We would like to display the three feet by five feet American flags on ten foot poles along two major entrances to our city: Don Knotts Boulevard along the median from the BFS convenience store to the Waterfront Place Hotel and also in multiple rows in front of the Creative Arts Center along Monongalia Boulevard. We will display the flags that we will sell to the community honoring heroes from Memorial Day to Flag Day. In order to proceed with this fundraiser we are asking for help in receiving permission to drill one foot by one inch diameter pilot holes every ten feet to hold a receiver that will in turn hold the flags on display. We would like to start with two hundred flags which will require two hundred pilot holes. Each receiver comes with a cap that we will insert after the flags are removed in order to reuse them in years to come. Our hopes would be that this fundraiser will grow in coming years and we can expand to other areas of the city and include the other Rotary Clubs with many more flags. We hope that you will consider this request and help us get permission to be able to place the flag receivers prior to Memorial Day. Mayor Shamberger & Ron Bane Absent Deputy Mayor Kawecki called the meeting to order. PRESENT: There were no presentations. PUBLIC PORTION: Matt Miller, 1416 Western Avenue, secretary of the Human Rights Commission, noted that the Resolutions they have proposed are in line with making the city inclusive. Mark Brazaitis, 734 Courtney Avenue, a WVU Professor has had direct contact with International Students that have not felt welcome in our City. Mr. Brazaitis noted that he supports the approval of the Resolutions that the Human Rights Commission has proposed. Dave Saville, 613 Hobson Street, referred to a statement that he read to Council supporting the Human Rights Commissions Resolutions. Ex. A. Mavis Grant Lilly, 173 Poplar Drive, speaking on behalf of the WV Friend of Syrian Refugees. She noted that the City should pass these Resolutions being presented by the Human Rights Commission. She stated that everyone should feel welcome in our community. Don Spencer, 687 Killarney Drive, Volunteer Human Rights Commission, noted that the two Resolutions proposed are to bring _pride, hospitality and inclusiveness to our city. Joe Morris, 532 Meridan Street, chair of the Urban Landscape Commission, explained changes to the commission ordinance. Marchetta Maupin, Morgantown Urban Landscape Superintendent for the City, explained that there are 49 project sites, 72 hanging baskets, and that she serves as City Administration for the Tree Board. Matthew Cross, 524 Milford Street, President ofSNA, presented a traffie request from a resident from the Sunerest Neighborhood Association. Ex. B. He supports the Resolutions that the Human Rights Commission is proposing. Mike, 28 Irish Road, Immigrant, member of the Community Coalition of Social Justice, supports the Human Rights Commission Resolutions. 1 6 ITEMS FOR DISCUSSION: 1. A ~ A Statement on Morgantown's Need for a Resolution Supporting the Rights of Immigrants, Refugees and Asylees David W. Saville, Commissioner City of Morgantown Human Rights Commission Bishop Desmond Tutu once said, "If you are neutral in situations of injustice, you have chosen the side of the oppressor." All across our country there are people, communities, cities, even members of Congress and the President, who are singling out people because of their nationality or religion. They seek to take away their rights. This resolution is one way, among many, that Morgantown can take the side of Justice, and live up to the principles our nation was founded upon. It is one way Morgantown can speak UPI and break the silence. It is one way Morgantown, and our richly diverse community, can be a protagonist in struggle for the rights of minorities and the oppressed. It is one way that Morgantown can live up to its billing as a Welcoming Community. Being responsible citizens, and a responsible community, in a Democracy, demands that we speak up in the face of injustice. Dr. Martin luther King said, "In the end, we will remember not the words of our enemies, rather the silence of or friends." We Resolve ... 8 To: Morgantown City Council March 10,2017 From: Matthew Cross President Suncrest Neighborhood Association Greetings, At the February meeting of the Suncrest Neighborhood Association the following motion was put forward; Whereas in Morgantown and particularly in Suncrest moving traffic violations are at epidemic levels and visible enforcement of moving traffic laws and ordinances by police is extremely low; We, the Suncrest Neighborhood Association, request the Morgantown City Council to instruct Morgantown Police to; 1. Enforce traffic laws and city ordinances within the Suncrest neighborhood on at least one street per week with enforcement as follows; a) speed under posted speed limit plus 20 % b) complete stop at stop signs c) no nuisance vehicular noise including exhaust, motor and audio. 2. Motion carried 6-0. 2 12 BOARDS AND COMMISSIONS: Council by acclamation affirmed Christiaan Abildso to serve as the City Representative on the Mon River Trail Conservancy Board. Council by acclamation requested that after the Human Rights Commission makes the changes to the Resolutions that they be featured on the city web-site. City Clerk Linda Tucker requested approval from Council to have a Special Meeting on 4/18/17 at 6:30 pm to interview a candidate for the Woodburn Commission. After discussion, Council approved, by acclamation that the Clerk can advertise for the Special Meeting. PUBLIC PORTION: Deputy Mayor Kawecki declared the Public Portion open. Penny Kostka, 895 Fairfax Drive, reported to Council that she had a bad experience with Southern Airlines when traveling recently and wanted Council to be aware of the situation. Roger Banks, 444 Overhill Street, stated that Morgantown is the most diverse community in WV because of its neighborhoods. He requested Council to support the Resolution and to make the next step of becoming a Refugee City like Charleston, WV. There being no more appearances, Deputy Mayor Kawecki declared the Public Hearing closed. SPECIAL COMMITTEE REPORTS: No Reports. NEW BUSINESS AN ORDINANCE AMENDING OF THE PLANNING AND ZONING CODE AS IT RELATES TO BICYCLE STORAGE RACK REQUIREM.ENTS: The below entitled Ordinance was presented for first reading. AN ORDINANCE AMENDING SECTION 1365.04 OF THE CITY OF MORGANTOWN PLANNING AND ZONING CODE AS IT RELATES TO BICYCLE STORAGE RACK REQUIREMENTS. After discussion, motion by Selin, second by Ganz to approve the above entitled Ordinance to second reading. Motion carried 6-0. AN ORDINANCE AMENDING OF THE CITY CODE PROVIDING FOR THE URBAN LANDSCAPE COMMISSION: The below entitled Ordinance was presented for first reading. AN ORDINANCE AMENDING ARTICLE 163 OF THE CITY CODE PROVIDING FOR THE URBAN LANDSCAPE COMMISSION. City Manager Paul Brake explained the amendments. After discussion, motion by Ganz second by Selin to approve the above entitled to second reading. Motion carried 6-0. CITY MANAGER'S REPORT: 3 13  City Manager Paul Brake updated Council on the T-Hangar construction at the Airport he stated that the City Crew will be assisting on Friday 4-7-17. He noted that the advanced Air-Force team will start on 4-9-17, construction workers on 4-16& 17. He stated that components of the project are coming together and the bidding process will be adjusted accordingly. New Business: 1. Award Nominal Lumber Package Bid for T -Hanger Project The City's airport engineer has recommended a successful bid for the above- mentioned project. The bid opening occurred on March 29, 2017. Attached you will find a copy of the recommendation to award the bid to 84 Lumber in the amount of$33,830.09. Motion by Ganz, second by Bane to award the bid for the T-Hangar Project at the Airport to 84 Lumber for $33,830.09. Motion carried 6-0. 2. Award Grounding Material and Delivery Bid for T-Hanger Project This includes a bid package for electric grounding materials and the delivery of these items. This was tabulated following the bid opening on March 29,2017. The engineer recommends that State Electric Supply, Inc as the successful bidder in the amount of $1 0,857.54 as presented in the accompanying document. Motion by Bane, second by Redmond to award the bid for the T -Hanger Project at the Airport to State Electric Supply for $10,857.54. Motion carried 6-0. 3. Award Concrete Reinforcement Steel Fabrication and Delivery Bid for T -Hanger Project Two bids were submitted for this work and the engineer has recommended a successful bidder. As described in the accompanying memorandum dated March 29, 2017, one ofthe bidders did not complete all the necessary documents and affidavits required in the bid package. Thus, Foster Supply, Inc. is now recommended as the successful contractor in the amount of $31,910.14. Motion by Selin, second by Ganz to award the bid for the T-Hanger Project at the Airport to Foster Supply for $31,910.14. Motion carried 6-0. 4. City Manager Paul Brake mention to Council per code that the City Manager has the authority to sign off on bids for the Airport to expedite the process on Council's behalf. After discussion, City Manager Paul Brake will update Council in his City Manager Report on April 18 t h, 2017. REPORT FROM CITY CLERK: Information: City Clerk Linda Tucker presented the following Election updates: 1. April 4th - Last day to register to vote at the County if you want to vote in the City Election. You may contact the County Clerk at 304-291-7238. 2. April 10 th - first Candidate Campaign Due. 3. April 11th - Write in candidates can apply by filling out paperwork per Charter Section 7.02f. 4. April 12th- April22 nd Early Voting 2 sights - City Hall and North Side Fire Station. 5. April 18th - Live presentation of Election Voting Machine at City Council Meeting. 4 14  6. Last day to accept Absentee Applications by mail is April 19th • 7. Election Day - April 25 th - Polls open at 6:30 a.m. and close at 7:30 p.m. REPORT FROM CITY ATTORNEY: No report. REPORT FROM COUNCIL MEMBERS: Councilor Bane: Councilor Bane thanked those that send their regards for loss of his girlfriend's mother. He noted the dates the Clerk stated, and asked everyone to remember to vote. Councilor Nugent: Councilor Nugent asked the City Manager to consider the airport transfer flight, that would cause issues with commercial flights. He thanked the Evansdale Neighborhood for the candidate forum. He suggested that citizens should vote early, ifnot vote on election day. Councilor Selin : Councilor Selin requested that the City Manager get a report from Southern Airlines on status of operations. She made the following announcements 4-7-17 Short Film Festival at Met Theatre; 4-22- 17 Chocolate Lovers Day and Friends of Decker's Creek from 6 p.m. to midnight. Councilor Redmond : Councilor Redmond congratulated the Evansdale Neighborhood Association on a well-organized Candidate Forum. He thanked the City Clerk, and the City Engineer for the virtual map on the web-site to help voters find where their polling place is located. He appreciated the City Planner showing up to explain zoning amendments, but would rather the approach be a comprehensive review. He expressed his disappointment to see in the newspaper a citizen involved with lawsuit with developers. He stated that he feels responsible for this situation for leading the developer down the wrong path. Councilor Ganz: Councilor Ganz thanked everyone for their reports. She noted that the Comprehensive Plan was looked at in an all-inclusive way in the early stages. She stated that she appreciates the work that the City Attorney and City Planner have done on the present Zoning changes. She thanked the Greek Service for their day of clean-up on Sunday. She mentioned the Airline in transition and agrees with Councilor Selin on getting an update on their progress. She noted her appreciation of volunteers from Neighborhood Associations, Art Work by Volunteers, Sister Cities, there are more than 300 volunteers, and if you have a vision for the city get involved. She encouraged citizens to take time to vote in the city election. Mayor Shamberger: Absent 5 15 Deputy Mayor Kawecki: Deputy Mayor Kawecki echoed Councilor Ganz comments about the volunteers and stated they are vital to this community. There is hereby established an Urban Landscape Commission for the City, the official name of which shall be the "Morgantown Urban Landscape Commission." 163.02 PURPOSE. The purpose of the Urban Landscape Commission shall be to advise and recommend to the City Manager andlor City Council such plans programs and projects which in the opinion of the Commission would improve the natural, aesthetic, and environmental quality of life within the City. The Commission shall review and make timely recommendations in collaboration with the Tree Board on all landscape plans accompanying new or reconstructed City buildings parks parking lots, trails and other City-owned realty. The Commission shall may adopt its own by-laws or rules subject only to the action of Council. 163.08 APPROPRIATION OF FUNDS. Council may appropriate any funds that it deems necessary to carry out any of the proposals set forth by the Urban Landscape Commission. The Commission, with the approval of City Council, may apply for federal and state fmancial aid in grants or other forms of financial assistance through the City Administration to assist in carrying out any of such proposals or projects. The Commission may also seek fmancial assistance from organizations or individuals for such purposes in consultation with the City Administration. All Commission funding shall be received and managed by the office of the City Manager. 163.09 ANNUAL REPORT. Council may request a yearly report from the Urban Landscape Commission regarding its services provided throughout the previous year. This report may include information, statistics and recommendations which may be deemed of general interest. This ordinance is effective upon adoption.
