MINUTES PLANNING COMMISSION Tuesday, October 25, 2016 4:00 p.m. AFTERNOON SESSION ONLY 580 PACIFIC STREET, COUNCIL CHAMBERS MONTEREY, CALIFORNIA Commissioners Present: Fletcher, Millich, Davis, Dawson, Latasa, Reed, Widmar Commissioners Absent: None Staff Members Present: Chief of Planning, Engineering & Environmental Compliance Cole, Senior Planner Hopper, Recording Secretary Leinen CALL TO ORDER Chair Fletcher called the meeting to order at 4:00 p.m. CONSENT ITEMS Commissioner Reed made a motion to approve the Consent Items. Commissioner Dawson seconded the motion. Commissioner Latasa abstained from voting due to his absence from the October 11, 2016 meeting. On a motion by Commissioner Reed, seconded by Commissioner Dawson, and carried by the following vote, the Planning Commission approved the CONSENT ITEMS: AYES: 6 COMMISSIONERS: Fletcher, Millich, Davis, Dawson, Reed, Widmar NOES: 0 COMMISSIONERS: None ABSENT: 0 COMMISSIONERS: None ABSTAIN: 1 COMMISSIONERS: Latasa RECUSED: 0 COMMISSIONERS: None Approval of Minutes 1. October 11, 2016 ACTION: Approved as submitted. Other Consent Items 2. Approve 449 Calle Principal; Permit 16-414 to Extend Minor Subdivision 14-405 and Use Permit 13-528 for Off-Street Parking within the Alvarado District for a New Three-Story Mixed Use Building with 1,361 Square Feet of Retail Space and 18 Apartment Units; Applicant Henry Ruhnke for Wald, Ruhnke and Dost Architects; Owner Anthony Davi, Sr.; PC-D Zoning District; Exempt from CEQA Requirements per Section 15183.5 ACTION: Adopted a resolution approving a two-year extension of Use Permit 13-528 for 449 Calle Principal. ***End of Consent Agenda*** PUBLIC COMMENTS Lorna Moffat thanked the Planning Commission for their stance against Verizon’s request to Planning Commission Minutes Tuesday, October 25, 2016 place a cell tower in a scenic easement next to the SPCA and said allowing it would be precedent setting. Ms. Moffat expressed concern regarding a lack of governmental protection for citizens against the negative effects of cell towers. She said citizens need to educate and protect themselves and recommended the book “Cell Phones: Invisible Hazards in the Wireless Age,” by Dr. George Carlo. Kimberly Cole clarified that the proposed Verizon tower Ms. Moffat spoke of is within the jurisdiction of Monterey County. PUBLIC HEARING 3. Recommend City Council Approve 1250 Seventh Street; HP Application 16-353 for H-2 (City Historic Resource) Historic Overlay Zoning; Applicant/Owner Malcolm Jack and Kyoko Ikemoto; R-3-6 Zoning District; Exempt from CEQA Requirements per Section 15305, Class 5 ACTION: Adopted a resolution recommending that the City Council adopt an ordinance rezoning the property as a City Historic Resource from R-3-6 to R-3-6-H-2. Staff Presentation/Commissioner Questions Christy Hopper presented the Agenda Report and answered Commissioners’ questions. Applicant No applicant present. Public Comments None. Commissioner Comments Commissioner Widmar made a motion to adopt a resolution recommending that the City Council adopt an ordinance rezoning the property as a City Historic Resource from R-3-6 to R- 3-6-H-2. Commissioner Dawson seconded the motion. On a motion by Commissioner Widmar, seconded by Commissioner Dawson, and carried by the following vote, the Planning Commission Adopted a resolution recommending that the City Council adopt an ordinance rezoning the property as a City Historic Resource from R-3-6 to R- 3-6-H-2: AYES: 7 COMMISSIONERS: Fletcher, Millich, Davis, Dawson, Latasa, Reed, Widmar NOES: 0 COMMISSIONERS: None ABSENT: 0 COMMISSIONERS: None ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None In response to Vice Chair Millich’s question, Ms. Hopper said the lot size in the Oak Grove neighborhood is generally 40 feet by 100 feet and that once the property is rezoned, modifications would require a historic permit. COMMISSIONERS COMMENTS None. Planning Commission Meeting Minutes Tuesday, October 25, 2016 2 Planning Commission Minutes Tuesday, October 25, 2016 INFORMATIONAL REPORTS & STAFF COMMENTS 4. Planning Office Update  Update received.  Ms. Cole said the City Council reviewed the proposed Emergency Shelter Overlay Zoning at their October 18, 2016 meeting and continued the item to allow for additional outreach. She said staff would like to hold a community workshop hosted by the Planning Commission on November 29, 2016 at 7:00 p.m.  In response to Commissioners’ questions, Ms. Cole said at their October 18, 2016 meeting, the City Council overturned the Planning Commission’s approval of the appeal of a new cellular facility in the right-of-way near 860 Wave Street. She said the Council struggled with their decision and that Crown Castle presented additional arguments regarding compliance with State laws. Planning Office Update ADJOURNMENT ADJOURNMENT — The general policy of the Planning Commission is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Commission, or continued to the next regularly scheduled Planning Commission Meeting, or continued to a Special Meeting. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Commission on any Agenda items. The Chair will formally open the floor for public comment. However, if you wish to speak to items during "Consent Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that item and you will be recognized. Notification as much in advance as possible is appreciated. Information distributed to the Commission at the meeting becomes part of the public record. A copy of written material, pictures, etc. should be provided to the Secretary for this purpose. Planning Commission decisions may be appealed within ten (10) days from the date of the decision on forms available in the Planning Division during business hours. When the tenth day falls on a weekend or a holiday, the appeal deadline date is the next working day following the holiday or weekend. An appeal fee will apply.
