Brown Act, Calif. Government Code section 54953(e)(1)(C) and the Monterey City Council’s resolution authorizing virtual participation in public meetings given the COVID-19 pandemic. CALL TO ORDER Chair Freeman called the meeting to order at 4:00 p.m. and Recording Secretary Cleary explained to the public how to participate and provide public comment during the meeting. 1. Meeting Procedures CONSENT ITEMS Approval of Minutes 2. June 14, 2022 ACTION: Approved as submitted. Consider 95 Prescott Avenue; Use Permit Application UP-22-0079 to Allow Commercial Recreation and Entertainment; Applicant Bella Avery; Property Owner The Cannery Row Company, L.P., Vince Balestreri as Authorized Agent; C-2 Zoning District (Community Commercial District); Commercial General Plan Designation; Exempt from CEQA Requirements per Article 19, Section 15301, Class 1 ACTION: Approved Use Permit application UP-22-0079 to allow commercial recreation and entertainment use at 95 Prescott Avenue pursuant to Conditions and Findings presented in the Agenda Report with an added Condition of Approval to edit Exhibit A to properly address the name of the company Staff Presentation/Commissioner Questions Associate Planner Buggert presented the Agenda Report and answered Commissioner questions. Community Development Director Cole was also present to answer Commissioner questions. Commissioner Brassfield asked if recording capability is required. Mr. Buggert specified security recordings are required to be retained onsite for three days. Commissioner Latasa and Chair Freeman inquired about approval and alcohol license requirements. Ms. Cole and Mr. Buggert provided details. Applicant Craig Watts and Jesse Ledin were present to answer questions on behalf of the project. Commissioner Brassfield asked about video surveillance. Craig Watts mentioned all entrances, bar areas, main areas, offices, and liquor storage would be under video surveillance. Commissioner Latasa pointed out a mislabel on the architectural drawings and asked which companies are involved in the project. Jesse Ledin suggested that could be fixed and explained the business name is Tipsy Putt LLC, which owns Flatstick Pub in Sacramento and Tahoe, and specified the Monterey location would be named Tipsy Putt. Chair Freeman asked how many mini golf holes there would be. Mr. Watts explained the site would have 19 holes spanning two courses. Commissioner Millich asked if there are restrooms on each level. Mr. Watts explained the top level and basement each have restrooms and there is an elevator that accesses each floor. Mr. Watts provided more information regarding the business and efforts to support local entities. Public Comments None. Commissioner Comments Commissioner Latasa spoke in support of the project. Commissioner Millich agreed. Mr. Buggert explained a Planning permit is necessary for new signs to be installed. Commissioner Brassfield and Chair Freemen agreed with Commissioner Latasa. Confirm Annual Appointments for Chair and Vice Chair (CEQA: Exempt per CEQA Guidelines Section 15378 and 15061 - Not a Project) ACTION: Confirmed Hansen Reed as Chair and Dan Fletcher as Vice Chair Staff Presentation/Commissioner Questions Community Development Director Cole presented the Agenda Report and answered Commissioner questions. Ms. Cole announced Vice Chair Reed had shown interest in accepting the Chair position and asked Commissioner Fletcher if he would accept the position of Vice Chair. Commissioner Fletcher said he would absolutely accept the position. Public Comments None. Commissioner Comments None. Ms. Cole offered to look into the project status. Commissioner Latasa requested an estimated date for the wireless ordinance discussion. Ms. Cole suggested August is the goal and explained the legal team has been reviewing the public comment letters and suggestions that have been submitted. Commissioner Brassfield and Commissioner Millich requested an update on recent court cases pertaining to wireless cell towers. Ms. Cole suggested it may be possible to begin the next wireless ordinance discussion with an update on recent legal actions. Commissioner Latasa inquired a recent City Council decision regarding a Housing consulting firm. Ms. Cole provided details. INFORMATIONAL REPORTS & STAFF COMMENTS 4. Planning Office Update ADJOURNMENT ADJOURNMENT — The general policy of the Planning Commission is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Commission, or continued to the next regularly scheduled Planning Commission Meeting, or continued to a Special Meeting. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Commission on any Agenda items. The Chair will formally open the floor for public comment.
