Consider 476 Tyler Street; Use Permit Application UP-22-0004 to Allow a Change in Use by Partially Converting Existing Ground Floor Commercial Space within an Existing Mixed-Use Building into Three Studio Apartments and One Storage Space For Lease By On-Site Tenants; Applicant George Ash, Architect; Property Owner Saucito Land Company; PC-D Zoning District (Planned Community – Downtown Specific Plan); Commercial General Plan Designation; Exempt from CEQA Requirements per Article 19, Section 15301, Class 1 1 DocuSign Envelope ID: 02824DF7-8EF3-4DFA-BA0D-B09ACE157E84 Zoning Administrator Minutes Thursday April 21, 2022 ACTION: Approved Use Permit application UP-22-0004 to allow a change in use by partially converting existing ground floor commercial space within an existing mixed-use building into three studio apartments and one storage space for lease by on-site tenants with added Conditions of Approval. Staff Presentation/Commissioner Questions Associate Planner Sabdo presented the Agenda Report and answered Zoning Administrator questions. Applicant On behalf of the property owner, Saucito Land Company, Jerry Anderson and Architect George Ash were present to answer questions. Zoning Administrator Roveri inquired about parking and storage. Mr. Ash provided details. Zoning Administrator Roveri asked about the existing use of the patio. Mr. Ash explained the intended use was a restaurant with covered outdoor seating but the space has been vacant. Zoning Administrator Roveri requested an explanation regarding patio encroachment and resident access. Mr. Ash explained some units encroached further into their patio to provide more space inside, stated there is a common walkway with unit entrances through each patio, and specified the entrance gate would be secured with resident keys and a buzzer for guests. Public Comments None. Zoning Administrator Comments Zoning Administrator Roveri spoke in support of the project because it conforms to objectives and standards and approved the proposal with the following Conditions of Approval: 1. CEQA Exception b: change “some of the site conditions are unique” to “the change in use would minimally expand the building footprint.” 2. CEQA Exception c: add “There are no unusual circumstances at the project site. Therefore, significant effects would not occur.” 3. CEQA Exception f: change “however, no digging is proposed. Therefore, there will be no impacts to historical resources” to “Minimal ground work may be required to plumb the proposed three studio apartments and expand the building footprint. The ground work would occur within previously disturbed areas. Therefore, impacts to historical resources are not anticipated.” 4. Finding 1: correct APN to “001-574-029-000” and correct the number of parking spaces to “17”. 5. Special Condition 1: correct APN to “001-574-029-000”. 6.
