Ordinance 2023-___ AN ORDINANCE AMENDING THE MEMBERSHIP REQUIREMENTS FOR THE URBAN LANDSCAPE COMMISSION The City of Morgantown hereby ordains that Article 163 of the City Code entitled “Urban Landscape Commission,” is amended as follows: Sec. 163.03. - Membership. The Urban Landscape Commission shall consist of five members, one being a member of City Council and the remainder having expertise in any of the following areas: Landscape architecture, landscape design, horticulture, plant health, urban planning, or civil engineering. All members shall be residents of the City or work in the City. The members of the Commission shall be appointed by City Council. The City Manager and the Director of the Board of Park and Recreation Commissioners, or their designees, shall serve as ex officio members of the Commission but shall not be entitled to vote. This ordinance shall be effective upon adoption. Ordinance No. 2023-___ AN ORDINANCE AMENDING SECTION 365.12 OF THE CITY CODE DESCRIBING GATE AND PULL TICKET VIOLATIONS IN PARKING FACILITIES The City of Morgantown hereby ordains that City Code section 365.12 is amended as follows: Sec. 365.12. - Gate and pull ticket violations. (a) No vehicle shall exit any off-street gated parking facility without paying the required fee for parking, including by means of a gate being physically lifted, by driving around a gate, or by exiting through any unauthorized area that avoids use of a gate. for the purpose of exiting the facility without paying for time parked. (b) No vehicle shall exit any off street gated parking facility by means of a pull ticket which has been modified or is different than that which was issued to the vehicle upon entering the facility. (c) No vehicle shall tailgate while exiting an off street gated parking facility. For purposes of this subsection, tailgate shall mean one vehicle following another vehicle so closely that the tailgating vehicle exits through the gated area during the gate cycle for the vehicle in front of it without using a paid parking ticket to exit. (d) Violations of any of the prohibitions within Section 365.12 shall be subject to a penalty of not less than $100.00 nor more than $500.00. Parking Authority Enforcement Officers shall have the authority to mail citations to a vehicle's registered owner who shall be responsible for violations set forth in Section 365.12. This ordinance shall be effective upon adoption. Ordinance No. 2023-___ AN ORDINANCE AMENDING CITY CODE SECTION 105.09 PROVIDING FOR ELECTION ROOMS AND BOOTHS The City of Morgantown hereby ordains that City Code Section 105.09 is amended as follows: Sec. 105.09. - Election rooms and booths. The City Clerk before each City election shall secure in each voting precinct a suitable room or building in which to hold the election, and shall cause the same to be suitably provided with a sufficient number of booths or compartments, each containing a table, counter or shelf and furnished with proper supplies for preparing ballots, at or in which voters may conveniently prepare their ballots, so that in the preparation thereof they may be secure from the observation of others. provided, however, that the City Clerk may determine that the polling place for one or more precincts should be consolidated to promote voter security or efficient administration of elections, and, in that event, the City Clerk shall provide affected voters with any notice required by law, and no polling place, attendants, or materials shall be required in the precinct where a polling place is not located, notwithstanding any provision of this Article to the contrary. The number of such booths or compartments shall not be less than two nor more than five for each precinct. This ordinance is effective upon adoption.
