MINUTES OVERSIGHT BOARD MEETING SPECIAL MEETING Wednesday, October 10, 2012 – 5-7 p.m. COUNCIL CHAMBER, FEW MEMORIAL HALL OF RECORDS MONTEREY, CALIFORNIA Oversight Board Members Present: Chip Rerig, Harvey Kuffner, Michael Adamson, Stephen Ma Absent: Mitchel Winick, Dave Potter and Chuck Della Sala City Staff Present: Assistant Finance Director Julie Porter, Housing and Property Manager Rick Marvin, Legal Counsel Richard Glenn, and Clerk to Board, Maria Buell. CALL TO ORDER Chair Rerig called the meeting to order at 5:00 PM. APPROVAL OF MINUTES 1. Minutes of the September 26, 2012 meeting. Legal Counsel requested a minor correction to his statement regarding General Plan and City Charter on page 4. On a motion by board member Adamson and seconded by board member Kuffner, the Minutes of September 26, 2012 were approved by the following vote: ADOPTED BY THE OVERSIGHT BOARD TO THE CITY OF MONTEREY SUCCESSOR AGENCY this 10th day of October, 2012, by the following vote: AYES: 4 MEMBERS: Rerig, Adamson, Kuffner, Ma NOES: 0 MEMBERS: None ABSENT: 3 MEMBERS: Winick, Potter, Della Sala ABSTAIN: 0 MEMBERS: None PUBLIC APPEARANCE 2. Approval and Transmittal of the Due Diligence Review for the Low and Moderate Income Housing Fund in Accordance with Health and Safety Code Section 34179.5. Staff Presentation/Board Member Questions Staff member Marvin presented the staff report and stated this was a continuation of an item from the meeting of September 26 which introduced the Due Diligence Review. Mr. Marvin indicated that according to the Rules for Adoption of the Due Diligence Review, the Review must allow at least five business days before the Oversight Board considers approval. Mr. Marvin indicated no public comment has been received. The report in today’s packet has not changed and that it is recommended to be approved. Mr. Marvin noted that the Due Diligence Review report has been sent to the Department of Finance, County Administrative Officer, and the County’s Auditor/Controller. Board Comments 1 Chair Rerig asked Mr. Marvin if he made it clear to the agencies that there is a defined period of time for their response. Staff member Marvin stated that the staff report stated clearly the 5-day public review period. Board member Adamson said that the Resolution did not include the amount of $100,209 referenced in the staff report. Mr. Marvin said that was a very good suggestion and the Resolution would be revised to ensure its inclusion. Public Comments: Chair Rerig opened discussion to members of public on this item. Having no requests to speak, Chair Rerig closed public comment. MOTION: On a motion by member Kuffner, seconded by member Adamson, the Board unanimously moved to approve, after the recommended revisions to the Resolution include the $100,209 amount, Approval and Transmittal of the Due Diligence Review for the Low and Moderate Income Housing Fund in Accordance with Health and Safety Code Section 34179.5. ADOPTED BY THE OVERSIGHT BOARD TO THE CITY OF MONTEREY SUCCESSOR AGENCY this 10th day of October, 2012, by the following vote: AYES: 4 MEMBERS: Rerig, Adamson, Ma, Kuffner NOES: 0 MEMBERS: None ABSENT: 3 MEMBERS: Winick, Potter, Della Sala ABSTAIN: 0 MEMBERS: None 3. Cancel Regular Meeting of October 24, 2012 Chair Rerig said that there are no items for the October 24 regular meeting. Mr. Marvin said that staff is working on items regarding former RDA properties but the evaluation is not complete. Board member Kuffner asked if the Board had an approved calendar and if action by Board was needed in order to do this. Legal Counsel responded that no action by the Board was needed in order to not hold the meeting. PUBLIC COMMENTS No member of the public provided input. Public Comments was closed. MEMBER COMMENTS Chair Rerig reminded Board members about the Board’s First Annual meeting being held on November 28, the week after Thanksgiving. ADJOURNMENT There being no further business, the meeting adjourned at 5:09 PM. Approval and Transmittal of the Due Diligence Review for the Low and Moderate Income Housing Fund in Accordance with Health and Safety Code Section 34179.5. (<name_dept> - <number_series>) PUBLIC COMMENTS PUBLIC COMMENTS allows you, the public, to speak for a maximum of three minutes on any subject which is within the jurisdiction of the Oversight Board and which is not on the agenda. Any person or group desiring to bring an item to the attention of the Oversight Board may do so by addressing the Oversight Board during Public Comments or by addressing a letter of explanation to: Housing and Property Management Office, 669 Van Buren St, Monterey, CA 93940. The appropriate staff person will contact the sender concerning the details. OTHER BUSINESS 3. Cancel Regular Meeting of October 24, 2012 (<name_dept> - <number_series>) BOARD MEMBER COMMENTS Board members may ask a question for clarification, make a brief announcement or make a brief report on his or her activities. In addition, the Oversight Board may provide a referral to staff or other resources for factual information, request staff to report back to the body at a subsequent meeting concerning any City matter, or direct staff to place a request to agendize a matter of business on a future agenda (G.C. 54954.2). ADJOURNMENT Members of the public have the right to address the Oversight Board on any item on the Agenda, before or during its consideration [G.C. §54954.3(a)]. The Chair will formally open the floor for public comment Wednesday, October 10, 2012 on items such as "Public Appearance" and "Public Hearings." If you wish to speak to items in any other categories, for example "Consent Agenda," please advise the Secretary to the Board or the Chair prior to the Oversight Board's action on that item, and you will be recognized. Notification as much in advance as possible is appreciated. The Oversight Board meeting packet may be reviewed by the public in the Library or the Housing and Property Management Office. Any writings or documents pertaining to an open session item provided to a majority of the Oversight Board less than 72 hours prior to the meeting, shall be made available for public inspection at the front counter of the Housing and Property Management Office, at 669 Van Buren Street, Monterey, California 93940 during normal business hours Information distributed to the Oversight Board at the meeting becomes part of the public record.
