MINUTES OVERSIGHT BOARD MEETING Wednesday, December 19, 2012 – 4-6 p.m. ORCA Conference Room 735 Pacific Street MONTEREY, CALIFORNIA Oversight Board Members Present: Chip Rerig, Mitchel Winick, Harvey Kuffner, Michael Adamson, Stephen Ma Absent: Chuck Della Sala, Dave Potter City Staff Present: Finance Director Don Rhoads, Housing and Property Manager Rick Marvin, Legal Counsel Richard Glenn, and Clerk to Board, Maria Buell. CALL TO ORDER Chair Rerig called the meeting to order at 4:04 PM. Mr. Rerig noted that Mr. Potter and Mr. Della Sala advised Chair of their absence at today’s meeting. Mr. Rerig said their absences are excused. APPROVAL OF MINUTES 1. The Minutes of the November 28, 2012 meeting were approved by the following vote: ADOPTED BY THE OVERSIGHT BOARD TO THE CITY OF MONTEREY SUCCESSOR AGENCY this 19th day of December, 2012, by the following vote: AYES: 3 MEMBERS: Rerig, Adamson, Ma NOES: 0 MEMBERS: None ABSENT: 2 MEMBERS: Della Sala, Potter ABSTAIN: 2 MEMBERS: Winick, Kuffner PUBLIC APPEARANCE 2. Receive and Review the Due Diligence Review for Non-Housing Fund and Account Balances of the former Redevelopment Agency of the City of Monterey in Accordance with Health and Safety Code section 34179.5 and Convene the Public Comment Session. Staff Presentation/Board Member Questions Finance Director Rhoads presented staff report and answered board member questions. Rhoads explained funds are available to cover the $4.4 million amount that has been identified as unobligated and available to transfer to taxing entities. It was explained the majority of the funds 1 are in reserve because the Cannery Row Redevelopment Project Area reached its tax increment cap about 2 years ago and the distributed tax increment monies have been placed in reserve. Rhoads requested Board receive the review report, convene a public comment session and authorize a special meeting for January 9, 2013 to consider approval of the review report, so that it can be sent to the State of California Department of Finance prior to the January 15, 2013 deadline. On a related matter Board member Kuffner inquired as to the status of the Board’s administrative budget and what will occur if administrative funds remain at the end of the budget year. Rhoads responded that it is anticipated that all of the funds will be spent but in the event funds remain it is expected that they will not roll-over into the next budget year. Public Comments: Chair Rerig opened discussion to members of public on this item. Having no requests to speak, Chair Rerig closed public comment. PUBLIC COMMENTS No member of the public provided input. Public Comments closed. BOARD MEMBER COMMENTS Board member Adamson wishes everyone a Happy Holidays. Chair Rerig reminded Board members of the Special meeting in January 9, 2013 to be held at the ORCA Conference Room, 735 Pacific Street, from 4-6 p.m. He urged them to contact Clerk Buell to advise if they are not going to attend. The Oversight Board must have a quorum in order to pass the important item which was presented today. ADJOURNMENT There being no further business, the meeting adjourned at 4:23 PM. You are welcome to offer your comments after being recognized by the Chair. The Oversight Board may limit the time each speaker is allocated. 2. Receive and Review the Due Diligence Review for Non-Housing Fund and Account Balances of the former Redevelopment Agency of the City of Monterey in Accordance with Health and Safety Code section 34179.5 and Convene the Public Comment Session. (<name_dept> - <number_series>) PUBLIC COMMENTS PUBLIC COMMENTS allows you, the public, to speak for a maximum of three minutes on any subject which is within the jurisdiction of the Oversight Board and which is not on the agenda. Any person or group desiring to bring an item to the attention of the Oversight Board may do so by addressing the Oversight Board during Public Comments or by addressing a letter of explanation to: Housing and Property Management Office, 669 Van Buren St, Monterey, CA 93940. The appropriate staff person will contact the sender concerning the details. BOARD MEMBER COMMENTS Board members may ask a question for clarification, make a brief announcement or make a brief report on his or her activities. In addition, the Oversight Board may provide a referral to staff or other resources for factual information, request staff to report back to the body at a subsequent meeting concerning any City matter, or direct staff to place a request to agendize a matter of business on a future agenda (G.C. 54954.2). ADJOURNMENT Members of the public have the right to address the Oversight Board on any item on the Agenda, before or during its consideration [G.C. §54954.3(a)]. The Chair will formally open the floor for public comment on items such as "Public Appearance" and "Public Hearings." If you wish to speak to items in any other categories, for example "Consent Agenda," please advise the Secretary to the Board or the Chair prior to the Oversight Board's action on that item, and you will be recognized. Notification as much in advance as possible is appreciated. Wednesday, December 19, 2012 The Oversight Board meeting packet may be reviewed by the public in the Library or the Housing and Property Management Office. Any writings or documents pertaining to an open session item provided to a majority of the Oversight Board less than 72 hours prior to the meeting, shall be made available for public inspection at the front counter of the Housing and Property Management Office, at 669 Van Buren Street, Monterey, California 93940 during normal business hours Information distributed to the Oversight Board at the meeting becomes part of the public record. A copy of written material, pictures, etc. should be provided for this purpose.
