PUBLIC COMMENTS None. ***End of Consent Agenda*** PUBLIC APPEARANCE 5. Consider Addendum to the Mitigated Negative Declaration for the Garden Road Zone Amendment (2300 Garden Road) ACTION: Adopted a Resolution certifying the California Environmental Quality Act Addendum to the Mitigated Negative Declaration for the Garden Road Zone Amendment at 2300 Garden Road, with findings as stated in the Agenda Report and amended Mitigation Monitoring Chart to reference the known contamination site Staff Presentation/Commissioner Questions Community Development Director Cole presented the Agenda Report and answered Commissioner questions. Commissioner Millich addressed a typo on page 73, Mitigation Measure 5, of the Agenda Packet. Ms. Cole suggested amending “the project site is a substantial distance from the project contamination site” to “the project site is a substantial distance from the known contamination site”. Ms. Cole stated three projects on Garden Road were submitted and will be reviewed by the Architectural Review Committee (ARC), however two sites meet CEQA exemptions while this site is not exempt. Commissioner Dawson inquired about Vehicle Miles Traveled (VMT). Ms. Cole indicated that the Traffic Consultant prepared a VMT analysis showing a net decrease in trips. Commissioner Latasa asked what changed from the Negative Declaration. Ms. Cole explained nothing has changed but the addendum was required to evaluate the project and document differences in the CEQA checklist that have occurred since the initial approval. Commissioner Brassfield inquired about the total resident count and if children would live onsite. Ms. Cole responded that the project could include varying household sizes. Commissioner Brassfield asked about the school district, showing concern for bus traffic. Ms. Cole explained the school district collects a per-unit development impact fee. Commissioner Brassfield asked if potential flood hazard areas have been identified. Ms. Cole suggested Plan Sheet C-1 shows mitigation measures and conditions of approval pending ARC review. Commissioner Brassfield shared concerns regarding noise impacts from proximity to the airport and asked about windowpane requirements. Ms. Cole suggested there is not a window pane requirement but windows must reach a threshold of noise protection (rating). Commissioner Brassfield asked who will pay for the proposed bridge. Ms. Cole stated the Transportation Agency of Monterey County (TAMC) charges per-unit development impact fees for housing, added that mitigation measures are not required when rezoning improves the situation, and specified a bridge is not required. Commissioner Millich mentioned the Agenda Report uses Level of Service (LOS) but should refer to VMT. Ms. Cole explained the attachment was added before the switch to VMT but the memo attached to the addendum shows the conversion was made and no significant impacts were found. Applicant Comments Chair Freeman asked the applicant what “home-based work only” means in the traffic report. Applicant Consultant Ron Sissem specified the “trip” approach was used to measure VMT as residential units are the origin of trips taken. Chair Freeman requested clarification. Mr. Sissem suggested remote working may not have been accounted for and stated the worst case would be if all residents travel from home to different destinations for employment. Public Comments None. Commissioner Comments Commissioner Latasa commended staff for making sure the environmental documents are ironclad and asked if affordable housing will be included. Ms. Cole explained the City Code specifies that each project is required to provide 20 percent affordable housing. Commissioner Millich motioned to approve the addendum with findings included in the Agenda Report. Commissioner Dawson seconded the motion. Ms. Cole reiterated a suggested amendment to the Mitigation Monitoring Chart clarifying that the project site is a substantial distance from the known contamination site, and requested it be included in the approval. Commissioner Millich approved the addition to the motion and Commissioner Dawson agreed. Commissioner Brassfield asked if changes were made to the parking requirements. Ms. Cole explained this was a new zoning district with its own parking requirements and parking does comply. On a motion by Commissioner Millich, seconded by Commissioner Dawson and carried by the following vote, the Planning Commission adopted a resolution certifying the California Environmental Quality Act Addendum to the Mitigated Negative Declaration for the Garden Road Zone Amendment at 2300 Garden Road, with findings as stated in the Agenda Report and amended Mitigation Monitoring Chart to reference the known contamination site: AYES: 5 COMMISSIONERS: Freeman, Reed, Dawson, Latasa, Millich NOES: 1 COMMISSIONERS: Brassfield ABSENT: 1 COMMISSIONERS: Fletcher ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None INFORMATIONAL REPORTS & STAFF COMMENTS Update received. COMMISSIONER COMMENTS Commissioner Latasa asked if any new Garden Road apartments are 100 percent affordable. Ms. Cole explained that 20 percent are affordable but the proposed number of units was lowered due to the Cease-and-Desist order. Commissioner Millich shared concerns for the State taking punitive action because of the Cease- and-Desist order and lack of water credits to provide for housing. Chair Freeman inquired about a project at 2101 North Fremont Street. Ms. Cole explained the City Council tabled the item to allow Staff to review and respond to a newly submitted noise study. Chair Freeman announced Commissioner Latasa had written a letter to City Manager Uslar to open investigations on sea level rise. Commissioner Latasa stated the letter asked for increased Staffing to measure and research eminent sea rise and mitigation. Chair Freeman suggested the goal is to find available options and economic cost or impact.
