City Staff Present: Jeff Krebs, NIP Staff Coordinator Undine Lauer, Administrative Assistant II, City Clerk’s Office Steve Wittry, Public Works Director Christine Davi, City Attorney CALL TO ORDER Mr. Krebs called the meeting to order at 6:30 p.m. ROLL CALL Ms. Lauer called the roll with eleven (11) neighborhoods represented and Aguajito Oaks, Deer Flats, Del Monte Beach, and Fisherman Flats absent. PUBLIC COMMENTS Mr. Krebs opened public comments. Seeing none, Mr. Krebs closed public comments. INFORMATIONAL REPORTS & STAFF COMMENTS Action: Mr. Krebs said there was nothing to report. Neighborhood Improvement Program Committee Minutes Tuesday, July 2, 2019 NIP INFORMATIONAL REPORTS 1. NIP Spokesperson Reports Action: Rick Heuer discussed the Grand Jury report, noting that he filed a reply. Richard Ruccello and Sharon Dwight commented on the Grand Jury report. PUBLIC APPEARANCE 2. Receive a Report and Comment on Proposed Modifications to the Neighborhood and Community Improvement Program’s Voting Procedures (Not a project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061) Action: City Attorney, Christine Davi presented proposal to modify NIP voting processes and procedures. Curt Tipton, Duane Peterson, Sharon Dwight, Richard Ruccello, Jean Rasch, Dennis Duke, Kathleen Baker, Steve Wittry and Jeff Krebs also spoke regarding the item. 3. Approve Close Out List of Completed Projects and Recommend Council Appropriate Funding from NIP Contingency Account to the Old Town Franklin/High Street Crosswalk and RRFB Installation Project Account (Not a project under CEQA Article 20, Section 15378 and under General Rule Article 5, Section 15061) Action: Jeff Krebs presented the agenda report and close out list of completed projects. Rick Heuer introduced a motion to appropriate $189.97 from the NIP Contingency account to the Old Town Franklin/High Street Crosswalk and RRFB Installation project. The motion was seconded by Dennis Duke. The motion carried by the following vote: AYES: 11 COMMITTEE MEMBERS: Heuer, Ruccello, Alley, Tipton, Whitney, Rasch, Dwight, Jencks, Harrison, Duke, Peterson NOES: 0 COMMITTEE MEMBERS: ABSENT: 0 COMMITTEE MEMBERS: ABSTAIN: 0 COMMITTEE MEMBERS: RECUSED: 0 COMMITTEE MEMBERS: Richard Ruccello introduced a motion to approve the close out list of completed projects less any projects to which a representative has a problem and must email Jeff Krebs about, and the Committee approves the remaining projects to be closed out and the remaining funds go to the NIP contingency fund. The motion was seconded by Merrily Alley. COMMITTEE MEMBER COMMENTS Duane Peterson joked that in the future representatives need to make sure that their alternates are at the far ends of the neighborhoods. Sharon Dwight said it is sad that the Committee is not working collaboratively to protect a treasure and that staff are thinking for them. She said never before did others set up their rules. Dennis Duke had no comment. Jean Rasch said she empathized with Sharon Dwight and that she feels similarly. She said it is easy to conclude the Committee more and it is not asking a lot of the City to collaborate. Lee Whitney said goodnight. Richard Ruccello referred to the conflict map and said for the Fairgrounds/Airport Road Lighting project there is a conflict of ‘RS’ and ‘SD’ and he asked about ‘RS.’ Jeff Krebs said he would take a look. Rick Heuer said he wanted to make it clear that the spokespeople were asked to meet with the City Attorney, Mayor, Public Works and Jeff Krebs to discuss and get their feedback. He said at the end of the day Council sets policy and the NIP does not. He said he is not going to do anything that puts him in legal jeopardy. Harlan Jencks said he has grave reservations about the voting procedure and said he is not sure how it will work. Merrily Alley said goodnight. April Harrison said the Committee needs to rewrite their manual. She said nobody has helped them and it has been sabotaged. She said it has to be done section by section and be brought before the whole Committee. Curt Tipton said the NIP needs to have a meeting to discuss the Grand Jury report. He said he would like everyone to have more input on the manual. Sharon Dwight said she wanted to follow up on the manual. She said when they spoke with the City Attorney months ago, but have not seen anything from the City Attorney regarding the discussed rewrites of the manual for all commissions.
