MINUTES ZONING ADMINISTRATOR Thursday, August 11, 2011 4:00 PM MONTEREY LIBRARY, COMMUNITY ROOM MONTEREY, CALIFORNIA CALL TO ORDER Senior Associate Planner Bennett called the meeting to order at 4:05 PM. PUBLIC COMMENTS No public comments were received. PUBLIC HEARING 1. 96 Via Robles; Use Permit 11-157; Applicant Rick Steres; Owner Rick Still; R-1-20 Zoning District; Exempt from CEQA Requirements. Re-open Use Permit 98-076 to allow for the partial removal of the existing 1-car garage and it's replacement with a 2-car garage. Action: Approved application with Standard and Special Circumstance Findings for Decision and Conditions of Approval. On August 11, 2011, the Zoning Administrator approved Use Permit 11-157 to re-open Use Permit 98-076 to allow for the partial removal of the existing 1-car garage and it's replacement with a 2-car garage located at 96 Via Robles within the R-1-20 District subject to the following findings, that: Environmental: 1. The project is exempt from the California Environmental Quality Act (Section 15301 because the project is a modification to an existing facility. General Plan: 2. The project, a partial demolition of a single car garage and its conversion to storage, and a replacement two-car garage is consistent with the City of Monterey General Plan because the site is zoned Residential and the use will continue to be a residential use. Zoning Ordinance: 3. As conditioned, the proposed use is in accord with the objectives and purposes of the R- 1-20 Zoning District and applicable Zoning Ordinance standards because the Zoning Code allows Guest Houses, with approval of a Use Permit, on R-1 zoned properties that are a minimum of 8,000 square feet and this project retains the Guest House use while expanding the number of off-street covered parking spaces. Use Permit: 4. As conditioned, the proposed use will not be detrimental to the public health, safety, or welfare of persons residing or working in or adjacent to the neighborhood of such use; and will not be detrimental to properties or improvements in the vicinity or to the general welfare of the City because the project is a modification to the Guest House garage, and its replacement will increase the number of off-street, covered parking spaces to be in compliance with the current Zoning Code. Zoning Administrator Minutes Thursday, August 11, 2011 5. The proposed use will comply with any specific condition required for that use. Conditions of Approval: 1. Planning, Engineering, and Environmental Compliance Division Condition. That the Use Permit 11-157 to re-open Use Permit 98-076 to allow for the partial removal of the existing 1-car garage and it's replacement with a 2-car garage within two (2) years from the date of approval, is approved as shown on the July 14, 2011 site plan and floor plan. 2. Planning, Engineering, and Environmental Compliance Division Condition. That all development on the project property shall be constructed and thereafter maintained in accordance with the conditions of this permit. 3. Planning, Engineering, and Environmental Compliance Division Condition. That prior to submittal of a building permit an application for Architectural Review Committee (ARC) review and approval shall be submitted and approved. 4. Planning, Engineering, and Environmental Compliance Division Condition. That a 2-car, replacement garage be constructed on the subject site within 24 months from the date of this decision. Failure to meet this deadline, or to obtain approval for an extension to this deadline, will result in a revocation of Use Permit 98-076 and removal of the existing Guest House. 5. Planning, Engineering, and Environmental Compliance Division Condition. Owner to submit copies of the two (2) Quit Claim deeds associated with the access easements to the adjacent residential properties. The documentation must show that the Quit Claim deeds have been recorded and shall include property descriptions. 6. Planning, Engineering, and Environmental Compliance Division Condition. Prior to issuance of a Building Permit for the replacement garage, the owner shall submit a Site Plan to the Planning office which identifies the location of the City storm drain line and Planning staff shall visit the site and confirm that the new garage foundation will not encroach over the storm drain. 7. Planning, Engineering, and Environmental Compliance Division Condition. The new, replacement garage shall maintain a minimum six (6) foot separation from the existing garage, or be attached to the existing garage. 8. Permit and Inspection Services Division Condition. The foundation plan for the new garage shall show the depth of the foundation footing to be greater than the depth of the storm drain in order to prevent the possibility that the foundation would need to be shored-up if work on the storm drain line is undertaken. 9. Permit and Inspection Services Division Condition. The applicant shall comply with all the requirements of the Permit and Inspection Services Division. 10. Planning, Engineering, and Environmental Compliance Division Condition. This project is subject to the categorical water allocation program approved by the City Council. The applicant will proceed at his own risk that water may not be available at the time he requests building permits. No building permits will be issued if water is not available to this project. This permit shall become null and void if not exercised or extended within twenty-four (24) months of the date of granting by the Zoning Administrator. It is the applicant’s responsibility to track the 24-month expiration date. No renewal notice will be sent to the applicant. Any person or group desiring to bring an item to the attention of the Zoning Administrator may do so during Public Comments or by addressing a letter of explanation to the Zoning Administrator, City Hall, Monterey, CA 93940. PUBLIC HEARING PUBLIC HEARINGS are required by law for certain actions. You are welcome to offer your comments after being recognized by the Zoning Administrator. The Zoning Administrator may limit the time allocated to each speaker. A copy of written material, pictures, etc. should be provided to the Administrator for this purpose. Zoning Administrator decisions may be appealed within ten (10) days from the date of the decision on forms available in the Planning Division during business hours. When the tenth day falls on a weekend or a holiday, the appeal deadline date is the next working day following the holiday or weekend. The appeal filing fee is $170.
