarification on how to potentially change the City Code so that potentially historic homes go before the HPC rather than the ARC. Ms. Roveri suggested writing a letter to the Community Development Director, Kim Cole. Chair Smith-Crivello questioned if a person who wants to make a change to their house picks a historian that would support what they want to do. Ms. Roveri said whoever they pick needs to meet the standards of being a professional historian. Commissioner O’Neil shared concerns of potentially historic projects going to the ARC because they have a different list of concerns. Ms. Roveri stated the ARC receives a copy of the historian’s report and a project will not go to the ARC if the historian finds that the project is inconsistent with the standards. Commissioner Dawson suggested applicants pay one fee in the event a project goes before both the HPC and the ARC. INFORMATIONAL REPORTS & STAFF COMMENTS  Update received. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org/ beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Commission on any Agenda items. The Chair will formally open the floor for public comment.
