PUBLIC HEARING 3. Consider 817 Martin Street: Application for H-2 Historic Zoning (AMD-25-0174); Applicant Gregory Bernard; Property Owner Gregory Michael Bernard and Jessica Rae Bernard; Residential Single-Family (R-1-15) Zoning District; Low Density Residential General Plan Land Use Designation (Exempt from CEQA per Article 19, Section 15305, Class 5) Docusign Envelope ID: 32C409FD-7B7A-4791-839B-6FFB654417C0 BE6093AB-3457-457E-ACCA-687D4CAF91CD ACTION: Approved Application for H-2 Historic Zoning (AMD-25-0174) at 817 Martin Street Staff Presentation/Commissioner Questions Principal Planner Roveri presented the Agenda Report and responded to questions regarding ownership and public right-of-way visibility. Ms. Roveri stated that the Mills Act procedures are under review and that the City may amend the ordinance; however, the current historic ordinance remains in effect. Chair Bluth inquired whether the Historic Preservation Commission (HPC) approved the item unanimously. Commissioner Freeman asked about the new Mills Act parameters. Ms. Roveri stated that staff will present proposed amendments at a later date. Applicant Gregory Bernard shared additional details about the history of the home and their intended historic preservation. Public Comments None. Commissioner Comments Commissioner Freeman suggested that the Planning Commission (PC) receive the (HPC) meeting minutes for additional context. Ms. Roveri noted that the HPC minutes will not be finalized until after the next HPC meeting in August. Applicant Applicant representative Anthony Davi clarified the layout and access. Mr. Davi provided additional information on why the applicant proposed this location. Public Comments None. Commissioner Comments Commissioner Freeman spoke in favor of the project, noting easy accessibility and privacy as benefits to the applicants. On a motion by Commissioner Freeman seconded by Commissioner Brassfield and carried by the following vote, the Planning Commission approved Use Permit Application UP-25-0125 for a massage establishment at 841 Foam Street: AYES: 4 COMMISSIONERS: Bluth, Brassfield, Dawson, Freeman NOES: 0 COMMISSIONERS: None ABSENT: 2 COMMISSIONERS: Latasa, Silva ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None 5. Confirm Annual Appointments for Chair and Vice Chair (CEQA: Exempt per CEQA Guidelines Section 15378 and 15061 - Not a Project) ACTION: Continued Chair and Vice Chair Appointments to the August 12, 2025 Planning Commission Meeting Staff Presentation/Commissioner Questions Principal Planner Roveri presented the agenda item, and the Commission made a motion to continue the item to the next PC Meeting. Commissioner Freeman asked how the combined Architectural Review Committee (ARC) and PC will operate. Community Development Director Cole shared that direction will be considered by Council at an upcoming Special Council meeting. Public Comments None. PUBLIC COMMENT PROCEDURES AND TIME LIMITS: The total amount of time allocated for public comment on a particular issue and for each individual speaker is generally as follows: 1. Up to three minutes per speaker. 2. For regular Planning Commission meetings, there are two 15-minute public comment periods, one in the afternoon and one in the evening. Speakers may only comment during one session. 3. The total time allocated for public comment: a. Items pulled from the consent agenda – 15 minutes each item b. Public Appearance items – 30 minutes each item c. Public Hearing items – 30 minutes each item At the time an item is considered, the Chair will ask those attending the meeting in person to line up at the podium or raise their hands, and for remote participants to use *9 on the telephone or the “raise hand” function in Zoom, if they wish to address the Planning Commission. The maximum amount of time for each person to speak and the total amount of time allotted for each item will be determined based on the number of people indicating an interest in speaking and the amount of business to be conducted on the agenda.
