CALL TO ORDER
Senior Associate Planner Bennett called the meeting to order at 4:00 PM.
PUBLIC COMMENTS
No public comments were received.
PUBLIC HEARING
1. Consider 625 Major Sherman Lane – Variance Application 11-311 for 6' fence within front
yard setback (4' - 0" standard); Applicant Ray Schmitt; Owner Albert Barreto; R-1-10-D1
Zoning District; Exempt from CEQA Requirements.
Action: Continued the application to the February 23, 2012 Zoning Administrator
Meeting for redesign.
On February 9, 2012, the Zoning Administrator continued Variance Application 11-311 for a
6’ fence within front yard setback located at 625 Major Sherman Lane within the R-1-10-D1
District subject to redesign by the applicant.
2. Consider 631 Major Sherman Lane – Variance Application 11-312 for 6' fence within front
yard setback (4' - 0" standard) and 12' front yard setback for new dwelling (15' - 0" standard);
Applicant Ray Schmitt; Owner Albert Barreto; R-1-10-D1 Zoning District; Exempt from CEQA
Requirements.
Action: Continued the 6’ fence within the front yard setback to the February 23,
2012 Zoning Administrator Meeting and approved the 12’ front yard setback for a new
dwelling with Standard and Special Circumstance Findings for Decision and
Conditions of Approval.
On February 9, 2012, the Zoning Administrator continued the 6' fence within front yard
setback to the February 23, 2012 Zoning Administrator Meeting and approved the 12' front
yard setback for a new dwelling located at 631 Major Sherman Lane within the R-1-10-D1
District subject to the following findings, that:
Environmental:
1. The project is exempt from the California Environmental Quality Act (Article 19, Section
15303, Class 1) because the project is one single family dwelling in a single family
residential zoning district.
General Plan:
2. The project, a new single family dwelling, is consistent with the City of Monterey
General Plan because it is a single family residential use on a site designated for
residential use, and that there will be no development on an existing hillside slope
located at the rear of the site which is equal to or greater than 25% which is prohibited
in the Safety Element section of the General Plan (Policy b.1(B) page 80).

Zoning Ordinance:
3. The proposed use is in accord with the objectives and purposes of the R-1-10-D1
Zoning District and applicable Zoning Ordinance standards because the use will be a
single family dwelling and the site is zoned and intended for such use.
Variance:
4. Because of special conditions applicable to the subject property, strict application of the
zoning requirements would deprive the subject site of privileges enjoyed by other
property in the vicinity and under an identical zoning classification because the hillside
area located at the rear of the site comprises a significant amount of the site and
meeting the front yard setback standard of 15’ would result in a significantly
substandard sized rear yard.
5. Granting the variance will not be detrimental or injurious to property or improvements in
the vicinity of the development site, or to the public health, safety or general welfare
because the approved setback of 12’ to the front property line is greater than the
existing front yard setback of approximately 4’, and that there are no residential uses on
the opposite side of the street.
6. Granting the variance is consistent with the purposes of the zoning ordinance and will
not constitute a grant of special privilege inconsistent with the limitation on other
properties in the vicinity and in the same zoning district because special conditions
associated with this site have been identified and justify the approval of the front yard
setback variance.
Conditions of Approval:
1. Planning, Engineering, and Environmental Compliance Division Condition. That
the Variance for a 12' front yard setback for new dwelling is approved as shown on the
December 13, 2011 site plan and floor plan, and described in the letter of the same
date.
2. Planning, Engineering, and Environmental Compliance Division Condition. That
all development on the project property shall be constructed and thereafter maintained
in accordance with the conditions of this permit.
3. Planning, Engineering, and Environmental Compliance Division Condition. That
prior to submittal of a building permit an application for Architectural Review Committee
(ARC) review and approval shall be submitted and approved.
4. Permit and Inspection Services Division Condition. The applicant shall comply with
all the requirements of the Permit and Inspection Services Division.
5. Fire Department Condition. Obtain G.P.M. and pressure flow data from Cal Am to
justify the design. Submit to Monterey Fire Prevention fire sprinkler plans and
calculations prior to installation in the manufactured home.
6. Planning, Engineering, and Environmental Compliance Division Condition. This
project is subject to the categorical water allocation program approved by the City
Council. The applicant will proceed at his own risk that water may not be available at
the time he requests building permits. No building permits will be issued if water is not
available to this project.

7. Permit Expiration Condition. This permit shall become null and void if not exercised
or extended within twenty-four (24) months of the date of granting by the Zoning
Administrator. It is the applicant’s responsibility to track the 24-month expiration date.
No renewal notice will be sent to the applicant.

PUBLIC COMMENTS. At this time, the public may speak for a maximum of three minutes on any
subject which is within the jurisdiction of the Monterey Zoning Administrator and which is not on the
agenda. Any person or group desiring to bring an item to the attention of the Zoning Administrator may
do so during Public Comments or by addressing a letter of explanation to the Zoning Administrator, City
Hall, Monterey, CA 93940.

after being recognized by the Zoning Administrator. The Zoning Administrator may limit the time
allocated to each speaker. Project representation is encouraged.

ADJOURNMENT— The general policy of the Zoning Administrator is that the meeting will end no later
than 6:30 p.m. Any public agenda items that have not been completed within the designated
adjournment time may be formally extended by the Administrator, or continued to the next regularly
scheduled Zoning Administrator Meeting, or continued to a Special Meeting.
The Zoning Administrator agenda may be reviewed by the public in the Monterey Public Library, in the
Planning, Engineering, and Environmental Compliance Division (PEEC), or on the web at
www.monterey.org beginning late Friday afternoon prior to the date of the meeting.
Members of the public have the right to address the Zoning Administrator on any item on the Agenda.
The Zoning Administrator will formally open the floor for public comment on items listed under “Public
Hearings.”
Information distributed to the Zoning Administrator at the meeting becomes part of the public record. A
copy of written material, pictures, etc. should be provided to the Administrator for this purpose.
Zoning Administrator decisions may be appealed within ten (10) days from the date of the decision on
forms available in the Planning Division during business hours. When the tenth day falls on a weekend
or a holiday, the appeal deadline date is the next working day following the holiday or weekend. The
