MORGANTOWN PLANNING COMMISSION MINUTES 6:30 p.m. August 12, 2021 Council Chambers COMMISSIONERS PRESENT: Peter DeMasters, Carol Pyles, William Blosser, A.J. Hammond, Tim Stranko, Michael Shuman, Sam Loretta and Bill Petros COMMISSIONERS ABSENT: STAFF PRESENT: Rickie Yeager, AICP CALL TO ORDER/ROLL CALL: DeMasters called the meeting to order at 6:30 p.m. and DeMasters read the pre-meeting announcement. I. GENERAL PUBLIC COMMENTS: None. II. MATTERS OF BUSINESS: Approval of meeting minutes from May 13 and May 27, 2021. Motion made and vote was unanimous for both. Minutes approved. III. UNFINISHED BUSINESS: None IV. NEW BUSINESS: A. MNS21-06 / Hollandsworth / 200 Logan Avenue: Request by Glenda Hollandsworth for minor subdivision approval of property located at 200 Logan Avenue, Tax District 10, Tax Map 36, Parcels 608, 609, 610, and 610.1; R-1A, Single- Family Residential District. Yeager read the staff report and noted the petitioner was present. There were no comments from the audience in favor or opposition. STAFF RECOMMENDATION: Staff recommends approval of the subdivision either: A. By survey plat with the following conditions: 1. That the petitioner submits at least three (3) original final plat documents, including all access/utility easements, signed and sealed by a surveyor licensed in the State of West Virginia for the Planning Commission President’s signature; and, 2. That the final plat is recorded at the Monongalia County Courthouse within thirty (30) days of receiving the executed plat. By covenant restriction in accordance with Article 1363.02(B)(3) of the City’s Planning and Zoning Code with the condition that the petitioner place the following covenant notation on the recorded deeds for the subject parcels with the intention of creating two separate parcels (Parcels A and B as shown in the staff enhanced image on page 3 of this report) and submit a certification of its recording to the Planning Division: “For planning and zoning purposes, the lot described herein shall be considered as part and parcel of the adjacent lot owned by <Insert Owners Names> pursuant to deeds recorded at Deed Record Book No. <Insert Deed Book>, Page <Insert Deed Page> in the Office of the Clerk of the County Commission of Monongalia County. The real estate described herein shall not be considered to be a separate parcel of real estate for land use, development, conveyance or transfer of ownership, without having first obtained the expressed approval of the Morgantown City Planning Commission. This restriction shall be a covenant running with the land.” There was a motion to approve and a second, and the vote was unanimously in favor. B. MNS21-07 / McLaughlin / 448-450 East Brockway Avenue: Request by Sandra McLaughlin for minor subdivision approval of property located at 448 East Brockway Avenue, Tax District 10, Tax Map 35, Parcels 52 and 55; R-1A, Single-Family Residential District. Yeager read the staff report and noted the applicant is not present. No members of the audience were in favor or opposition. STAFF RECOMMENDATION: Staff recommends approval of the minor subdivision with the following conditions: 1. That the petitioner submits at least three (3) original final plat documents, including all access/utility easements, signed and sealed by a surveyor licensed in the State of West Virginia for the Planning Commission President’s signature; and, that the final plat is recorded at the Monongalia County Courthouse within thirty (30) days of receiving the executed plat; or, 2. MNS21-08 / Sheldon / 713 Park Street: Request by Kelsey Sheldon for minor subdivision approval of property located at 713 Park Street, Tax District 10, Tax Map 36, Parcels 653 and 654, R-1A; Single-Family Residential District. Yeager read the staff report and noted the petitioner requested staff to represent. No members of the audience were in favor or opposition. STAFF RECOMMENDATION: Staff recommends approval of the minor subdivision with the following conditions: 1. That the petitioner submits at least three (3) original final plat documents, including all access/utility easements, signed and sealed by a surveyor licensed in the State of West Virginia for the Planning Commission President’s signature; and, that the final plat is recorded at the Monongalia County Courthouse within thirty (30) days of receiving the executed plat; or, 2.
