MINUTES PLANNING COMMISSION Tuesday, September 11, 2018 4:00 P.M. AFTERNOON SESSION ONLY FEW MEMORIAL HALL OF RECORDS COUNCIL CHAMBERS 580 PACIFIC STREET MONTEREY, CALIFORNIA Commissioners Present: Dawson, Latasa, Fletcher, Millich, Reed Commissioners Absent: Brassfield Staff Members Present: Community Development Director Cole, Housing and Community Development Manager Caraker, Recording Secretary Leinen CALL TO ORDER Chair Dawson called the meeting to order at 4:00 p.m. CONSENT ITEMS Approval of Minutes 1. August 28, 2018 ACTION: Approved as submitted. Vice Chair Latasa made a motion to approve the minutes. Commissioner Fletcher seconded the motion. On a motion by Commissioner Latasa, seconded by Commissioner Fletcher, and carried by the following vote, the Planning Commission approved the minutes: AYES: 5 COMMISSIONERS: Dawson, Latasa, Fletcher, Millich, Reed NOES: 0 COMMISSIONERS: None ABSENT: 1 COMMISSIONERS: Brassfield ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None ***End of Consent Agenda*** PUBLIC COMMENTS None. PUBLIC HEARING Elizabeth Caraker requested that item #3 be heard before item #2 to determine if the Planning Commission would entertain a reconsideration of its decision. Commissioner Millich said he would like to move forward with adoption of denial findings as there is nothing to reconsider until findings are adopted. The Commission discussed staff’s request and Vice Chair Latasa made a motion to hear item #3 of the agenda before item #2. Commissioner Reed seconded the motion. Planning Commission Minutes Tuesday, September 11, 2018 On a motion by Commissioner Latasa, seconded by Commissioner Reed, and carried by the following vote, the Planning Commission moved to hear item #3 of the agenda before item #2: AYES: 4 COMMISSIONERS: Dawson, Latasa, Fletcher, Reed NOES: 1 COMMISSIONERS: Millich ABSENT: 1 COMMISSIONERS: Brassfield ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None (Heard after item #3) 2. Adopt Findings for Denial for 300 Cannery Row and 258/270 Foam Street, Use Permit Amendment 18-0241 Amending Resolution P18-003 Approving Use Permits 09-142 and 17-0128 for a Mixed Use Project That Spans Two Sites to Eliminate Condition of Approval #2 Requiring a Cannery Row Coastal Land Use Plan Amendment and Finding the Project Consistent with the Cannery Row Coastal Land Use Plan; Applicant and Owner: 300 LLC; Zoning: Cannery Row Commercial and Planned Community - Lighthouse; General Plan: Commercial; CEQA: Mitigated Negative Declaration Adopted ACTION: Continued to September 25, 2018. Staff Presentation/Commissioner Questions Ms. Caraker recommended that the item be continued to the September 25, 2018 meeting. Applicant Applicant was present but did not address the Commission. Public Comments None. Commissioner Comments Commissioner Reed made a motion to continue the item to September 25, 2018. Vice Chair Latasa seconded the motion. Staff Presentation/Commissioner Questions Ms. Caraker presented the Agenda Report and answered Commissioners’ questions. Applicant Paul E. Davis, representing applicant, said he is happy to answer any questions of the Commission. Public Comments None. Commissioner Comments Chair Dawson said he learned after the Commission made their decision that attorney Anthony Lombardo and Ms. Caraker had met with Coastal Commission staff to discuss the proposed splitting of density between the Cannery Row and Foam Street sites. In light of this additional information not heard at the prior meeting, he said, it would be a good idea to reconsider the decision. Ms. Caraker explained the process of a reconsideration hearing and answered Commissioners’ questions. Commissioner Millich said that the new information should be discussed at the present meeting and not continued to the next meeting since the reconsideration is based on the new information. Ms. Caraker provided additional clarification and said she will provide a report of the conversation with the Coastal Commission and that Mr. Lombardo can be present at the next meeting. Commissioner Reed made a motion to approve the request for a reconsideration hearing to be heard September 25, 2018. Commissioner Millich seconded the motion. On a motion by Commissioner Reed, seconded by Commissioner Millich, and carried by the following vote, the Planning Commission approved request for a reconsideration hearing to be heard September 25, 2018: AYES: 5 COMMISSIONERS: Dawson, Latasa, Fletcher, Millich, Reed NOES: 0 COMMISSIONERS: None ABSENT: 1 COMMISSIONERS: Brassfield ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None Vice Chair Latasa said he supports the motion due to the new information that will be brought forward. COMMISSIONERS COMMENTS Chair Dawson said the grand opening and ribbon cutting for the Cooper Molera Adobe will be held today from 4:00 p.m. – 7:00 p.m. and he already had a chance to view the Cooper Molera Adobe and was very impressed. Planning Office Update  Report received.  Kim Cole gave an update regarding the Wireless Subcommittee and answered Commissioners’ questions. She said in response to the recent shot clock reduction for wireless applications from 150 to 60 days, the Planning Commission and City Council will review an expedited ordinance that she hopes will become law in November. Planning Office Update ADJOURNMENT ADJOURNMENT — The general policy of the Planning Commission is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Commission, or continued to the next regularly scheduled Planning Commission Meeting, or continued to a Special Meeting. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Commission on any Agenda items. The Chair will formally open the floor for public comment. However, if you wish to speak to items during "Consent Agenda" or "Staff Informational Report," please advise the staff or the Chair prior to the action on that item and you will be recognized. Notification as much in advance as possible is appreciated. Information distributed to the Commission at the meeting becomes part of the public record. A copy of written material, pictures, etc. should be provided to the Secretary for this purpose. Planning Commission decisions may be appealed within ten (10) days from the date of the decision on forms available in the Planning Division during business hours. When the tenth day falls on a weekend or a holiday, the appeal deadline date is the next working day following the holiday or weekend. An appeal fee will apply.
