MINUTES WIRELESS SUBCOMMITTEE Friday, December 14, 2018 9:00 AM – 12:00 PM FEW MEMORIAL HALL OF RECORDS COUNCIL CHAMBERS, 580 PACIFIC STREET MONTEREY, CALIFORNIA Members Present: Brassfield, Breedlove, Dawson, Hansen, Nine, Peterson Members Absent: Olsen Staff Members Present: Community Development Director Cole CALL TO ORDER Chair Dawson called the meeting to order at 9:00 a.m. CONSENT ITEMS Approval of Minutes 1. December 7, 2018 ACTION: Approved as Submitted. Subcommittee Member Brassfield made a motion to approve the consent item. Subcommittee Member Breedlove seconded the motion. On a motion by Subcommittee Member Brassfield, seconded by Subcommittee Member Breedlove, and carried by the following vote, the Subcommittee approved the consent item: AYES: 6 SUBCOMMITTEE Brassfield, Breedlove, Dawson, Hansen, Nine, MEMBERS: Peterson NOES: 0 SUBCOMMITTEE None MEMBERS: ABSENT: 1 SUBCOMMITTEE Olsen MEMBERS: ABSTAIN: 0 SUBCOMMITTEE None MEMBERS: RECUSED: 0 SUBCOMMITTEE None MEMBERS: PUBLIC COMMENTS Pat Venza shared that most residents are concerned about fire risk. She added that the City’s goal should be to remove all equipment from poles to reduce fire hazards. ***End of Consent Agenda*** PUBLIC APPEARANCE  Wireless Subcommittee Minutes Friday, December 14, 2018 2. Recommend the Planning Commission Recommend Additional Changes to Municipal Code Section 38-112.4 Personal Wireless Service Facilities Chair Dawson suggested that the Subcommittee discuss Freestanding Tower Facilities. Subcommittee Member Nine requested that the Subcommittee begin with the section on Relocation Procedures for Facilities in the Pubic Rights of Way and presented information about underground requirements. She questioned if there is information in the City Ordinance that requires relocation when an area is undergrounded. She requested that staff contact the cities that have undergrounded utilities for more information. Ms. Nine shared that the City appears to be lax in its management of the rights of way. Subcommittee Member Hansen requested that the Subcommittee consider the issue now, and that it should be incorporated into the Ordinance. Subcommittee Member Nine recommended that the City contact the cities of Dallas or Palos Verdes to discuss the issue and Subcommittee Member Brassfield recognized the need for expert input on equipment issues. Community Development Director Cole replied that the City may not have the budget to underground all cabinets and utilities. Subcommittee Member Hansen expressed concern with the aesthetics of above ground utilities. Subcommittee Member Nine indicated that public parks should be off limits to wireless facilities. Subcommittee Member Hansen indicated that Monterey is a city of neighborhoods and there is no place for towers in residential or open space areas. Community Development Director Cole clarified zoning and identified open space areas throughout the City on the City’s Zoning Map. The Subcommittee discussed Preferred Locations. The Subcommittee added D - public rights of way adjacent to open space districts (not within parks – prefer away from residences). Subcommittee Member Brassfield pointed out that the City has four military areas and there may be opportunities for wireless facilities to be located on military bases. Subcommittee Member Breedlove mentioned that the facilities could be located along the entire base length and point towards New Monterey. Subcommittee Nine read an example of maintenance and operation code requirements from another city. Subcommittee Member Breedlove said that a maintenance plan should exist for such facilities, as well as consequences for deferred maintenance. There was consensus that the maintenance and operation requirements should be included in the draft ordinance. Subcommittee Member Nine presented new language regarding the effective prohibition of service. There was consensus that this information should be included in the draft ordinance. Subcommittee Member Hansen presented two options for language regarding Written Decisions. Chair Dawson questioned the need for substantial evidence. Subcommittee Member Nine agreed that the substantial evidence clause could be removed because it is a matter of law. 2 Wireless Subcommittee Minutes Friday, December 14, 2018 Subcommittee Member Hansen reviewed the language for Appeals. Subcommittee Member Nine explained the significance of the wording for 30 days. Community Development Director Cole objected to this language due to difficulty in scheduling meetings. Subcommittee Member Nine emphasized the importance of this language. The group discussion ended prior to Section J., Independent Consultant Review. Subcommittee Member Hansen commented that she would like to see the final ordinance draft prior to legal review. Community Development Director Cole clarified that the working draft was the draft that will be presented for legal review. Subcommittee Member Hansen indicated that she would like to approve the content and form prior to its presentation to the Planning Commission. SUBCOMMITTEE MEMBER COMMENTS None. INFORMATIONAL REPORTS & STAFF COMMENTS Community Development Director Cole encouraged the group to finish the ordinance by next week. Subcommittee Member Nine expressed concerns about rushing and wanting to ensure a quality work product.
