MINUTES WIRELESS SUBCOMMITTEE Monday, December 10, 2018 7:00 PM – 10:00 PM FEW MEMORIAL HALL OF RECORDS COUNCIL CHAMBERS, 580 PACIFIC STREET MONTEREY, CALIFORNIA Members Present: Brassfield, Breedlove, Dawson, Hansen, Nine, Olsen, Peterson Members Absent: Staff Members Present: Community Development Director Cole, Recording Secretary Leinen CALL TO ORDER Chair Dawson called the meeting to order at 7:00 p.m. PUBLIC COMMENTS None. PUBLIC APPEARANCE 1. Recommend the Planning Commission Recommend Additional Changes to Municipal Code Section 38-112.4 Personal Wireless Service Facilities Subcommittee Member Olsen said equipment that is not in use should not be stored on utility poles. Subcommittee Member Dawson said he shares the concern, however, the matter is beyond the scope of the Wireless Subcommittee. Subcommittee Member Brassfield said a recommendation to City Council on the matter may be more appropriate. Subcommittee Member Nine said the Subcommittee can carefully craft the language when it gets to the section of the code on abandonment. The Subcommittee resumed their discussion of the proposed ordinance at item 6, Public Rights- of-Way Facilities, section b, Concealment. The Subcommittee discussed and agreed on the following changes and additions:  Page 12, Item 6a – add following purpose statement: The purpose and intent of this Chapter is to provide a uniform and comprehensive set of regulations and standards for the permitting, development, siting, installation, design, operation, and maintenance of wireless communications facilities in the City’s public rights-of-way. These regulations are intended to prescribe clear and reasonable criteria to assess and process applications in a consistent and expeditious manner, while reducing the impacts associated with wireless communication facilities. This Chapter provides standards necessary to 1. For the preservation of the public rights of way in the City for the maximum benefit use of the public; 2. To promote and protect public health and safety, community welfare, visual resources, and the aesthetic quality of the City consistent with the goals, objectives, and policies of the General Plan, and 3. To provide for the orderly, managed and efficient development of wireless facilities in accordance with state and federal laws, rules and regulations.  Item 6b (formerly 6a) – Remove the phrase “incommode the public” and add language regarding ADA at the end of the paragraph.  After item 6b, add the following language: Wireless Subcommittee Minutes Monday, December 10, 2018 c. Location Preference. The City’s preference for antennas located in the public right-of way in the following order: 1. Locate antennas on existing light poles in non-residential and non-historic zoning districts. 2. Locate antennas on existing utility poles in non-residential and non-historic zoning districts 3. If the facility must be located near a residential or historic district, open space areas can be considered if the facility will be farther away from residences. d. Equipment Preference. The City prefers the smallest equipment that is technically feasible to the vendor or applicant.  Item 6e (formerly 6b) – Modify text to read “Concealment. All conduit on poles shall be concealed within a pole when possible. On wood poles, wires or cables should be enclosed within conduit finished to match the pole.” Chair Dawson called for a recess at 8:23 p.m. Chair Dawson reconvened the meeting at 8:28 p.m. The Subcommittee continued with their discussion and agreed upon the following changes and additions:  Item 6f (formerly 6e) – Modify text to read “Undergrounded Equipment. Applicants shall install all non-antenna equipment underground including the electric meter. Conduit and emergency shutoffs shall be placed within the pole if possible, otherwise on the pole. Equipment vaults must be designed to contain a fire for a period of 60 minutes or 2 hours based on the national standards – NEMA & NFPA. Applicant or service provider must provide the capability to remotely, 24/7 1) control, monitor, and diagnose the condition of health of each cell site in operation; 2) remotely switch off the equipment in the event of a malfunction, fire, or danger to the environment; 3) have an automatic switch-off feature in the case of fire or water damage. City review of underground vaulting may include but not be limited to: safe clearance from other utilities, ADA compliance, aesthetic impact and quiet mechanical heating, air conditioning or ventilation systems. Additional expense to install and maintain an underground equipment enclosure does not exempt an applicant from this requirement, except where the applicant demonstrates by clear and convincing evidence that this requirement will effectively prohibit the provision of personal wireless services.  Item 6g (formerly 6d) – Remove text reading “Ground mounted equipment shall not be permitted in connection with a street light, traffic signal, utility pole or other similar infrastructure in the public right of way.”  Item 6h (formerly 6e) – Modify first sentence of text to read “Pole-Mounted Equipment. If an exception is granted and pole mounted equipment is allowed, pole-mounted equipment (not antennas) shall be installed as close to the pole as technically and legally feasible to minimize impacts to the visual profile.”  Item 6h, subsection i – Modify text to read “Antennas. The City requires compact radomes at top of the pole, preferably flush with the pole. The antenna shall be top- mounted and concealed within a radome that also conceals the cable connections, antenna mount and other hardware. GPS antennas shall be placed within the radome or directly above the radome not to exceed six inches. Pole-mounted antennas shall not increase the pole height by more than two feet and shall not exceed the diameter of the pole unless required by safety codes. No antennas shall be attached on poles with transformers.” Wireless Subcommittee Minutes Monday, December 10, 2018  Item 6h, subsection ii – Modify text to read “Pole-Mounted Equipment Cabinets. All non- antenna equipment shall be placed underground. All equipment other than the antenna(s) and disconnect switch shall be concealed within an equipment cage not extending more than 10 inches beyond the pole centerline on either side. The equipment cage shall be nonreflective and painted, wrapped or otherwise colored to match the existing pole. All pole-mounted equipment shall be installed as flush to the pole as possible. Any standoff mount for the equipment cage may not exceed four inches and shall include metal flaps (or “wings”) to conceal the space between the cage and the pole.”  Item 6h, subsection iii – Modify text to read “Replacement Poles. If an applicant proposes a replacement facility in the public rights-of-way, then the applicant shall use existing above-ground structures. If permitted, replacement poles shall utilize materials and colors similar to and compatible with existing streetlight or utility poles in the area so as to not be visually obtrusive. In addition, the approval authority may require the applicant to install a decorative or integrated pole designed to conceal the equipment.”  Add Item 6g – “Re-Location Procedures for Facilities in the Public Rights-of Way. After reasonable written notice to the permittee, the Director may require a permittee, at the permittee’s sole expense, and in accordance with the standards in this chapter applicable to such wireless communication facility(ies), to relocate or reconfigure a wireless communication facility in the public rights of way as the Director deems necessary to protect public health, safety, and welfare. The provisions in this section are intended to include circumstances in which a wireless communication facility is installed on a pole scheduled for undergrounding.” SUBCOMMITTEE MEMBER COMMENTS None. INFORMATIONAL REPORTS & STAFF COMMENTS  Community Development Director Cole confirmed the next meeting will be held Friday, December 14, 2018 from 9:00 a.m. – 12:00 p.m. and the following meetings will be December 17 and December 21, 2018.  Chair Dawson said he may be late to the December 14, 2018 meeting.
