MINUTES OVERSIGHT BOARD ANNUAL MEETING Monday, December 1, 2014 – 7-9 p.m. COUNCIL CHAMBER, FEW MEMORIAL HALL OF RECORDS MONTEREY, CALIFORNIA Oversight Board Members: Present: Harvey Kuffner, Chip Rerig, Chuck Della Sala, Mitch Winick Absent: Dave Potter, Vicki Nakamura, Michael Adamson City Staff Present: Housing and Property Manager Rick Marvin, Assistant Finance Director, Julie Porter, Legal Counsel Alex Lorca, and Secretary to Board, Maria Buell. CALL TO ORDER Chair Kuffner called the meeting to order at 7:27 PM. APPROVAL OF MINUTES 1. The Minutes of the September 24, 2014 meeting were approved by the following vote: ADOPTED BY THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY OF THE CITY OF MONTEREY REDEVELOPMENT AGENCY this 1st day of December, 2014 by the following vote: AYES: 3 MEMBERS: Kuffner, Della Sala, Rerig NOES: 0 MEMBERS: None ABSENT: 3 MEMBERS: Adamson, Nakamura, Potter ABSTAIN: 1 MEMBERS: Winick PUBLIC APPEARANCE 2. Election of Chair and Vice Chair Staff Presentation/Board Member Questions Staff member, Marvin introduced this item and answered Board members questions. Board member Kuffner was nominated for the position of Chair and Board member Rerig was nominated for the position of Vice Chair. There were no other nominations and nominations were closed. Board member comments: Both members Kuffner and Rerig accepted the nominations for the respective officer positions on the Board. Public Comments: Chair Kuffner opened discussion to members of public on this item. Having no requests to speak, Chair Kuffner closed public comment. On a motion by Board member Winick, seconded by Board member Della Sala, the Board unanimously moved to approve the nominations. 1 ADOPTED BY THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY OF THE CITY OF MONTEREY REDEVELOPMENT AGENCY this 1st day of December, 2014 by the following vote: AYES: 4 MEMBERS: Winick, Kuffner, Della Sala, Rerig NOES: 0 MEMBERS: None ABSENT: 3 MEMBERS: Adamson, Nakamura, Potter ABSTAIN: 0 MEMBERS: None 3. Report on State Department of Finance Determination on ROPS 14-15B Staff Presentation/Board Member Questions Staff member Marvin introduced this item and answered Board members questions. Mr. Marvin said Department of Finance reduced the amount of ROPS funding available to City by 50% and that they inquired about the status of the ROPS money that has not yet been spent. Mr. Marvin said this is a reasonable determination by DOF and staff is not opposed. The reason that the money has not been spent is that it has taken more time than estimated to establish the process for completing the Monterey Hotel apartment project. Mr. Marvin advised the Board that the Successor Agency’s Long Range Property Management Plan (LRPMP) is still under review by DOF. Board member comments: Board member Winick asked if Staff could estimate the type of activity expected for Oversight Board to review in the next few months. Staff member Marvin responded that once DOF makes a determination on the LRPMP, then the only remaining task is construction of the Monterey Hotel apartments and the Board’s review will pertain to the spending down of the Monterey Hotel ROPS. Mr. Marvin said ROPS 15-16A needs to be prepared and it will be presented to Board early in 2016 for approval. Board member Winick asked if this would be presented at next Board meeting in January. Mr. Marvin responded that there might not be items needing Board approval then. Board member Winick asked, once Oversight Board completes review of the Monterey Hotel, if this would be the last item for Oversight Board to approve? Staff member Marvin stated that remaining items presented to the Oversight Board will be reporting on the LRPMP decision, monitoring Monterey Hotel apartment ROPS draw down and any future ROPS. There were no other further comments by Board members. Public Comments: Chair Kuffner opened discussion to members of public on this item. Having no requests to speak, Chair Kuffner closed public comment on this matter. PUBLIC COMMENTS No member of the public provided input. Public Comments was closed. OTHER BUSINESS None. September 24, 2014 PUBLIC COMMENTS PUBLIC COMMENTS allows you, the public, to speak for a maximum of three minutes on any subject which is within the jurisdiction of the Oversight Board and which is not on the agenda. Any person or group desiring to bring an item to the attention of the Oversight Board may do so by addressing the Oversight Board during Public Comments or by addressing a letter of explanation to: Housing and Property Management Office, 669 Van Buren St, Monterey, CA 93940. The appropriate staff person will contact the sender concerning the details. PUBLIC APPEARANCE PUBLIC APPEARANCE items are reports on non-routine issues that might stimulate public discussion, but that do not require formal noticing as public hearings. You are welcome to offer your comments after being recognized by the Chair. The Oversight Board may limit the time each speaker is allocated. 2. Election of Chair and Vice Chair 3. Report on State Department of Finance Determination on ROPS 14-15B BOARD MEMBER COMMENTS Board members may ask a question for clarification, make a brief announcement or make a brief report on his or her activities. In addition, the Oversight Board may provide a referral to staff or other resources for factual information, request staff to report back to the body at a subsequent meeting concerning any City matter, or direct staff to place a request to agendize a matter of business on a future agenda (G.C. 54954.2). ADJOURNMENT Members of the public have the right to address the Oversight Board on any item on the Agenda, before or during its consideration [G.C. §54954.3(a)]. The Chair will formally open the floor for public comment on items such as "Public Appearance" and "Public Hearings." If you wish to speak to items in any other categories, for example "Consent Agenda," please advise the Secretary to the Board or the Chair prior to the Oversight Board's action on that item, and you will be recognized. Notification as much in advance as possible is appreciated.
