CIVILIAN POLICE REVIEW AND ADVISORY BOARD Morgantown, West Virginia MINUTES Special Board Meeting, September 13, 2023 Present: Bob Cohen, Rich Burks, Dady Dadyburjor, Catherine Fonseca, Bryan Church This virtual Special Meeting was convened by Zoom at approximately 12 p.m. to discuss proposed Bylaws drafted by Bob Cohen. Reviewed and discussed were proposed Article V(E) through Article IX(C), which address: Removal of Board Members from Office Vacancies Officers Committees Quorum Regular Meetings Special Meetings Open Meetings Participation in Meetings by Electronic Communication Means Voting Work with Other Entities Orientation and Training – Attendance at Meeting of Board Orientation and Training – Receipt of Packet of Information Orientation and Training – Ride-along with Morgantown Police Department’ Orientation and Training – Orientation Provided by MPD Orientation and Training – Orientation by NACOLE or Similar Organization Orientation and Training – Annual Training by NACOLE or Similar Organization Board’s Powers and Duties MPD Response to Board’s Recommendation or Policy Statement  Board’s Response to Citizen Complaint of Misconduct Most sections of the proposed Bylaws were accepted as written or changed in relatively minor ways. In various sections the proposed Bylaws used the word “shall” with reference to entities other than the Board itself, such as the Morgantown Police Department. It was suggested that the Board’s Bylaws could not legally contain mandatory language regarding entities other than the Board. It was decided that Bob would contact City Attorney Ryan Simonton to obtain guidance on this issue. With regard to the section about an orientation of new members by the Morgantown Police Department, the question was raised whether the MPD was willing to provide such an orientation. It was decided that Rich would contact Chief Eric Powell to obtain an answer to this question. The Meeting was adjourned at approximately 1:30 p.m. with a decision to schedule another Special Meeting to discuss Bylaws on October 4, 2023 with Bob to prepare a new draft based on changes suggested at this Meeting and the Special Meeting previously held on August 9, 2023.
