MINUTES PLANNING COMMISSION Tuesday, August 25, 2015 Joint Session with ARC and HPC , MONTEREY, CALIFORNIA Commissioners Present: Davis, Garden, Reed, Widmar Commissioners Absent: McCrone, Osorio, Stocker Staff Members Present: Principal Planner Cole, Senior Associate Planner Bennett, Senior Associate Planner Hopper, Code Compliance Coordinator Wright FIELD TRIP The Planning Commission, Historic Preservation Commission, and Architectural Review Committee will not be conducting a field trip on Monday, August 24, 2015. For more information, please call (831) 646-3886. Date Posted: August 21, 2015 CALL TO ORDER Vice-Chair Reed called the meeting to order at 5:03 pm. PUBLIC COMMENTS Sherna Stuart concerned about the streetscape plan within the City of Monterey. She said she is concerned about the fact that the trees are all water-intensive; require a lot of sun; and the overplanting of deciduous trees. She went on to say she would like this issue put on the Agenda as part of an upcoming meeting. PUBLIC APPEARANCE Staff Presentation/Commissioner Questions Dino Pick, Deputy City Manager of Plans and Public Works welcomed the new committee/commission members on behalf of upper management. Kim Cole and Chrissy Davi gave presentation and took committee/commission member questions. Commissioner/Committee Member Comments Brown Act Training Committee Member Terry Latasa asked about a majority of members versus a quorum Planning Commission Minutes Tuesday, August 25, 2015 and how many people constitute a quorum. City Attorney Chrissy Davi said four is the quorum for ARC. Principal Planner Kim Cole said there are times when a meeting starts with enough members for a quorum but due to conflicts of interests we may end with only 3 members to vote on an item. Ms. Davi said there are different rules for nonparticipation due to disqualification versus nonparticipation due to abstention as to whether or not the remaining members constitute a quorum and advises to call the City Attorney’s office prior to the meeting. Committee Member Latash asked if four was the magic number to constitute a quorum. Ms. Davi said four is the magic number but if you are at social function with three other members it is not advisable to have conversations with the other members regarding any items, just to be safe. Fair Political Practices Commission (FPPC) Committee Member Sandra Freeman asked what is the FPPC with regards to the Political Reform Act. Ms. Davi said the FPPC is the Fair Political Practices Commission. Committee Member Charles Kimzey asked if there is a limit regarding the 500ft rule. Ms. Davi said there is not limit. California Environmental Quality Act (CEQA) Commissioner Garden asked what boards/commissions within the city are able to certify environmental analysis documents. Ms. Cole said based on the local CEQA guidelines, the Planning Commission and the City Council can certify Negative Declarations or the more extensive Environmental Vice-Chair Hansen Reed said we don’t normally address the CEQA language in the motion but is that something that should be happening. Ms. Davi said it should be ok if it is in the draft but if there are concerns regarding a CEQA issue then it should be discussed. Petty asked if he misplaced his copy of Agenda can he cal staff. Davi said that should be ok but anything further should go thru COA or COM Smith-Crivello said she is unsure about communications and when she should or should not contact COA or COM. Davi said mostly anything of substance. Garden asked about Robers ruls or Rosenberg rules; every adopted. No “rules” has been adopted. Davi gave order of meetings and the way it should take place. You are suppose to listen to the public comment before making a decision. We weill look to the Chair for direction. Garden asked if the Agenda is supposed to be prepared by the Chair/Vice Chair or is that done by staff Garden said if the Agenda is discussed with the Staff is that allowable. Davi said that is acceptable Kimzey said what is the appropertie action when a letter is addressed Davi said it should be given to staff for distribution and a courtesy response would be ok not an obligation. 1. At this time, the public may speak for a maximum of three minutes on any subject which is within the jurisdiction of the Monterey Planning Commission and which is not on the agenda. Any person or group desiring to bring an item to the attention of the Commission may do so during Public Comments or by addressing a letter of explanation to the Commission, City Hall, Monterey, CA 93940. Public Comments are taken during the afternoon session and continued at the evening session. Individuals may choose to speak once for up to three minutes at either session, but not both. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Commission on any Agenda items. The Chair will formally open the floor for public comment. However, if you wish to speak to items during "Consent Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that item and you will be recognized. Notification as much in advance as possible is appreciated. Information distributed to the Commission at the meeting becomes part of the public record. A copy of written material, pictures, etc. should be provided to the Secretary for this purpose. Planning Commission decisions may be appealed within ten (10) days from the date of the decision on forms available in the Planning Division during business hours. When the tenth day falls on a weekend or a holiday, the appeal deadline date is the next working day following the holiday or weekend. An appeal fee will apply.
