February 23, 2021 ACTION: Approved as submitted. On a motion by Commissioner Dawson, seconded by Commissioner Millich, and carried by the following vote, the Planning Commission approved the February 23, 2021 Minutes as submitted: AYES: 4 COMMISSIONERS: Brassfield, Freeman, Dawson, Millich NOES: 0 COMMISSIONERS: None ABSENT: 2 COMMISSIONERS: Fletcher, Latasa ABSTAIN: 1 COMMISSIONERS: Reed RECUSED: 0 COMMISSIONERS: None ***End of Consent Agenda*** Recording Secretary Ziel provided information to the public on how to participate and provide public comment during the meeting. PUBLIC COMMENTS Tony Tollner commented on the Monterey Peninsula School District (MPUSD) draft Environmental Impact Report (EIR), emphasizing issues with potential light pollution and traffic issues, and event use. Mr. Tollner encouraged the Planning Commission (PC) to hold MPUSD to the same standards in maintaining the Monterey character. Consider 167 Davis Lane; Use Permit Application UP-20-0158 to Allow a Mixed-use Project – One Residential Unit and Commercial Office Space; Applicant and Owner William Khieu and Juliette Le; CO-ES Zoning District; Commercial General Plan Land Use Designation; Exempt from CEQA per Article 19, Section 15301, Class 1 ACTION: Approved as submitted. Staff Presentation/Commissioner Questions Interim Principal Planner Roveri presented the Agenda Report and answered Commissioner questions. Commissioner Reed asked if the office space would qualify as an ADU. Community Development Director Cole explained the State Zoning Law allows ADUs on single-family, multi-family, and mixed-use sites, and ADUs are approved ministerially in the Building and Safety division but applicants must prove they have adequate water credits for the proposed change in use. Commissioner Reed inquired about the process. Ms. Cole clarified all ADU and JADU applicants must submit to the Building Division. The proposed use is not an ADU because it is not secondary to another residential use. Vice Chair Freeman asked if the owner proposes to use the back parking lot for both commercial and residential parking. Ms. Roveri explained the property owner proposes four spaces for office and two for residential, all located off Davis Lane. Applicant Jack Paquin, general contractor representing the applicant, stated parking already exists and the plan is for residential parking on one side and commercial parking on the other. Chair Brassfield asked where the residential entrance would be located. Mr. Paquin explained it would be at the main entrance near the kitchen. Public Comments Commissioner Reed read a comment from Jan Burns asking where the carport will be located. Mr. Paquin explained the carport will be to the far right of the parking area. Commissioner Comments Commissioner Reed spoke in support of the proposal. Commissioner Dawson agreed, explaining the area contains many existing residential and commercial uses. Chair Brassfield also spoke in support of the project. Discuss Draft Circulation Element and Provide Input (Exempt from CEQA per Article 19, Section 15306, Class 6) ACTION: Item heard and discussed. Staff Presentation/Commissioner Questions Community Development Director Cole explained State regulations have changed regarding evaluation of circulation impacts and City ordinances are following to comply with State law. Interim Principal Planner Roveri presented the Agenda Report and answered Commissioner questions. Commissioner Dawson made the following suggestions:  Regarding paragraph four of the Agenda Report: Land Use Policy a.7 does not support non-aviation uses within the Airport District. The District is not part of Monterey and might be unaffected by City policy.  Regarding Policy a.11 and e.7 for future rail service: the projected path for rail service may not be wide enough to support a railroad.  In Goal h, at “zero collisions, involving fatal injuries”: remove comma for clarity.  Regarding packet page 38: involve airport district in discussions. Chair Brassfield asked the following questions:  Regarding Vehicle Miles Travelled (VMT), are number of employees and their methods of transportation now being tracked? Kimley-Horn Vice President Frederik Venter explained VMT per employee is predicted then calculated to estimate overall VMT, and mitigation of VMT impact could potentially be focused on employees.  How can cars and busses be reduced in Monterey? Has the Fort Ord track adjacent to the Recreation Trail been examined as a potential transportation hub into the Peninsula? City Traffic Engineer Renny explained that Monterey/Salinas Transit (MST) is working with the Transportation Agency of Monterey County (TAMC) to provide a bus system, called the Surfline, that would begin in Marina. Ms. Cole showed a video of the TAMC Surfline route from mst.org as Mr. Venter provided details. Commissioner Millich asked if the plan was coordinated with sea water intrusion. Mr. Venter suggested it was.  If existing parking areas disappear to allow for more traffic lanes, where will those cars park? The Chair shared concern for safety in widening roadways while increasing bicycle and pedestrian activity. Public Comments None. Commissioner Comments Commissioner Reed noted a significant increase in amount of bicycles on the Recreation Trail. The Commissioner suggested that if a safer system is created, bicycle use could increase. Commissioner Millich stated the plan has good suggestions but many problems must be solved prior to implementation. Chair Brassfield asked for clarification regarding Policy i.15. Ms. Roveri explained Policy i.15 is part of the Environment, Equity, & Economy chapter, which prioritizes projects that increase mobility options for disadvantaged persons and create a more equitable transportation network. Ms. Cole explained the State of California has changed General Plan law to require cities address issues of Environmental Justice. INFORMATIONAL REPORTS & STAFF COMMENTS Update received. COMMISSIONER COMMENTS Regarding MPUSD’s draft EIR, Vice Chair Freeman requested City Attorney Davi attend a PC meeting to explain why the PC has no authority over school district property. Commissioner Millich asked if the same can be done with other local districts, such as airport and water. Chair Brassfield asked about wireless facility ordinances.
