MORGANTOWN PLANNING COMMISSION MINUTES 6:30 p.m. February 11, 2021 By Electronic Means COMMISSIONERS PRESENT: Peter DeMasters, Carol Pyles, Tim Stranko, William Blosser, Bill Petros, Ronald Dulaney, AJ Hammond Bill Petros and Sam Loretta. COMMISSIONERS ABSENT: STAFF PRESENT: John Whitmore, AICP I. CALL TO ORDER/ROLL CALL: DeMasters called the meeting to order at 6:30 p.m. DeMasters with approval of all did not read the pre-meeting announcement. II. ELECTION OF OFFICERS: President and Vice-President. Blosser moved to re- elect the current officers. Shuman seconded. Vote was unanimous. III. MATTERS OF BUSINESS: A. Approval of the December 10, 2020 meeting minutes. Stranko motioned to approve as presented. Blosser seconded. Loretta and Hammond abstained. Vote was 7-0-2. B. 2020 Annual Report to City Council. John Whitmore discussed the annual report. During 2020 we were in the middle of the pandemic. Numbers were lower than 2019, but higher than they were in 2018. Whitmore asked if there were questions or changes to please email him the information so that we can present to City Council. Demasters complimented the experience that we have present on this committee. IV. UNFINISHED BUSINESS: None V. NEW BUSINESS: A. MNS21-01 / Bravo Rentals, LLC / 544 Melrose Street: Request by Misty Spiroff on behalf of Bravo Rentals, LLC for minor subdivision approval of property located at 544 Melrose Street. Tax District 12, Tax Map 14, Parcel 256; R-1A, Single-Family Residential District. Whitmore presented the staff report. Whitmore is representing the petitioner. Being no questions from the committee or the public during the public hearing, DeMasters asked for staff recommendation. MNS21-02 / Mandler / 500 Conn Street: Request by William Mandler for minor subdivision approval of property located at 500 Conn Street. Tax District 10, Tax Map 36, Parcels 263 and 264.1; R-1A, Single-Family Residential District. Whitmore presented the staff report. Petitioner is not on the call and Staff was not asked to represent but was available to represent the petition. DeMasters agreed with staff’s representation. Demasters opened and closed the public hearing, having no additional public comment. DeMasters asked for Staff Recommendation, provided by Whitmore. Loretta moved to approve with staff recommendations. Pyles seconded. Petros abstained from vote since he was late to the meeting. Vote was unanimous. C. MNS21-03 / Hollandsworth / 200 Logan Avenue: Request by Glenda Hollandsworth for minor subdivision approval of property located at 200 Logan Avenue. Tax District 10, Tax Map 36, Parcels 608, 609, 610, and 610.1; R-1A, Single-Family Residential District. Whitmore presented the staff report and noted that the applicant is present. Ms. Hollandsworth explained that she is trying to put the house and garage together on Logan Avenue, and the Sherman Avenue property would be separated and could be sold. She noted that the lot is being sold separately. DeMasters asked for staff recommendation. Stranko asked about the two recommendations and asked which Whitmore would endorse. Whitmore noted that the deed covenant language is from planning code and the other method is uses a survey plat. Ms. Hollandsworth noted she has had a plat prepared. Stranko motioned to approve based the subdivision with a completed plat in accordance with the staff report. Loretta seconded. Vote was unanimous. VI. OTHER BUSINESS A. Staff Comments: Whitmore mentioned a memorandum discussing a recommendation to City Council regarding changing the modification of video gaming or lottery establishment. Whitmore conferred through the City Attorney that the text is not slated to be changed. This meeting of the Morgantown Planning Commission is being conducted by electronic means consistent with the West Virginia Open Governmental Proceedings Act and the guidance of the West Virginia Ethics Commission due to the current State of Emergency given the outbreak of COVID-19. In order to mitigate the transmission of the virus and reduce risk of COVID-19 illness, we have been advised and directed to suspend public gatherings. In keeping with that direction, and the authority provided by the Open Governmental Proceedings Act and the Ethics Commission guidance allowing the conduct of public meetings by electronic means so long as the public is able to observe the meeting, this meeting is being conducted by remote electronic participation and in-person attendance by the public is not permitted. This meeting will include a public comment portion concerning matters not on the agenda and public hearings for each of the cases listing on this evening’s agenda. Members of the public will be permitted to comment during these portions by submitting comments in writing or by speaking during their designated time, if they have signed up to do so prior to the start of the meeting. Even if members of the public do not provide comment, participants are advised that people may be listening who do not provide comment, and those persons are not required to identify themselves. MATTERS OF BUSINESS: A. Approval of the November 12, 2020 meeting minutes. Motion and second to approve the minutes. Vote was unanimous. III. UNFINISHED BUSINESS: A. TX20-04 / Bucklew / Permitted Land Uses: Request by Robert Bucklew for Zoning Text Amendments to Articles 1329.02, 1331.05.01, and 1331.06(13), allowing “Video Gaming / Lottery Establishment” uses in the B-2, Service Business District. Demasters asked for a motion to remove this from the table. Motion by Dulaney, seconded by Stranko. Vote was unanimous. Whitmore noted that the Petitioner was present. Whitmore presented the Staff Report. Berryman noted that he had no comment on the Staff Report. Demasters asked if Mr. Berryman had any additional comments. Berryman noted that Bucklew would like to put something in this area that worked before. Berryman also noted that this location is very isolated and also noted there is adequate parking. Bucklew lives across the street. Berryman noted that Hot Spots are not very invasive, and that there are no schools or churches in the area. Demasters asked if members of the Commission had any questions. Demasters asked if there were any members of the public in favor or opposition of this. Demasters asked if members of the Commission had questions for the planner. Being none, Demasters asked for discussion. Stranko mentioned that it is important to remember that the petitioner is asking about this specific parcel, he states that this will apply throughout the City and the B-2, District. Stranko does not think this is in the best interest of the City to do this, and asked his colleagues to join him. Demasters asked for a motion. Stranko moved that the Planning Commission forward to City Council. Stranko asked if we need to specifically ask to deny the application. Demasters stated that the commission would need to ask to deny. Stranko amended his motion to include the President’s comments. Demasters asked for a second. Pyles confirmed we are voting to deny as well as the text changes. Demasters confirmed. Dulaney seconded. Whitmore asked to remove the former motion and suggested that vote in the affirmative to send a recommendation to deny. Demasters asked for a motion to withdraw the previous motion. Dulaney stated withdrawn. Demasters asked that we the commission deal with the application at hand. Stranko motioned we forward an application to forward to City Council that the application be denied. Pyles seconded. Vote was unanimous. Stranko made a motion to amend the text as provided in the staff report and established below: Seconded by Pyles. Vote was unanimous. IV. NEW BUSINESS: A. RZ20-05 / Bruceton Farm Service, Inc. / Unit Block of Brookhaven Road: Request by Howard Goodstein on behalf of Bruceton Farm Service, Inc. for a Zoning Map Amendment to reclassify multiple properties in the unit block of Brookhaven Road from R-1, Single-Family Residential District to B-2, Service Business District. Tax District 14, Tax Map 45, Parcels 5.2, 6, 7, and 7.4, R-1, Single-Family Residential District. The person that sent this correspondence is on the line now. Petros asked if there was any discussion with the county on their plan for the property. Whitmore noted that there are no reviews currently occurring in this portion of the county. Whitmore noted the other properties are residential. Stranko asked if we approve, would this be a development of significant impact or with development that may follow. Whitmore noted that the Division of Highways would have to evaluate traffic impact. Whitmore stated that the development plans review would depend on what BFS has planned. Whitmore noted that there is a lot of opportunity for this area given the size of the site. Stranko asked for more information on the DOH portion. Whitmore noted that the applicant would have to fill out an MM109 permit with DOH to establish access, which is a standard form with no fee associated. They would then look into the change of use as outlined in the building plan. Whitmore noted there would also have to be a traffic impact study since it would be going from residential use to business use. Stranko asked how the building permit process would connect with the DOH. Whitmore reviewed the building permit process. Demasters asked if the Petitioner was present. Howard Goodstein with BFS, clarified that they would have to apply for a highway occupancy permit which Mr. Whitmore referenced. This would include any highway improvements that would need to made. Goodstein noted that the site is a residential area but would probably never be used for this purpose because the bordering properties are commercial/mixed use. Goodstein noted that this is in an area which anticipates growth due to the proximity of the interstate. Demasters asked the committee for questions to the applicant. Being none, Demasters asked if there was any member of the audience that would like to speak in favor or opposition. Whitmore asked if the commission would like him to read a letter in opposition, previously provided to staff. Demasters noted that the person who has written the letter is on the call, but did not take the opportunity to speak, so he asked Whitmore to read the email. Whitmore read the letter into the record. Being no further comment, the public hearing was closed and Whitmore provided the staff recommendation. Stranko reminded his colleagues that the last time the City dealt with the DOH on Hartman Run Road, they recommended significant traffic upgrades at the intersection. Although he appreciates the public comment on traffic issues, he believes that the DOH will work to remedy the situation. Stranko recommends approval. Petros expressed that more of the property borders Brookhaven than Earl Core Road. Pyles feels that this is mainly the entrance to the Brookhaven neighborhood, and this would change that area. Dulaney discusses the reclassification and feels it is in line with the Comprehensive Plan. Dulaney does not see that this will ever be developed as residential use again. Petros states there are already a few houses on this plot of land, confirmed by Whitmore. Stranko stated that this property is obsolete as zoned R-1, District based on area growth. Whitmore confirmed that the property owners are working with BFS. Whitmore noted that one of the issues that this corridor neighborhood of Brookhaven is experiencing, that there is no land use planning occurring outside of the city, in the county. He stated this is something other city councilors have brought up regarding annexation such as in the Cheat Lake area. Whitmore stated the only thing that we can do currently is regulate this property that is not affiliated with unincorporated Brookhaven. Demasters noted that while BFS may have a deal to purchase this property, if we turn this down, they could purchase the property across the street without any issues. Demasters understands the traffic issues, but that is not unique to the City of Morgantown. Demasters thinks that since it is consistent with the comprehensive plan, he thinks this is something that should be done. Dulaney noted that this development may give incentive to make this DOH issue a higher priority. Stranko moved to approve the application. Shuman seconded. Vote was unanimous. VI. OTHER BUSINESS A. Small Area Plan – Future Study Area No. 5 The Current State of Urban Planning in the City of Morgantown The impact of the COVID-19 pandemic cannot be understated. For a period of approximately two months starting in mid-March, City of Morgantown administrative staff primarily worked from home as the crisis began. All in person meetings were cancelled and have not resumed, with limited exception. City of Morgantown revenues were instantly changed as commerce ground to a halt. Previously planned projects, including the revision to the Subdivision and Land Development Ordinance were paused. The Development Services Department in working with local, regional, state and federal agencies, has been able to adapt with minimal disruption. Development Services staff takes pride in facilitating community planning for the City of Morgantown and will continue to meet the professional demands required in this challenging time. 2020 Morgantown Planning Commission Page 1 of 6 Annual Report to City Council PC Meeting Page 14 of 36 February 11, 2021 Citizen Planners The success of local planning policies, programming, and services depends largely on the commitment and integrity of residents appointed by the Morgantown City Council to serve on various planning-related commissions, boards, and committees. Morgantown is fortunate to enjoy a well-informed public willing to serve in the role of Citizen Planner. The following status for each PUD is provided in accordance with Article 1357.03(D)(4)(c) of the Planning and Zoning Code. The Square at Falling Run, SC Bodner, Westminster House, and Beech View Place Planned Unit Developments were completed. Grand Central Apartments was originally approved in 2007 but rescinded by ordinance in 2010. Habitat for Humanity was originally approved in 2009 but rescinded by ordinance in 2012, and lands subsequently developed as single-family housing. Glen Ridge Apartments was originally approved in 2015 but rescinded by ordinance in 2017. These PUDs were rescinded because development was not initiated prior to respective Outline Plan Approval deadlines. City of Morgantown 2020-2022 Strategic Plan In December 2017, City Council finalized a strategic plan to serve as a road map guiding its vision toward implementing significant, measurable and attainable improvements. The Planning Commission and/or Development Services Department staff have direct or indirect roles in contributing to the following strategic goals and objectives. Attractive Amenities Objective 2 Create new public green spaces throughout the city by acquiring new property, revitalizing existing properties, and maximizing partnerships with private property owners. Identify blighted areas that could be repurposed into green space. UPDATE/STATUS – The Planning Division in working with the City of Morgantown Land Reuse and Preservation Agency (LRaPA), has actively evaluated properties in and around the downtown area. Additional focus on properties located in the City of Morgantown’s Qualified Opportunity Zones around the West Virginia University Downtown Campus. Cooperative Relationships Objective 2: Promote collaboration with and engage the Monongalia County Commission so that community issues and solutions have buy in from all locally elected officials. Create opportunities for city and county elected officials to meet to discuss common issues and develop solutions that have buy-in from both groups. UPDATE/STATUS – The Planning Division continues to contribute to the Morgantown- Monongalia Metropolitan Planning Organization (MMMPO) through active membership on its Transportation Technical Advisory Committee (TTAC). The Planning Division has partnered with the MMMPO to facilitate comprehensive planning processes on a regional, county, and urban level, with collaboration with the MPO, Monongalia County, the cities of Morgantown and Westover and the towns of Granville and Star City. The comprehensive planning efforts will begin in 2021. Excellent, Equitable City Services Objective 1: Create effective communication strategies that keep residents informed regularly and provide means to gain citizen feedback on projects and initiatives. Utilize technology to hone in on the appropriate audiences for neighborhood projects and initiatives. UPDATE/STATUS – The Planning Division working with the Communications Department has had success utilizing newer virtual meeting technology for meeting administration. These efforts have expanded opportunities for public participation in planning processes and will be vital for future planning efforts. Vibrant Downtown Objective 1: Facilitate programs that make our downtown more beautiful and clean. Create more green space downtown UPDATE/STATUS –2020 saw the completion of the Spruce Center Master Plan including a pocket park at the Morgantown Marketplace. Construction is projected to be completed in mid-2021. 2020 Morgantown Planning Commission Page 5 of 6 Annual Report to City Council PC Meeting Page 18 of 36 February 11, 2021 2021 Planning Work Program • Modernization of Subdivision Regulations – The Planning Commission and City Council completed the lengthy task of modernizing and codifying the City’s zoning regulations in 2006. The fundamental purpose of this endeavor was to implement progressive land use policies and strategies as well as comply with the State Legislature’s similar effort in 2004 to modernize the State’s Planning Enabling Law. Changes in State Code have created opportunities to streamline the review and approval of subdivision petitions. Incorporating these opportunities in Morgantown’s Planning and Zoning Code requires a major amendment to the City’s subdivision regulations. City Council allocated $75,000 in FY 2019 to complete this project. A related request for proposals was published in the first quarter of 2020 Calendar Year, with project completion anticipated within 9 to 12 months. The COVID-19 pandemic greatly affected this timeline. Staff now anticipates this project beginning in mid-2021. • 2023 Comprehensive Plan Update – In hopes of building on the collaborative success of the 2013 Comprehensive Plan Update process, City Administration began the process of securing multi-year funding commitments from the Morgantown-Monongalia Metropolitan Planning Organization (MMMPO), the Monongalia County Commission, and neighboring municipalities. This will align with the timing of the MMMPO’s next Metropolitan Transportation Plan (MTP) and publication of the 2020 decennial census data. • Small Area Studies – Strategies NH 1.2 and ED 5.7 of the 2013 Comprehensive Plan Update provides for the preparation and implementation of small area studies for 16 “Future Study Areas”, which are identified in Appendix A of the Plan. Future Study Area No. 7 has been designated by the Planning Commission as the next area to receive study. This project is anticipated to begin in early 2021. Development Services Department Staff Chris Fletcher, Director of Development Services since 2006 resigned from the City of Morgantown in September 2020 to begin employment with Urban Design Ventures, LLC. Mr. Fletcher was instrumental in developing and maintaining the City of Morgantown Planning and Zoning Code, review of all Planned Unit Developments in the City of Morgantown and contemporary Development of Significant Impact reviews. In addition to his work with the City of Morgantown, Mr. Fletcher aided the planning profession, as a long serving President of the West Virginia Chapter of the American Planning Association and as a member of the West Virginia Home Rule Board.
