MINUTES OVERSIGHT BOARD MEETING Wednesday, January 9, 2013 – 4-6 p.m. ORCA Conference Room 735 Pacific Street MONTEREY, CALIFORNIA Oversight Board Members Present: Chip Rerig, Harvey Kuffner, Michael Adamson, Stephen Ma, Chuck Della Sala, Dave Potter Absent: Mitchel Winick City Staff Present: Finance Director Don Rhoads, Housing and Property Manager Rick Marvin, City Attorney Christine Davi, Julie Porter, Assistant Finance Director, Legal Counsel Richard Glenn, and Clerk to Board, Maria Buell. CALL TO ORDER Chair Rerig called the meeting to order at 4:00 PM. APPROVAL OF MINUTES 1. The Minutes of the December 19, 2012 meeting were approved by the following vote: ADOPTED BY THE OVERSIGHT BOARD TO THE CITY OF MONTEREY SUCCESSOR AGENCY this 9th day of January 2013, by the following vote: AYES: 4 MEMBERS: Rerig, Adamson, Ma, Kuffner NOES: 0 MEMBERS: None ABSENT: 2 MEMBERS: Winick (Della Sala arrived after approval of Minutes) ABSTAIN: 1 MEMBERS: Potter PUBLIC APPEARANCE 2. Approving the Due Diligence Review for Non-Housing Fund and Account Balances of the Former Redevelopment Agency of the City of Monterey in Accordance with Health and Safety Code Section 34179.5 and Taking Certain other Actions in Connection Therewith Staff Presentation/Board Member Questions Finance Director Rhoads presented an update to the staff report and answered board member questions. Mr. Rhoads recommended that Board table this item. He provided the following summary: the DDR was originally submitted and staff was focused on cash and assets. The report last month reflected that focus. Upon further review it was determined Capital assets should have been included in the asset column even though capital assets are then backed out, so they have no net effect on the assets available for return to the taxing entities. At the time the DDR 1 report and agenda were prepared, the exact procedure was not clear. Mr. Rhoads recommended the Board to table approval of the DDR to allow staff time to update the DDR and include the capital assets. He also recommended the report be revised as quickly as possible and brought back to Board for approval. Board member Kuffner asked if this impacts the time schedule. Mr. Rhoads answered that the official date is January 15 and that staff will not meet the time schedule. However, he added that it is staff’s understanding at this time, that there are no penalties for submitting it late. Counsel for Board, Mr. Glenn, distributed a proposed Resolution to the Board members and staff. He recommended the Board be proactive and as a “good faith” effort adopt the proposed resolution to show DOF the Board’s intent. Mr. Glenn stated that public notice will be required prior to the Board consideration of the revised DDR. Board member Della Sala asked if the reason to have another notice is to allow staff to come up with a specific date. Mr. Rhoads said that is the reason. Staff member Marvin said that the resolution will be revised accordingly to meet Oversight Board’s requirements. Board member Kuffner asked if this resolution will be made available at the next meeting. Staff answered in the affirmative. MOTION: On a motion by Board member Della Sala, seconded by Board member Potter, the Board unanimously moved to Table the Approval of the Due Diligence Review for Non-Housing Fund and Account Balances of the Former Redevelopment Agency of the City of Monterey in Accordance with Health and Safety Code Section 34179.5 and Taking Certain other Actions in Connection Therewith and that it be scheduled for review before the Board as soon as practicable. PASSED AND ADOPTED BY THE OVERSIGHT BOARD TO THE CITY OF MONTEREY SUCCESSOR AGENCY this 9th day of January, 2013, by the following vote: AYES: 6 MEMBERS: Rerig, Della Sala, Ma, Kuffner, Adamson, Potter NOES: 0 MEMBERS: None ABSENT: 1 MEMBERS: Winick ABSTAIN: 0 MEMBERS: None Public Comments: Chair Rerig opened discussion to members of public on this item. Having no requests to speak, Chair Rerig closed public comment. PUBLIC COMMENTS No member of the public provided input. Public Comments closed. OTHER BUSINESS 3. Next meeting is scheduled on January 23, 2013 Staff member Marvin stated that the Board will have one item for review on January 23rd. BOARD MEMBER COMMENTS Chair Rerig said that a hard copy of the regular meetings scheduled for 2013 was provided to all Board members and asked that any absences be communicated to Clerk Buell. Board member Kuffner asked if staff had a Meet and Confer meeting and are these final. 2 Finance Director Rhoads said that Staff went to two: the first in November pertaining to 2 items ($1.5M and $2M); DOF agreed to $1.5 budget but not on the $2M item. Staff member Marvin said that another meet and confer is scheduled for February 4 pertaining to the housing assets. ADJOURNMENT There being no further business, the meeting adjourned at 4:14 PM. December 19, 2012 PUBLIC APPEARANCE PUBLIC APPEARANCE items are reports on non-routine issues that might stimulate public discussion, but that do not require formal noticing as public hearings. You are welcome to offer your comments after being recognized by the Chair. The Oversight Board may limit the time each speaker is allocated. 2. Approving the Due Diligence Review for Non-Housing Fund and Account Balances of the Former Redevelopment Agency of the City of Monterey in Accordance with Health and Safety Code Section 34179.5 and Taking Certain Other Actions in Connection Therewith PUBLIC COMMENTS PUBLIC COMMENTS allows you, the public, to speak for a maximum of three minutes on any subject which is within the jurisdiction of the Oversight Board and which is not on the agenda. Any person or group desiring to bring an item to the attention of the Oversight Board may do so by addressing the Oversight Board during Public Comments or by addressing a letter of explanation to: Housing and Property Management Office, 669 Van Buren St, Monterey, CA 93940. The appropriate staff person will contact the sender concerning the details. OTHER BUSINESS 3. Next meeting is scheduled on January 23, 2013 BOARD MEMBER COMMENTS Board members may ask a question for clarification, make a brief announcement or make a brief report on his or her activities. In addition, the Oversight Board may provide a referral to staff or other resources for factual information, request staff to report back to the body at a subsequent meeting concerning any City matter, or direct staff to place a request to agendize a matter of business on a future agenda (G.C. 54954.2). ADJOURNMENT Members of the public have the right to address the Oversight Board on any item on the Agenda, before or during its consideration [G.C. §54954.3(a)]. The Chair will formally open the floor for public comment Wednesday, January 9, 2013 on items such as "Public Appearance" and "Public Hearings." If you wish to speak to items in any other categories, for example "Consent Agenda," please advise the Secretary to the Board or the Chair prior to the Oversight Board's action on that item, and you will be recognized. Notification as much in advance as possible is appreciated. The Oversight Board meeting packet may be reviewed by the public in the Library or the Housing and Property Management Office. Any writings or documents pertaining to an open session item provided to a majority of the Oversight Board less than 72 hours prior to the meeting, shall be made available for public inspection at the front counter of the Housing and Property Management Office, at 669 Van Buren Street, Monterey, California 93940 during normal business hours Information distributed to the Oversight Board at the meeting becomes part of the public record.
