Brown Act, Calif. Government Code section 54953(e)(1)(C) and the Monterey City Council’s Resolution authorizing virtual participation in public meetings given the COVID-19 pandemic. 1. Meeting Procedures CALL TO ORDER Chair Smith-Crivello called the meeting to order at 4:00 p.m. and Recording Secretary Barrera provided information to the public about how to participate by calling in to give public comment on the live web meeting. CONSENT ITEMS Approval of Minutes 2. December 08, 2022 Commissioner Dawson made a correction to packet page 6 and 7. Chair Smith-Crivello made note that most features that deem a home historic are on the exterior rather than the interior of the home. ACTION: Approved as amended. On a motion by Commissioner O’Neil, seconded by Commissioner Collum, and carried by the following vote, the Historic Preservation Commission approved the December 08, 2022, HPC minutes as amended, by the following vote: Smith-Crivello, Collum, Dawson, Hambaro, AYES: 7 MEMBERS: O’Neil, Rath, Rodriguez NOES: 0 MEMBERS: None ABSENT: 0 MEMBERS: None ABSTAIN: 0 MEMBERS: None RECUSED: 0 MEMBERS: None PUBLIC COMMENTS None. Receive Report on Certified Local Government 2021-22 Annual Report (Not a Project under CEQA per Article 20, Section 15378 and under General Rule Article 5, Section 15061) ACTION: Received Report and Held Discussion on Certified Local Government 2021-22 Annual Report Staff Presentation/Commissioner Questions Principal Planner Roveri presented the Agenda Report and answered Commissioner questions. Commissioner Dawson added that she completed the Ethics training. Commissioner Rath, Commissioner O’Neil, and Commissioner Rodriguez said they would email their list of training to Ms. Roveri. Commissioner Rodriguez acknowledged the impressive experience and knowledge of his fellow Commissioners. Chair Smith-Crivello commended the diversity of the experience and knowledge of the Commissioners. Public Comments None. 4. Receive Presentation and Discuss Monterey City Code Section 38-74b Land Use Regulations for Properties Without Historic Zoning (Not a Project under CEQA per Article 20, Section 15378 and under General Rule Article 5, Section 15061) (No Written Report, Verbal Presentation Only) ACTION: Received Report and Discussed Monterey City Code Section 38-74b Land Use Regulations for Properties Without Historic Zoning Staff Presentation/Commissioner Questions Community Development Director Kim Cole and Principal Planner Roveri presented the Agenda Report and answered Commissioner questions. Commissioner O’Neil asked for clarification on the direction of projects that aren’t being considered historic or not. Ms. Cole clarified that older homes designed in alliance with the Secretary of Interior Standards will go before the Architectural Review Committee (ARC). Chair Smith-Crivello questioned if homes with projects that went before ARC could come back and apply for a Mills Act. Ms. Cole affirmed they can. Commissioner Hambaro asked if homes that are 50 years old or older that aren’t included in the reconnaissance survey list can be considered historic. Ms. Cole answered homes that have been left off the reconnaissance survey can be considered historic with an intensive survey. Commissioner Dawson speculated that homes that are almost 100 years old and built by a predominant builder should go before the Historic Preservation Commission (HPC) before they make additions or alterations. Commissioner Dawson proposed a joint meeting with ARC. Ms. Cole stated that would require a change of code. Ms. Cole added it’s possible to join the ARC and HPC with a change of code. Commissioner Dawson suggested having a few members from ARC and HPC rather than having full attendance from both Commissions. Ms. Cole included that the City cannot designate a home historic without the owner’s consent except for homes eligible for the national register and considered first, last, only, or rare of its type. Commissioner O’Neil asked if staff could reject the qualified historian reports. Ms. Cole said there is a struggle to argue a qualified historian’s report is wrong. Ms. Cole added that one idea considered is requiring the applicant to make a deposit with the City in exchange for an on-call consultant, but the challenge is government contracting due to higher insurance requirements. Ms. Cole included that the cost and lack of staff resources in managing contracts discourages the idea of on-call consulting. Commissioner Hambaro asked if there would be updates to the reconnaissance survey list since it is out of date. Ms. Roveri said that the previous surveys were done with a grant and the City could pursue another grant. Ms. Roveri added that it would be ideal to update the surveys but that would require lots of resources. Commissioner Hambaro speculated it isn’t fair to the people whose homes should have been included on the reconnaissance surveys but were left off. Chair Smith-Crivello pointed out a community member may have their property reviewed and there is a process for that. Ms. Roveri outlined the process for demolishing potentially historic properties. Commissioner Dawson asked for a presentation on demolition by neglect. Commissioner Rodriguez agreed and expressed frustration that there are no consequences for neglect. Ms. Cole interjected that the code is currently silent on demolition by neglect, but the county has a demolition by neglect code. Ms. Roveri stated the City would need to adopt their own demolition by neglect section to the ordinance and that Commissioners can request to agendize it or to have staff research what the county has done. Public Comments None. COMMISSIONER COMMENTS: Commissioner Rath suggested preserving part of the adobe wall within a glass encasement that was exposed when the side of 498 Alvarado fell. Ms. Roveri stated a historian is updating the historic preservation report and can ask if it can be preserved. INFORMATIONAL REPORTS & STAFF COMMENTS  Update received. Members of the public have the right to address the Commission on any Agenda items. The Chair will formally open the floor for public comment.
