OVERSIGHT BOARD MEETING
Wednesday, August 22, 2012 – 7-9 p.m.

Oversight Board Members
Present: Chip Rerig, Mitchel Winick, Harvey Kuffner, Chuck Della Sala,
Michael Adamson, Dave Potter, Harvey Kuffner
Absent: Stephen Ma
City Staff Present: Finance Director Don Rhoads, Housing and Property Manager Rick
Marvin, and Clerk to Board, Maria Buell.
CALL TO ORDER
Chair Rerig called the meeting to order at 7:00 PM.
APPROVAL OF MINUTES
1. The Minutes of the July 25, 2012 meeting were approved by the following vote:

PUBLIC APPEARANCE
2. Receive an Oral Report and Consider Appointment of The Thompson Law Office as
Legal Counsel to the Oversight Board as Recommended by the Chair’s Ad Hoc
Committee
Staff Presentation/Board Member Questions
Staff member Marvin presented the staff report and answered Board members’ questions. He
said the recommendation to the Oversight Board was made after the Ad Hoc committee reviewed
the top three of the Applicants’ qualifications and determined that The Thompson Law Office was
the most qualified candidate who could provide the type of legal services the OB needs. Mr.
Marvin said that Chair Rerig would add more comments as to the process the Ad Hoc committee
followed.

Board Comments
Chair Rerig said that seven (7) qualified firms responded; three (3) firms were highly qualified and
one (1) was exceptionally qualified. The Ad Hoc committee consisted of Chair Rerig and Board
members Winick and Kuffner. They recommend the Board to hire Richard Glenn and The
Thompson Law Office because of their experience in the redevelopment and municipal law areas.
Board Member Winick said that he had no additional comments to offer from what Chair Rerig
had already provided the Board. Board member Kuffner said that the Ad Hoc committee
developed a matrix of qualifications needed and that three (3) stood out and that The Thompson
Law Office stood well above the other two.
Chair Rerig said that the next step is to ask the Board to approve the Ad Hoc’s recommendation
and that a standard City Contract was prepared. He reminded that the legal counsel will be
representing the OB only and that Attorney Davi will represent City. Chair Rerig said he would
arrange a meeting with Mr. Glenn to go over agendas and bring him up-to-date. He cautioned the
Board to use the legal fund judiciously and requested their approval of the Ad Hoc’s selection.
Board member Potter said he supports this recommendation and thanks the Ad Hoc Committee
for taking time to review and do the selection.
Public Comments:
Chair Rerig opened discussion to members of public on this item.
Richard Glenn said that The Thompson Law Office is honored to provide legal services. He
said his background is in municipal and redevelopment law and that will provide the best advice
possible to the Oversight Board. Ralph Thompson of The Thompson Law Office said it was a
pleasure for his firm to work with City.
Staff member Marvin reminded the Board that all actions need to be adopted by Resolution.
Having no additional requests to speak, Chair Rerig closed public comment.
MOTION:
On a motion by member Della Sala, seconded by Member Kuffner, the Board unanimously moved
to approve the selection of Richard Glenn and The Thompson Law Office as Legal Counsel to the
Oversight Board as Recommended by the Chair’s Ad Hoc Committee.
PASSED AND ADOPTED BY THE OVERSIGHT BOARD TO THE CITY OF MONTEREY
SUCCESSOR AGENCY this 22nd day of August, 2012, by the following vote:

MEMBER COMMENTS
Chair Rerig reminded Board of the upcoming Annual meeting in November 28, 2012. Special
notice will be provided by publishing it on the local newspaper. Chair Rerig stated that Clerk, Ms.
Buell, will be taking care of the publication and requested Board members to check their
calendars and notify office of any planned absence(s).
ADJOURNMENT
There being no further business, the meeting adjourned at 7:10 PM.

The next regular meeting of the Oversight Board is scheduled for September 26, 2012 at 7:00
p.m. The remaining Oversight Board meetings are October 24 and November 28. All regularly
scheduled meetings begin at 7 p.m at the City Council Chambers. There is no meeting for
December due to holiday schedule.

PUBLIC APPEARANCE
PUBLIC APPEARANCE items are reports on non-routine issues that might stimulate public
discussion, but that do not require formal noticing as public hearings. You are welcome to offer
your comments after being recognized by the Chair. The Oversight Board may limit the time each
speaker is allocated.
2. Receive an Oral Report and Consider Appointment of The Thompson Law Office as Legal
Counsel to the Oversight Board as Recommended by the Chair's Ad Hoc Committee

PUBLIC COMMENTS
PUBLIC COMMENTS allows you, the public, to speak for a maximum of three minutes on any
subject which is within the jurisdiction of the Oversight Board and which is not on the agenda. Any
person or group desiring to bring an item to the attention of the Oversight Board may do so by
addressing the Oversight Board during Public Comments or by addressing a letter of explanation
to: Housing and Property Management Office, 669 Van Buren St, Monterey, CA 93940. The
appropriate staff person will contact the sender concerning the details.
BOARD MEMBER COMMENTS
Board members may ask a question for clarification, make a brief announcement or make a brief
report on his or her activities. In addition, the Oversight Board may provide a referral to staff or
other resources for factual information, request staff to report back to the body at a subsequent
meeting concerning any City matter, or direct staff to place a request to agendize a matter of
business on a future agenda (G.C. 54954.2).
ADJOURNMENT
Members of the public have the right to address the Oversight Board on any item on the Agenda, before
or during its consideration [G.C. §54954.3(a)]. The Chair will formally open the floor for public comment
on items such as "Public Appearance" and "Public Hearings." If you wish to speak to items in any other
categories, for example "Consent Agenda," please advise the Secretary to the Board or the Chair prior to
the Oversight Board's action on that item, and you will be recognized. Notification as much in advance as
possible is appreciated.

The Oversight Board meeting packet may be reviewed by the public in the Library or the Housing and
Property Management Office. Any writings or documents pertaining to an open session item provided to a
majority of the Oversight Board less than 72 hours prior to the meeting, shall be made available for public
inspection at the front counter of the Housing and Property Management Office, at 669 Van Buren Street,
Monterey, California 93940 during normal business hours
Information distributed to the Oversight Board at the meeting becomes part of the public record. A copy of
written material, pictures, etc. should be provided for this purpose.
