Any person or group desiring to bring an item to the attention of the Planning Commission may do so by addressing the Commission during Public Comments or by addressing a letter of explanation to: Planning, Engineering, and Environmental Compliance Division (PEEC), City Hall, Monterey, CA 93940. The appropriate staff person will contact the sender concerning the details. Note: Public Comments are taken during the afternoon session and continued at the evening session. Individuals may choose to speak once for up to three minutes at either session, but not both. None. APPROVAL OF MINUTES July 27, 2010 ACTION: Approved as submitted. 4-0-2 (Abstain-Stites, Widmar) 1-(Absent-Stocker). MOTION: On a motion by Commissioner Osorio, seconded by Commissioner Garden, the Minutes of July 27, 2010 were approved as submitted. Architectural Review of exterior alterations to the front façade of an existing auto body shop in a D-2 (Design Control) Overlay District. ACTION: On consent, approved Architectural Review Application 10-155 as submitted. 6-0-1 (Absent- Stocker). MOTION: On a motion by Commissioner Garden, seconded by Commissioner Osorio, on consent it was moved to approve Architectural Review Application 10-155 as submitted. You are welcome to offer your comments after being recognized by the Chair. The Chair may limit the time allocated to each speaker. Project representation is required. 2. Revisions to Monterey Municipal Code Chapter 38, Article 25, Architectural Approval; Applicant City of Monterey; Initial Study and Negative Declaration proposed. Recommendation to City Council. Revisions to Monterey Municipal Code Chapter 38, Article 25, Architectural Approval, including changes to process, noticing, findings, and other components. ACTION: Discussed and continued to September 14, 2010 to allow time for staff to incorporate suggested revisions to Chapter 38, Article 25 Architectural Approval. 6-0-1 (absent-Stocker). Staff Presentation/Commissioners Questions: Forrest Ebbs presented the staff report and answered Commissioners’ questions. Public Comments: Barbara Bass Evans, resident of New Monterey, offered comments for some minor word changes; she said that product should come before process relating to enforcement of the General Plan, Neighborhood Plans, and Land Use Plans; she said she likes the idea of joint meetings because the same information is heard by both bodies; and, she suggested that notification be made available earlier in the process. Commissioner Comments: The Commission discussed and suggested revisions and clarifications to the ordinance as they pertain to:  Joint meetings that they “may be convened” rather than “shall be convened”; and, the Commission requested logistical consideration or the scope of how joint meetings may be run.  Applicability as it relates to “Multiple Entitlements”; clarifying required fees; and, adding language related to enforcing policies such as the Area and Neighborhood Plans.  Definitions as they pertain to major and minor projects; a more precise definition regarding “maintenance” of approved projects indefinitely; and, the exchange of alterations of landscape (i.e. from grass to gravel). Commissioner Garden moved to continue this item to September 14, 2010 to allow time for staff to incorporate changes. Commissioner Stites seconded the motion. Notice of Preparation for an Environmental Impact Report - Proposed City of Seaside Redevelopment Agency In-N-Out Burger located on Del Monte Boulevard facing Roberts Lake to the northwest and bordered by Laguna Grande Lake to the southeast. ACTION: Directed staff to forward letter to the City of Seaside as amended. 6-0-1 (absent-Stocker). Staff Presentation/Commissioners Questions: Kim Cole presented the staff report and answered Commissioners’ questions. Public Comments: None. Commissioner Comments: The Commission discussed and made recommendations to the proposed letter to the City of Seaside regarding the Notice of Preparation for the Draft Environmental Impact Report for the In-N-Out Burger Drive-Through Restaurant project. Commissioner Stites requested that the City be allowed to preview the circulation study scope of work. Commissioner McCrone said that there are issues concerning Laguna Grande Lake and this is not a good place for this project because it changes the look of the entry to Monterey. He said if the JPA has constraints they should be noted. Commissioner Widmar suggested the EIR evaluate light and noise impacts to the adjacent residential neighborhood. Commissioner Garden moved to forward the letter with suggested modifications. Commissioner Stites seconded the motion. Appointments to Subcommittees ACTION: Approved the Appointments to Subcommittees as submitted. Staff Presentation/Commissioners Questions: Kim Cole presented the staff report and answered Commissioners’ questions. Public Comments: None. Planning Commission Minutes August 10, 2010 Page 3 of 4  Commissioner Comments: The Commission discussed with a consensus to approve the appointments to subcommittees as submitted. COMMISSION COMMENTS Commissioners may ask questions for clarification, make brief announcements or make a brief report on his or her activities. In addition, the Commission may provide a referral to staff or other resources for factual information, request staff to report back to the body at a subsequent meeting concerning any City matter, or direct staff to place a request to agendize a matter of business on a future agenda (G.C. 54954.2). 5. Response to Commissioners’ Comments at the July 27, 2010, Meeting. Report received. New Comments:  Commissioner Osorio inquired about the status of the downtown committee. Mr. Rerig reported that the Mayor’s adhoc committee is meeting, staff is acting in a facilitation role, and minutes are being taken. He said that there will be a web site set up with minutes posted and staff will electronically forward the link to the Commission.  On question, Mr. Ebbs updated the Commission on the sidewalk maintenance process and said that damage by City trees or utilities are the exception to the owners’ responsibility to repair sidewalks. PLANNING, ENGINEERING, and ENVIRONMENTAL COMPLIANCE DIVISION UPDATE The Planning, Engineering & Environmental Compliance Division Update furnishes information to the Planning Commission on upcoming activities or announcements including the scheduling of future meetings, study sessions, or retreats. 6. Planning Office Update. Report received and reviewed.  Ms. Cole announced that the August 25, 2010 Joint Protocol Meeting is cancelled at this time. Staff is seeking space to accommodate interactive dialogue among participants. ADJOURNMENT There being no further business, the meeting adjourned at 5:45 P.M.
