APPROVAL OF MINUTES 1. January 24, 2019 Ms. Rasch requested a revision on page 22, under her Committee member comment. She said her comment made it sound as though the fiber optic study started, which it has not, so she requested the sentence be changed from “Jean Rasch said she appreciates the fiber optic study starting…” to “Jean Rasch said she would appreciate the fiber optic study starting.” Sharon Dwight made a motion to approve the minutes as amended. Harlan Jencks seconded the motion. The motion passed unanimously. PUBLIC COMMENTS Mr. Krebs opened public comments. Seeing none, Mr. Krebs closed public comments. INFORMATIONAL REPORTS & STAFF COMMENTS  Neighborhood Improvement Program Committee Minutes Wednesday, February 20, 2019 Mr. Krebs said there was nothing to report. NIP INFORMATIONAL REPORTS 2. NIP Spokesperson Reports Mr. Heuer said that two City Council meetings ago, Council gave direction on NIP projects. He said Councilmember Smith pushed for a tot lot in Oak Grove, playgrounds in general, bathrooms in key locations throughout the City, traffic calming projects and he hoped somebody would put in a project for Lighthouse at Bolio to address the temporary bollards. Mr. Heuer said Councilmember Williamson was pushing for bike lanes and agreed with what Councilmember Smith said. Mr. Heuer said Councilmember Albert pushed for the same projects as the other Councilmembers and also emphasized traffic calming and renovating Jack’s Park field. Mr. Heuer stated that Councilmember Haffa emphasized safety bike lanes, tree maintenance and any items relating to historic preservation. Mr. Heuer said Mayor Roberson’s focus was fuel reduction throughout the City. He added that there was discussion on fuel reduction and hazardous trees. Mr. Heuer said he informed Council of what NIP has funded for fuel reduction and residents may be happy because they are paying less in fire insurance than neighboring towns due to the fuel reduction work being done. Mr. Heuer said they also discussed tree planting. Mr. Heuer said he, Mr. Ruccello and Ms. Dwight met with the City Manager, Mayor and City Attorney. He said there was a lively discussion regarding items in the NIP Policy and Procedures Manual. He stated that certain procedural aspects currently in the manual will be going into a boards and commissions manual that the other boards and commissions also use. He said part of the policy and procedures manual will need to be changed to meet the Maddy Act. He reported that they are also looking at longer terms so members do not need to be appointed every year. Mr. Heuer discussed the need for a different appointment process as well, and how anyone must be able to apply, because there are legal issues if the NIP requires people to be part of a neighborhood association. He said there will still be an NIP Policy and Procedures Manual, but it will contain items specific to the NIP Committee. He added that if there are changes then the NIP will have the ability to approve it and it will not have to be approved by City Council. Mr. Heuer said the NIP will also become a full commission and not a committee. Ms. Dwight said the interview process under the Maddy Act is a public process, so the NIP will now be interviewed as all other boards and commissions are interviewed. She stated that since the NIP has no decision power, then they may be able to do something smaller than the Form 700 conflict of interest form currently required. Ms. Harrison asked if people had to live in the neighborhood to apply for the NIP Committee. Mr. Heuer said they have to be a resident of the neighborhood they are applying to be a NIP Representative for, but are not required to be involved with their neighborhood association. Ms. Alley asked for clarification on the Maddy Act. Ms. Dwight said it has to do with transparency and requires a public process for those who apply to sit on a boards or commissions. Ms. Alley asked why the Committee was not previously under the Maddy Act. Ms. Dwight said it is because the Maddy Act was passed only a couple of years ago. Neighborhood Improvement Program Committee Meeting Minutes Wednesday, February 20, 2019 2 Neighborhood Improvement Program Committee Minutes Wednesday, February 20, 2019 Mr. Krebs said he followed the Maddy Act and publicized for NIP Representatives in the Downtown and Skyline Ridge neighborhoods and that is how NIP got a Downtown Rep. Mr. Heuer said there cannot be a requirement that applicants must have a neighborhood association in order to be a NIP Representative. He said you cannot have those requirements for a Commission, because anybody can apply. He said you can have set a standard saying applicants must live within the district. Ms. Dwight clarified that currently the neighborhood associations nominate NIP Representatives and Alternates and the City Council can, under the current rules, decline appointing somebody and the neighborhood association can nominate somebody else. She said by having no tie with neighborhood associations and instead saying any resident can apply, it basically means two City Council members will decide who is going to serve on the NIP. Mr. Heuer said two Councilmembers will nominate the persons and the full Council will vote. Mr. Rowley said the Mayor pointed out that Monterey is one of the few cities that has the Mayor as a subcommittee of the Council and other cities do not have an interview process like the City has. He said ours is a more open process, even though the Mayor indicated nobody shows up but the interviewee. Mr. Rowley said it is an example of leadership by our City Council and the Mayor. He said Monterey is unusual compared to other cities and is exceptional compared to other cities. Ms. Dwight said applications are published and all information becomes public information and she does not think it is wise to have that information readily available to anyone. She said what you write on your form is out there for anyone to see and she does not think it is a good idea. Mr. Heuer stated that the Form 700 is also a public document and is easy to get. Ms. Fields said there is nothing like NIP anywhere, so there is nothing to compare it to. She said the Committee needs to look carefully at the process. She stated that they are going to turn the NIP, a community neighborhood driven idea, into something political. She said she understands that it does not need to be associated with a neighborhood association but that she hoped there was a way to keep each neighborhood’s input as it comes together and that they can avoid politicization at all costs that will make the NIP like any other public office. She said if they need to go down to a work group instead of being a Brown Act entity, or look for something other than the word Commission, that she invites the creativity of the folks working on this to look for that, because the NIP is not a Commission. Mr. Heuer said they raised many issues during the meeting and at the end of the day it was concluded that this is what is happening. He said there was concern over the four year term length. He said there is nothing stopping neighborhood submissions of applicants, because it is not disallowed, but the point is that anybody else that wants to apply can and that is what legally has to happen. Ms. Dwight said once the City Attorney has extracted the information, it ends up in the commissions manual and the subcommittee has a chance to take a look at what is left. She said it will then require a rewrite. Ms. Alley asked for clarification regarding NIP Committee applicants. Ms. Dwight said the Neighborhood Improvement Program Committee Meeting Minutes Wednesday, February 20, 2019 3  Neighborhood Improvement Program Committee Minutes Wednesday, February 20, 2019 only requirement is that you live in the neighborhood and the read job description and say you will fulfill those duties. Mr. Rowley asked what is driving the change and Mr. Heuer said it was the Mayor. Mr. Rowley said this has not been discussed to his knowledge at any City Council meeting. Ms. Dwight said the City Attorney is concerned about the NIP compliance with the Maddy Act. Mr. Heuer said the Mayor was also adamant about the NIP complying and having an open process and, in particular, was heading the request for four-year terms, but said he was okay with two simply because the amount of time it was taking to get the Committee reappointed. Mr. Heuer said the current Committee is not technically reappointed, but the rule is that you serve until somebody replaces you. He said the sheer volume of interviewing everybody and scheduling it is why the Mayor prefers longer terms. Mr. Overton said a neighbor complained that his association was not compliant with the Davis-Stirling Act of California and they had to then ensure compliance. He said this issue is the same; it is a compliance issue and the NIP needs to be in compliance. Mr. Duke said cities all over the state of California have been filing Maddy compliance lists since 2015. Ms. Alley asked why they must complete a Form 700 if they have not been reappointed this year but are continuing. Mr. Heuer confirmed that it is a state requirement for annual filing. Ms. Dwight said their current Form 700’s on file from last year expire in April and if they do not complete a new one, then they cannot vote for NIP projects. PUBLIC APPEARANCE 3. Recommend City Council Appropriate $51,000 From the Neighborhood Improvement Program Contingency Account (31ncont) in the Amount of $40,500 to the Glenwood/MPC Track Crosswalk Improvements Project Account (35n1736) and $10,500 to the 200/201 Glenwood RRFB Project Account (35n1809) (Not a project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061). Mr. Krebs said bids were high and so he was going out to re-bid March 12. He said based on bid prices received, it seems he may run over cost. He said he made some changes to the bid, citing his change from a concrete wall to a wood wall. He said the change will reduce the concrete cure time and traffic control, so the cost should be down. Ms. Whitney said the two projects are needed due to major traffic issues that make the area like a speedway. She said the area has become a highway cut-through and these are traffic calming items to slow it down. She added that the lighted bus areas are important for safety. Ms. Whitney stated that the projects are desperately needed. Ms. Dwight said this is precisely the reason NIP has a contingency fund. She said Mr. Krebs is taking care of the project scope as needs to be done and sometimes it just costs more money. Mr. Duke said some of the change of cost seems to be from when the project was estimated and approved to when it went out to bid. Review the Preliminary Project Submittals for the NIP Fiscal Year 2019/20 program (Not a project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061). Mr. Krebs said tonight was the preliminary review to determine whether or not each project is a viable NIP project. NEIGHBRHD PROJECT NAME Mesa Rd at Fremont St Crosswalk AM-1 Project. Mesa Rd Speedbumps Mr. Krebs said the project conflicts with Council direction. Ms. Dwight asked if there is anything else acceptable to slow speed and act as a traffic calming device. Mr. Heuer said there is nothing in place for traffic calming on Mesa Road, so to do anything would mean they would need AM-2 to amend the traffic calming plan. Ms. Dwight asked if the project can be kept on the books in case the applicant wants to amend the project. Mr. Heuer said if they want to amend the project, then it may cause issues, but said he would speak with project nominator. Project. Fairground Road/Airport Road Lighting and Cameras Mr. Krebs said the Fairground Road frontage belongs to the Fairgrounds, which means it will require a Memorandum of COK-4 Understanding (MOU). Mr. Ruccello referred to shared funding. Mr. Krebs said the NIP Policy and Procedures Manual requests shared funding on these sort of projects. Project. Deer Forest/Elk Run Utility Box Relocation DF-1 Project. Deer Forest Traffic Calming DF-2 Project. DMB-1 Spray Ave Tot Lot Resurfacing (2018 Cut- Off) Project. Spray Ave Dog Waste Station DMB-2 Project. Spray Ave Tot Lot Resurface and Exercise Equipment Ms. Fields said this is largely the same as DMB-1, but the applicant DMB-3 wanted to see about getting more funding for exercise equipment. Ms. Fields said we will see if only one of the projects stays or if both stay. Project. DMB-4 Del Monte Beach/Tide Ave Security Camera Ms. Dwight asked if this is something the police department is going to need to approve. She asked if the cameras will be mounted on utility poles and if the City will want to undertake it. Mr. Krebs said it is an underground district and he anticipates having to set a pole to mount the cameras. He explained if they set a City pole, then there are other ramifications and City protocol is followed for cameras. He said it is considered a project at this time, but requires additional work and information to develop the scope. Ms. Dwight said this is a new move for the City and she wants to make sure the City wants to go down this road before NIP thinks to undertake it. Neighborhood Improvement Program Committee Meeting Minutes Wednesday, February 20, 2019 6 Neighborhood Improvement Program Committee Minutes Wednesday, February 20, 2019 Ms. Fields said the project is supposed to be focused on license plates, so she thinks it will not be looking at the beach. She said it is written as though it may be, but it will be clarified. Mr. Ruccello said NIP explored this years ago. He said there are no cameras in the City that take license numbers and this will be the first. He said it requires a Council policy decision. He said the cameras the City has now look at the volume of traffic and allow the City staff to know where to intercede to break up traffic jams. He said this project is actually capturing information and that is not done yet in the City, so it is a decision City Council needs to explore before voting night. Ms. Dwight requested the item be on the Council agenda before voting night. Mr. Krebs said he will run the process through. Mr. Duke said he believes the cameras would be supported by the police department. Mr. Krebs said it is a project but more information is needed before voting night. Project. DMB Retaining Wall Repair DMB-5 Project. DMB Rec Trail Signage Mr. Krebs said he needs to work with the applicant because he does not believe they are aware there is a new intersection design and construction funding for the intersection at the Rec Trail and Casa Verde, which may solve the issue for the applicant. DMB-6 Ms. Fields said she is going to provide the applicant with a copy of the design to see if it translates into additional things that are not covered by the project as currently requested. Project. Beach Way/Surf Way Traffic Calming Ms. Dwight asked what traffic calming has been completed in Del Monte Beach so far. Mr. Krebs said Del Monte Beach has a circulation plan. DMB-7 Ms. Fields said a study was completed. She said there was some money left after the study, but nothing has been built. She said they will go back to the study to see what the discussion was, how it may fit with the leftover money and what the applicant would like. Project. DMB-8 DMB Dunes Play Area Ms. Fields said there was volleyball court, but it sloughed away. Franklin and Figueroa Trash Receptacle Ms. Dwight said NIP does not do trash cans and that this is not a capital project. Mr. Tipton said the idea is to make the trash cans look more pleasing by DT-3 placing a structure around them that improves the appearance. Ms. Dwight said if it takes up any sidewalk area, NIP cannot make that decision. She said she is not sure who makes the decision on taking up public walkways. Mr. Heuer said the City will have to sign off. Project. Harbor Parking Lot EV Charging Station Mr. Ruccello said the wharf parking lot is under the tidelands fund area, DT-5 which has millions in funding. Mr. Krebs said it is still a project and the committee is not voting on whether to fund it tonight. Project. Downtown and Wharf Trash/Recycle Enclosures DT-6 Project. Fisherman Flats Park Improvements Mr. Rowley discussed the dog waste bag stations and the City Council recently allowing dogs in the City parks. Ms. Dwight asked about additional garbage cans and if Mr. Marcuzzo FF-1 can add any. Mr. Marcuzzo said yes. Mr. Ruccello said the project details replacing a large tree with two trees and that NIP passed $100,000 on tree replacement, so those trees may come out of that fund. Project. Josselyn Cyn Radar Speed Signs Mr. Rowley requested that this be a Citywide project. Mr. Krebs said it will be moved to the next sequential citywide number. FF-2 Moved to citywide. Will now be CW-45. Project. FF-3 Marsala Circle Sidewalk Infill Mr. Rowley said the owners of 2034 do not want the sidewalk infill. Mr. Rowley said it will subtract 15 feet and now be 80 linear feet of infill. She said the City Attorney has been very clear in the past that if you start a sidewalk then you must be able to get people to the end. She said this is contrary to the direction the City Attorney has provided. Mr. Krebs said he will take a look at the project and discuss with the applicant. He said Ms. Dwight is correct and the sidewalk needs to get people down the block. Project. Fisherman Flats Greenbelt Fuel Reduction FF-4 Project. Mar Vista Drive Radar Sign Ms. Dwight asked why this project only has one speed sign in one direction when speed is usually regulated in both directions. Mr. Krebs MV-1 said that in years past they were not able to find a place for one on the other side. Project. Via Paraiso Park Pickleball 6-Court Ms. Rasch said it is a policy that projects go through Parks first, then come to NIP for funding. Ms. Dwight said the PRC looked at Pickleball, as they have control over what goes into the City’s parks. She said there is an idea proposed that NIP asks PRC if a project is okay with them. She said before it is voted on, NIP needs guidance from PRC saying it is consistent with their policy for the park. MV-2 Ms. Rasch asked if that is something Mr. Krebs does, if he takes it to the PRC in time. Mr. Krebs said yes. Mr. Heuer said when projects go to the PRC it is for compliance with master plans, and is not whether they like the idea or not. He said they look at whether the master plan allows for particular items in each park and if there is space for it. He added that they can give preference on items, but it is up to the NIP on whether they want to vote for particular projects. Project. Dry Creek Road Storm Drain Grate Upgrade MV-3 Project. MV-4 El Caminito Del Norte Streetlight Ms. Dwight said NIP does not do streetlights. She said ordinarily the City has a standard for where they need lights. She asked if they can check to see that it is a location where the City wants lights. Mr. Krebs Neighborhood Improvement Program Committee Meeting Minutes Wednesday, February 20, 2019 10 Neighborhood Improvement Program Committee Minutes Wednesday, February 20, 2019 said that is why he noted in his slideshow that the City anticipates having a Standard Operating Procedure (SOP) for streetlight installation in place by the end of 2019. Ms. Dwight said NIP has routinely, over the years, referred streetlights to the City department that deals with them. Mr. Heuer said NIP did fund a streetlight in Fisherman Flats that was controversial. He said they must meet City standards, but NIP has funded streetlights. He said some may not have voted for it, but it passed and was funded. Ms. Dwight said everyone needs to be very clear and consistent in understanding that NIP is perhaps 2% of the City’s budget and they are increasingly asking NIP to fund things that the City actually budgets money to accomplish. She said it is important to take it to the department that ordinarily handles it and see if they can deal with it instead of asking NIP to do the heavy lifting. Mr. Overton said that the project nomination did not come from the City, but came from residents. He said it is not the City pushing for the funding. Ms. Dwight clarified that she was not saying the City was pushing it, but that NIP is a very small part of the City’s budget and there is other funding in the City to do streetlights. She asked what the rest of the budget is for if NIP just rolls over and says yes to anything. Project. El Dorado Sidewalk Resurface MV-5 Project. Via Paraiso Park Pickleball 4-Court Mr. Krebs said the project would involve removal of the basketball court. He noted that the Parks staff has not supported removing the basketball court at Via Paraiso. MV-6 Ms. Rasch reiterated that removal of the basketball court was not supported by Parks staff. Mr. Krebs said it has not gone through the PRC yet, and his note was from the Parks staff that briefly reviewed the project. Project. MV-7 Mar Vista Traffic Calming, Ph 1 Ms. Dwight acknowledged that the project said location and scope are to be determined. She asked who will determine the location of the traffic calming. Mr. Krebs said he will be working with the applicant to develop the scope. He said there is a current NIP project for the design phase. Ms. Dwight requested clarification, asking if this is a beginning phase of implementation of an existing traffic calming plan. Mr. Krebs confirmed. Project. Mar Vista/Soledad Ped Improvement, Ph I Mr. Krebs said there is a study for Mar Vista and Soledad. He said the MV-8 applicant wants to implement one of the phases from the study. Project. Via del Pinar Realignment at Via del Rey Ms. Dwight asked if this project has come to the NIP in the past. Mr. MV-9 Krebs said it was a project last year, but did not get funded. Project. Via Buena Vista On-Street Parking and Speed Signs Mr. Krebs said the Fire department determined it was not necessary to limit parking. He said it does not meet the definition of an alley and therefore the City cannot legally place a 15 mph sign. He noted that residential permit parking may be requested through Parking. He also said the ivy hedge can be trimmed, which may be requested through Code Enforcement. MV-10 Ms. Rasch asked Mr. Krebs if there was any item in the project that can be developed. She said projects have been discussed, pieces removed and still kept as a valid project on the books. Mr. Krebs said the various items may be taken care of by other departments and this does not need to be NIP project. Ms. Dwight said this is a referral, which is an official action to another department, just not NIP. Not a project. Monterey Vista Greenbelt Fuel Reduction MV-11 Project. Lily 900 Block Southwest Sidewalk Ms. Dwight said the New Monterey area plan talks about having a standard 36-foot width for streets. She said any time there is a request for sidewalks, the street is widened to the minimum 36-foot width. She said the project will be a widening project. She said there is sidewalk on NM-1 one side with 15 or 16 feet taken for the strip of sidewalk. She said the project would involve moving the curb on both sides and would affect two houses. She explained that it is a transition block between Pacific Grove and Monterey. She said the location at which the applicant is requesting the sidewalk would require widening. Project. NM-2 Hawthorne-Bolio Bicycle Ramp, Ph I Neighborhood Improvement Program Committee Meeting Minutes Wednesday, February 20, 2019 12 Neighborhood Improvement Program Committee Minutes Wednesday, February 20, 2019 Ms. Dwight said preliminary design was completed by TAMC, so the project would be taking what has been done and implementing a part of the City mobility plan. Mr. Heuer asked if the project is on City or Army property. Mr. Krebs said 90% of the work is on City property, but the City must get authorization from the Army to connect it. Mr. Heuer said it must go through the process for third parties, just like all others, prior to voting night. He said there have been projects that went to voting night and had not gone through the third-party process. He said he wanted to be sure there was time for it to get done beforehand. Mr. Krebs said the project must go through National Environmental Policy Act (NEPA) and the Army cannot make a decision, but can provide intent. Ninth and Sloat Rapid Rectangular Flashing Beacon Mr. Jencks said it is his understanding that the City has a plan to rework the intersection at Sloat and Tenth, which is the main entrance to NPS. He said if that is the case, then it will preclude this project. Mr. Krebs said the City does not place rapid flashing beacons at an all- way stop. He said the applicant did request a crosswalk at Third. Mr. Krebs said there is a current project to complete RRFBs at Fifth and Sloat. He said he will have to go back to the project applicant to see if they really want to push for the RRFB at Third Street. OG-1 Mr. Jencks asked if the City is in fact planning to do something about the intersection. Mr. Krebs said it is not a NIP project, so he is not aware of it. He said it could be a CIP project and he can find out. Mr. Jencks said if it is a CIP, then it would render this project nomination irrelevant, except for Third Street. Mr. Jencks said he agrees with staff that it is not necessary and said the project would be done primarily for the benefit of NPS students. Ramona Ave Highway Screening Mr. Overton said that if the screening type is trees, then as Mr. Ruccello said in regards to FF-1, NIP funded the replanting of trees. He asked if this could be included. Mr. Krebs said he can go to the Urban Forester to find out if this is a good spot for trees. He said he will have to take a look and see if it is an opportune site for trees. VDM-3 Mr. Ruccello said the tree replanting fund was targeted at landmark trees lost in the neighborhoods. He said screening should be a separate item and that the replanting funding will go quickly, due to the large loss of landmark trees in the various neighborhoods. Project. Del Robles Ave Streetlights Ms. Dwight said it was possible to provide a streetlight by one of the houses, but the applicant had said they wanted it on the other side because they wanted to discourage RV parking. Ms. Dwight said rather than using streetlights to discourage people from parking, there is a less-expensive way to handle it. She said she does not believe it is a proper use of streetlights. Mr. Heuer said it is a valid project. He said it was a project last year and VDM-4 that means it is a project this year. He said tonight is the screening to determine whether nominations are valid projects. Ms. Dwight said she was raising the issue because there were two different points of view. She said NIP ordinarily does not allow somebody to set policy for them. She said she is raising the issue now so Mr. Krebs has the time to get answers to them. Mr. Krebs said he will look into it. He said it was left vague because prices were high, so he will have to see what the estimate comes in for on the volleyball court. Project. She asked if there is anything that can be done to remove the sand from the CW-4 existing boardwalks so persons can make it to the beach. Mr. Krebs said that would make it a maintenance issue and he can pass it on to the maintenance division. Project. CW-5 Citywide Dog Park Study Mr. Krebs said he is removing the word “study” from the title, because the project is not a study, but is a construction project. Ms. Dwight said the PRC did not have enough time to review the parks- related NIP preliminary projects and consider priorities. She said they submitted all of them, so some of them may be pulled or revised. She said the PRC will go over them at their meeting tomorrow. Ms. Dwight said there is already an entryway that looks like track. She said they discussed having play equipment in place of where the train is now. She said what is going to the PRC tomorrow night is to leave the engine there, keep the fencing and take out a piece of play equipment and put in the train. Mr. Krebs said it is what they requested and he drew what they asked. Mr. Marcuzzo said he was asked to modify it to not be certain that the train will be removed. CW-7 Mr. Heuer said it is a valid project that is going to need a final design before voting night that receives a “blessed solution” from the PRC. Mr. Ruccello said the decision has to go to the City Council because moving the train is bigger than NIP. He said between now and voting night NIP will have clear direction from the PRC and if it involves moving the train then it will involve Council direction. Mr. Krebs said that is why the description currently says “somewhere in Dennis the Menace park.” Project Rec Trail & N Fremont Bike Repair Stations Ms. Dwight said a representative from the county’s bicycle committee told her TAMC has a funding program for bike repair stations. She CW-8 thinks NIP should see if it is something that may be done jointly with TAMC. Mr. Krebs said yes, just like they are working on now with the Library bike rack project. Project. CW-9 Citywide Aquatic Center Mr. Ruccello said it is not part of Parks and Recreation master plan and will cost millions of dollars to make happen and a lot of money for annual maintenance. Ms. Dwight said it is something that was discussed as they were drafting the Parks master plan, recognizing that having longer lanes and something competitive would be worth exploring. She said at this juncture it is going to go to the PRC and NIP will find out from them whether they want to entertain it. Mr. Ruccello said this project came up from the original battle over the Sports Center and an Olympic size pool versus the pool in there now. Mr. Ruccello asked if the project should go before Cultural Arts. Ms. Dwight said the applicant has taken it to them already. Project. CW-17 Accessible Beach Mats Mr. Krebs said the request is to have the beach mats out to the water, but you cannot anchor them because the water is going to move them out. Rec Trail Safety Improvements Mr. Krebs said the current Parks and Recreation Master Plan has a mixed-use shared path for the existing 14-foot wide Rec Trail and does not have it distinguished, so it would not be able to comply to the applicant’s request on that piece. He said it may be able to comply to the railroad tie bike pedal snagging, but with the current Parks and Recreation Master Plan the existing path needs to be mixed-use. Mr. Ruccello asked if this is a valid project. Mr. Krebs said the only valid portion is the railroad tie bike pedal issue, but he has to go back and speak with the applicant. Mr. Ruccello asked if that would be a CW-19 maintenance issue. Mr. Krebs said it would be an improvement, because bike pedals are hitting the retaining wall. He said he needs to work with the applicant. Mr. Ruccello said if somebody submits an NIP project to ban all pedestrians from the Rec Trail and make it only bikes, or the opposite, then it would not be a valid project. Mr. Krebs said the first half of the applicant’s write-up is not valid because it does not follow the Parks Master Plan for shared-use. She asked if that was part of the original description when the project came to NIP last year. She said when they were out for the van tour it was decided ADA access could be in place, but a total regrade and install of a retaining wall was not necessary. She said she wants to make certain that they are looking at the lesser because it is still a rustic park. Mr. Overton said he is the project applicant and he resubmitted what he CW-26 submitted the previous year. He said he is fine with not including the retaining wall and keeping it rustic. He referred to the minutes from the January 24, 2019 meeting and said John Wilkes, Park Attendant at Vets Park, thought the project was an excellent idea because it is in poor condition and parking is an issue so he hoped to get serious consideration. Mr. Overton said he would like to get their input on what it should look like. Ms. Dwight said it was going to be a major cut into the hillside and would be a big difference compared to what is there now. Project. Lake El Estero Portland Loo Ms. Fields said it is her understanding that all of the listed restrooms are closed at night and it is causing maintenance issues around the outside of the restrooms. She requested clarification on the issue. Mr. Krebs CW-27 said the restrooms are closed, but the park is also closed from 10pm to 6 am. Ms. Dwight said the buildings are closing at 5 or 6 pm, but the park is open as long as there is daylight. Project. Vets Pk Bball Court, Ph II CW-28 Project. Conduit Installation Pilot Project Mr. Heuer said he would hope this coordinates with the fiber-optic and undergrounding study that was funded and hoping to get started soon. He said they need to make sure it coordinates. Ms. Dwight said there needs to be a planning effort because there is CW-31 preliminary engineering that has to happen before anything can be constructed. She said NIP is bypassing setting up an assessment district and that setting aside a quarter of a million dollars before knowing what area is being covered concerns her. She said she is not certain this is valid. Mr. Heuer said it is technically valid, but whether it is wise depends on the study being completed to give a better idea. Project. Downtown Portland Loos Mike Brassfield, project applicant, said he outlined in his request to have staff decide the best placement downtown. He said one suggestion was to install near the Rec Trail, closer to the Wharf. He said people who need to use restrooms do not go to the end of the Wharf and CW-32 restaurants to not let them in. Ms. Dwight asked if this will receive guidance from Parks and Recreation for placement. She said she wants to know if will be run by PRC and what they say before the project is voted on. Project. CW-44 Emergency Operations Center Upgrade Mr. Krebs said this project was not included on the project list that went out because it was in his email and he did not get it to Ms. Huerta to add to the list that went out. Mr. Heuer requested clarification on which EOC the project was intended for. Mr. Duke clarified that it was for the original EOC, not the backup EOC. Mr. Ruccello said he is not sure what equipment and items can be funded through NIP. Mr. Krebs opened public comments. Mr. Krebs clarified that tonight’s NIP meeting was to discuss whether a project was a valid project and not whether it should be funded or not. Bella Lofaso, project applicant for DT-3, said it seemed like there were several projects for signage and incorporating historic emphasis on the City. She said if all or part of those projects are funded, it would be nice if they were consistent and have a unifying theme instead of things being somewhat random. Bruce Zanetta discussed CW-31. Ms. Rasch discussed the item as well. Seeing no more comments, Mr. Krebs closed public comments. Ms. Dwight discussed the matter of conduit and undergrounding districts with Mr. Krebs. Mr. Ruccello said he has concern about projects submitted that are specifically designed without considering master plans and the overall views of Council and the City. He said he hates to be put in that box where NIP is making those decisions and funding projects. He he wants the various commissions to make hard decisions and tell NIP if the project is good for that park or street, etc. Mr. Ruccello said his other concern is the millions of dollars spent on restrooms and that they have closing times. He said people have 24-hour timelines and it can cause custodial issues if restrooms are locked. He said he wants to find a way to keep restrooms open 24 hours a day, which is why he suggested the Portland-Loos. He said Portland-Loos are designed to be anti-crime, low-maintenance and accessible 24 hours a day. He requested Mr. Krebs agendize an item for Council to provide City policy on public restrooms. COMMITTEE MEMBER COMMENTS Dave Overton referred to Committee member comments from the January 24, 2019 NIP meeting and said the residents in Deer Flats Park are pleased with what has been done by Parks; he thanked Mr. Marcuzzo. Mr. Overton thanked Mr. Krebs and Ms. Huerta for their hard work and providing the Committee with their project nomination books. April Harrison thanked Ms. Huerta for her work. Ms. Harrison said she is concerned that there are several preliminary projects submitted that require MOUs. She said her experience regarding MOUs, referencing the Old Town neighborhood park, has been less than stellar. She told everyone to proceed with caution and remember that those items must still go before the school board. She told Mr. Krebs if there was anything he could do to expedite the process on the Old Town Park she would appreciate it. Olivia Morgan said she needs to get home because a PG&E issue blew out every appliance in her home and so tonight she has no comment. Sharon Dwight said she is very concerned that the NIP Committee has not been appointed. She said the Committee was told they are being continued into this year. She said the Committee serves for one year. She said for those with new Alternates, they cannot participate until they are appointed and she does not know what the hang up is. She said they need it resolved. Mr. Krebs said he was told the item is on the agenda for the next Council meeting, but he has not been asked to help clarify anything from his original submittal. Mr. Krebs said it is on the agenda for March 5 and he loaded up the info for it. Ms. Dwight said she knows staff did exactly what they are supposed to do. She said the issue happens after it leaves here. Dennis Duke congratulated Mr. Krebs on his new position and said looking through the NIP project nomination book one of the applicants incorrectly referred to Mr. Krebs as the City Manager. Lee Whitney thanked everybody for voting for the contingency funds for her neighborhood. She said it is desperately needed. She said good night and good luck from Edward Murrow. Jean Rasch had no comment. Richard Ruccello said he had a small request. He said he has been one of the people pushing the fuel reduction in City forests. He said NIP funds it every year and he would like a short email saying how much is done in Fisherman Flats, Skyline Ridge, Monterey Vista, etc. He said he wants to know the stage of completion and which is the worst area in the City. He said he needs that information in order to make good judgements. He requested a short summary, neighborhood by neighborhood. Ms. Dwight said she wants to know what the plan is as well. She said if the funding has not been spent but there is a start date, then it helps the Committee. Rick Heuer said one of the challenges with fuel reduction is that it is continually changing and growing. He agreed that understanding what has been spent where and how much is left will be a big help. He said if he is down to zero then he may want more than $25,000. He said he is really worried after the wet season, between trees falling and brush undergrowth, etc. Dennis Duke said he has been out in the rain and saw trees coming down. He said Carmel was a mess last week. Harlan Jencks thanked the staff for their work. Merrily Alley had no comment. Tom Rowley said this is the second year NIP has been able to go through the original submissions, pointing to the NIP project nomination book. He said it is helpful to see the original submissions. He thanked the staff. He said on all of the greenbelt maintenance project nominations that the City Forester submitted, he placed an amount on the applications that he is recommending. He said it is not a comprehensive list, but is sort of a priority list.
