CONSENT ITEMS On a motion by Commissioner Garden, seconded by Commissioner Osorio, and carried by the following vote, the Planning Commission approved the CONSENT ITEMS. February 22, 2011 On a motion by Commissioner Osorio, seconded by Commissioner Garden, and carried by the following vote, the Planning Commission approved the February 22, 2011 minutes. PUBLIC HEARING 4. 41 Ave Maria Road; Minor Variance Permit 11-070; Applicant Jeanne C. Byrne, Architect; Owners Ken Higashihara & Dai Dee Pun; R-1-15 Zoning District; Exempt from CEQA Requirements. Consider front yard setback variance of 1' - 3" (20' to garages, 15' to living areas required) to allow for the construction of a two-car garage and an underfloor residential addition on the site of an existing single-story, single family dwelling. The project includes development on slope greater than 25%. ACTION: Approved the requested setback variance and development on slope greater than 25% with Findings and Conditions. Staff Presentation/Commissioners Questions: Kim Cole presented the staff report and answered Commissioners’ questions. Applicant: Jeanne Byrne, Architect, said the applicant intends to relocate to the property permanently and because they own several classic cars that require regular maintenance, additional space for parking is imperative. She also said the owner intends to remove two temporary storage units that are currently on the property and has added the extra storage to provide space to move the items in the units. Public Comments: Paul E Davis said he previously owned a neighboring property and concurs that parking is an issue for the subject property. He said the proposed solution is a valid change for the property and encouraged the Commission to approve the application. Commissioner Garden said a condition should be added to preserve what will be the necessary sight line exiting the garage by backing out and he does not agree with the Traffic Engineer that two no parking signs are necessary. He said an alternative should be considered that is less invasive and could be incorporated into the landscaping. Commissioner Davis motioned to approve the requested setback Variance and development on slope greater than 25% with findings and an added condition to investigate a landscaping feature that reasonably addresses the sight line issues that does not include the addition of signage. Commissioner McCrone seconded the motion. Code Compliance Update Staff Presentation/Commissioners Questions: David Wright presented the staff report and along with Forrest Ebbs and Rick Marvin, answered Commissioners’ questions. Response to Commissioners’ Comments at the March 8, 2011 meeting. Report received. New Comments:  Commissioner Stocker said the new website is difficult to download the packets and requested the items be renamed to reflect the actual title. Ms. Cole said she would forward the comment onto the City Clerk’s office and gave a brief explanation of the intention of the changes happening with the web based procedures and welcomed the feedback.  Commissioner Garden said the presentation by the Code Compliance Coordinator clarified how the process is working. He also asked for an update on the presentation from the Parking Division regarding the current changes happening in the City.  Commissioner Osorio said there a large amount of signs all over the City and several repeat the same information. He suggested staff review the necessity of the various signs in the Downtown Area. Ms. Cole said some of the sign issues are being addressed with the work that is being done on the various specific plans. Commissioner Osorio also said there is a lot of on street parking downtown and encouraged other Planning Commissioners to walk the Downtown area. He encouraged staff to have a walk-around with the Planning Commission to look at parking in the downtown area. Ms. Cole said that there will be a three day workshop with the hired consultants to review the parking in the Downtown area on May 17-19, 2011. She suggested the Planning Commission take part in a portion of this effort and informed the Commission that they will be tasked with determining alternatives for the study.  Commissioner Davis said the citizen concerns that that are creating letters in the newspaper need to be addressed and suggested the specific plans also address social problems that are occurring in the downtown area. Ms. Cole said it would be appropriate to authorize the Chair to write a letter to the City Council addressing the items that have been brought up by the public and are outside of the Planning Commissions' jurisdiction.  Commissioner MCCrone said the appearance of the Waterfont parking lot in front of the passenger depot needs to be addressed and he is concerned because it is located in the gateway to Monterey and the first thing visitors to Monterey see. He said it needs to be cleaned up and restrictions need to be put into place. He also suggested moving the trucks and vehicles currently on the site to the property located across the street, and he would like to see the Waterfront Master Plan process move forward. He suggested the subcommittee gather to work through the projects.  Chair Widmar announced that the Mayor's meeting went very well. INFORMATIONAL REPORTS & STAFF COMMENTS 7. Planning Office Update. Planning Commission Meeting Minutes Tuesday, April 12, 2011 4 Planning Commission Minutes Tuesday, April 12, 2011  After a discussion regarding the Planning Office schedule, Ms. Cole informed the Commission she would bring the schedule back to the Commission every month to inform the Commission of the status of the Planning Office projects. Members of the public have the right to address the Commission on any Agenda items. The Chair will formally open the floor for public comment.
