MINUTES PLANNING COMMISSION Tuesday, October 28, 2014 4:00 pm - 5:30 pm 7:00 pm - 11:00 pm 580 PACIFIC STREET, COUNCIL CHAMBERS MONTEREY, CALIFORNIA Commissioners Present: Osorio, Davis, Garden, Stocker, Reed, Widmar Commissioners Absent: McCrone Staff Members Present: Principal Planner Kimberly Cole, Senior Planner Christine Hopper CALL TO ORDER Vice Chair Osorio called the meeting to order at 4:02 pm. CONSENT ITEMS Commissioner Stocker made a motion to approve the Consent Agenda. Commissioner Davis seconded the motion. Ms. Cole recommended item #2 be pulled from the Consent Agenda to allow interested members of the public to speak. Commissioner Stocker amended his motion to approve items #1 and #3 on the Consent Agenda. Commissioner Davis maintained his second. On a motion by Commissioner Stocker, seconded by Commissioner Davis and carried by the following vote, the Planning Commission approved items #1 and item # 3 be approved on the consent agenda . AYES: 6 COMMISSIONERS: Osorio, Davis, Garden, Stocker, Reed, Widmar NOES: 0 COMMISSIONERS: None ABSENT: 1 COMMISSIONERS: McCrone ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None Approval of Minutes 1. October 14, 2014 ACTION: Approved with amendments. Commissioner Osorio requested that the following language be added to his comments: "Commissioner Osorio requested that Principal Planner Cole follow up on Code Compliance issues regarding Mickey Mouse at the Custom House Plaza." Commissioner Widmar abstained from the vote on the minutes due to his absence at the October 14, 2014 meeting. Planning Commission Minutes Tuesday, October 28, 2014 Other Consent Items 2. Consider City of Monterey Wharf II Repairs and Parking Upgrades and Monterey Water Front Area Repair and Maintenance Project Mitigated Negative Declaration; Applicant/Owner City of Monterey ACTION: Adopted a a Resolution certifying the Mitigated Negative Declaration for the Wharf II Repairs and Parking Upgrades and Monterey Water Front Area Repair and Maintenance Project with amendments. Staff Presentation: Kimberly Cole presented the Agenda Report and answered Commissioners' questions. Public Comment: Tony Lombardo, representing Fisherman's Wharf Company, asked staff if a similar five year plan for Wharf #1 would be created and when such a plan would be coming forward. Committee Member Comments: Norman Green, City Surveyor, said CIP has not approved any funds to repair Wharf #1. Commissioner Osorio requested the Initial Study be amended to state "Coastal Commission Review" under the project permit heading and recommended that the resolution be altered to state: "WHEREAS, at its regular meeting of October 28, 2014, the Planning Commission reviewed and considered the proposed Mitigated Negative Declaration together with comments received during the public review process and finds on the basis of the whole record before it (including the initial study and any comments received), with the implementation of the proposed mitigation measures that there is no substantial evidence that the project will have a significant effect on the environment and that the mitigated negative declaration reflects the lead agency’s independent judgment and analysis;" Commissioner Davis made a motion to adopt a Resolution certifying the Mitigated Negative Declaration for the Wharf II Repairs and Parking Upgrades and Monterey Water Front Area Repair and Maintenance Project with amendments. Commissioner Reed seconded the motion. On a motion by Commissioner Davis, seconded by Commissioner Reed, and carried by the following vote, the Planning Commission Adopted a a Resolution certifying the Mitigated Negative Declaration for the Wharf II Repairs and Parking Upgrades and Monterey Water Front Area Repair and Maintenance Project with amendments. Continue 315 Calle Principal to the November 12, 2014 Meeting; Use Permit 14-367 for Food and Beverage Sales Including a Type 21 Liquor License; Applicant Rodney J. Riggs; Owner JMDJ Co.;Planned Community Downtown PC-D; Exempt from CEQA Requirements ACTION: Continued to the November 12, 2014 Planning Commission meeting. ***End of Consent Agenda*** PUBLIC COMMENTS None. PUBLIC HEARING Commissioner Stocker excused himself from the meeting due to illness. 4. Consider 449 Calle Principal; Minor Subdivision 14-405 and Use Permit 13-528 for Off-Street Parking within the Alvarado District for a New Three-Story Mixed Use Building with 1,361 Square Feet of Retail Space and 18 Apartment Units; Applicant Henry Ruhnke for Wald, Ruhnke and Dost Architects; Owner Anthony Davi, Sr.; PC-D Zoning District; Exempt from CEQA ACTION: Adopted Resolutions approving a Minor Subdivision for a Vesting Tentative Parcel Map; approving a Use Permit for Off-Street Parking within the Alvarado District of the Downtown Specific Plan; and adopting a Finding of No Further Review (for Infill Development). Staff Presentation/Committee Member Comments: Christine Hopper presented the Agenda Report and answered Commissioners' questions. Applicant: Peter Silva, WRD, said Mr. Davi is interested in revitalizing the Downtown Area and has a commitment to high quality projects. He encouraged the Commission to approved the project. Anthony Davi Sr. said this will be a great addition to the Downtown Area. Public Comment: None. Committee Member Comments: Commissioner Reed said he is in support of the project. Discussion on CEQA Findings Ms. Cole said one of the City's prime responsibilities is to reveal the environmental impact of a project to the public and decision makers. Legal staff has advised that the environmental determinations remain prominent in the Staff Report and Resolutions. Commissioner Osorio said the Resolutions must be thorough and clear without being too repetitive. COMMISSIONERS COMMENTS Commissioner Garden said the Lighthouse Specific Plan Community Meetings were held on October 22 and October 24, 2014. He said the subcommittee will meet soon. INFORMATIONAL REPORTS & STAFF COMMENTS 6. Planning Office Update  Report received.  The Commission discussed holding a meeting on November 13, 2014. ADJOURNMENT The meeting adjourned at 4:46 pm. Planning Office Update ADJOURNMENT ADJOURNMENT — The general policy of the Planning Commission is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Commission, or continued to the next regularly scheduled Planning Commission Meeting, or continued to a Special Meeting. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Commission on any Agenda items. The Chair will formally open the floor for public comment. However, if you wish to speak to items during "Consent Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that item and you will be recognized. Notification as much in advance as possible is appreciated. Information distributed to the Commission at the meeting becomes part of the public record. A copy of written material, pictures, etc. should be provided to the Secretary for this purpose. Planning Commission decisions may be appealed within ten (10) days from the date of the decision on forms available in the Planning Division during business hours. When the tenth day falls on a weekend or a holiday, the appeal deadline date is the next working day following the holiday or weekend. An appeal fee will apply.
