WARD & BOUNDARY COMMISSION MEETING
Wednesday, November 19, 2014
City Hall – Council Chambers
PRESENT: Chairman Alan Donaldson, Commission members: Don West,
Cindy O’Brien, (City Clerk administered Ms. O’Brien’s Oath as the
2nd Ward Representative.) Steve Carpenter, William Ryan, Guy
Panrell, Roger Banks, Clerk Linda Tucker, and Assistant City
Engineer Damien Davis.
The meeting was called to order by Chairman Donaldson at 10:10 a.m.
APPROVAL OF MINUTES:
Motion by Commissioner Panrell, second by Commissioner West to
approve the minutes from November 12th, 2014 meeting.
PUBLIC PORTION:
There being no appearances, Chairman Donaldson declared the
Public Portion closed.
UNFINISHED BUSINESS:
A. City Attorney Steve Fanok response on Court Case (State
Of WV Cooper v. Tennant).
After discussion, motion by Commissioner Carpenter
second by Commissioner Panrell to accept Steve Fanok, City
Attorney’s opinion and ruling on his review of State of WV Ex Rel.
Thornton Cooper v. Natalie Tennant.et al. Motion carried by
unanimous consent. (Exhibit A Mr. Fanok’s opinion attached to
minutes).
B. Amendments from Ward members for map:
Damien Davis explained to the Commission the amendments to the
map, noting that the wards had not been updated since 1989. After
discussion, Chair Donaldson stated that the commission needed to
review the 4th and 7th wards again, because we have 2 people on City
Council this decision would affect. City Clerk, Linda Tucker
reminded the Chair that he must defer from talking about politics
and stay on the task and mission the Ward and Boundaries duties.
After discussion, motion by Commissioner Ryan review numbers again
in the 4th and 7th ward to equalize, second by Chair Donaldson.
Motion carried 5-2. (Banks & Panrell voted No.) Damien Davis
projected the map and registered voters for the commission to
review on the screen as various sections were reviewed and studied
by the Commission. After discussion motion by Chair Donaldson,
second by Commissioner Carpenter that the section with 207
registered voters be accepted into the numbers. Question was
called. Motion failed 4-3. (West, Ryan, Panrell and Banks voted No)
C. Review Voter registration data from November 4th General
Election:
Clerk reported that County Clerk is still getting caught up
from November 4th Election and will possibly have the numbers at our
next meeting. City Clerk asked Commission of availability of
having a work session on November 24, 2014 at 10am; to finish up
report for COW on November 25, 2014. By acclamation meeting
scheduled for November 24, 2014 at 10am.
D. Review and edit ordinance for presentation at COW
Meeting:
Commission will finish work on November 24th, 2014 as
stated above.
ADJOURNMENT: There being no further business, meeting adjourned by
unanimous consent. Time: 11:35 am
