Karr Councilmembers: Cathie Kelly, Council President Art Bruhn Salvatore Cortese Joan Goddard Nancy Verga Dennis Wagner Absent: None Present: Fred Knapp, Esq., representing Borough Attorney ITEMS FOR DISCUSSION Mayor Karr asked if anyone had any questions or comments for this Conference Session. Councilmember Verga spoke about the possible expansion of zoning in the B Districts and in the L-1 District in relation to fitness exercise studios, tattoo parlors and massage parlors. She also spoke about the possible expansion of restaurants and cafes in the B-4 Zone. Mayor Karr stated he will discuss these matters with her first and then there can be discussion with the Business Development Committee. He wants to provide background on the massage parlors. Mayor Karr requested Councilmember Verga to speak with the planner Liz Leheny. Councilmember Verga provided everyone with the environmental report prepared by Emilcott Associates in connection with the environmental impact of cannabis businesses and copies of feedback from two municipalities that presently have cannabis businesses. Councilmember Verga reported that there are maps in council chambers that need to be updated and the costs involved. The Borough Planner is recommending consideration of digital maps for the future – they will be easier to update and no printing is needed. However, there would be a cost for a projector and screen to use at meetings. She will research these costs. Mayor Karr said digital would be fine, but he also wants hard copies of the maps, too. He believes funds are in the budget for these costs. Councilmember Verga reported there were numerous emails to the Council and Mayor encouraging support for Pride Month. She provided commentary about this request, including inquiries from residents, a petition, the rainbow flag and comments from children in regards to the recognition of Pride Month by the Borough. Councilmember Goddard added her support for recognition of Pride Month and the various details that Councilmember Verga spoke in this regard. Cross discussion about support for Pride Month recognition. The consensus was that recognition be given to Pride Month by the Borough. Mayor Karr spoke about the rainbow flag and a petition that he had received, however, in the past he decided the only flags that would be flown on municipal property are the American flag, the POW flag and on some poles the Community of Caring flag. Ms. Cara Parmigiani, 8 Franklin Place, Morris Plains, spoke about Pride Month matters as well as her personal experiences being a member of the LGBTQ+ community. She emotionally stated her reasons for wanting the rainbow flag to be flown in the Borough. Councilmember Bruhn concurs with the comments made by Councilmembers Goddard and Verga and supports flying a rainbow flag out front. He thanked Ms. Parmigiani for her commentary. Councilmember Wagner agreed with Councilmember Bruhn’s comments and also thanked Ms. Parmigiani. Councilmember Kelly said she believes the resolution should speak for itself and does not think a flag display is needed. Ms. Parmigiani shared a quote from Elie Wiesel, author and Holocaust survivor. “We must always take sides. Neutrality helped the oppressor never the victim. Silence encourages the tormentor never the tormented.” While a resolution was passed last year, it was not known by the community at large, especially since there were no public attendees at that meeting. Mayor Karr stated this is the Council’s conference meeting and does not include a public comment portion. While Ms. Parmigiani was allowed to speak, all other comments will need to wait until the regular meeting. Councilmember Bruhn provided an update on work being done in connection with the re-opening of the Borough buildings. Cross discussion about the re-opening of the buildings. Friendly Sons of St. Patrick be granted permission to serve alcoholic beverages at a picnic to be held Saturday, May 29, 2021 from 12:00pm to dusk at Community Park Pavilion. Award of Contract 2021.01, Improvements to Grove Avenue to 4 Clean- Up, Inc. for their low bid of $171,972.00, subject to the Borough Attorney’s review of the bid documents. Award of Contract 2021.02, Improvements to Dogwood Road, Hillside Court West, Oakwood Court, Lindabury Lane, Freight Station Walkway and 555 Speedwell Avenue Parking Area to 4 Clean-Up, Inc. for their low bid of $265,558.00, subject to the Borough Attorney’s review of the bid documents. GREETINGS OF PUBLIC AND INVITATION FOR DISCUSSION Mayor Karr opened the meeting to the public for any discussion; he provided detailed information on how the public can participate. There were no e-mail comments/questions. Mr. Robert Lawson, 27 Hillview Avenue, Morris Plains, concurred with Ms. Parmigiani’s comments. He asked about the Planet Networks, Inc. resolution and what it may offer in connection with residential broadband. Mayor Karr said he does not know the details of this fiber-optic cabling; Mr. Hall said he will check this and try to answer Mr. Lawson’s question. Ms. Jessica Prater, 17 Rosedale Avenue, Morris Plains, said she, too, concurs with Ms. Parmigiani’s comments and provided some of her own. Ms. Amy Traver, 87 Glenbrook Road, Morris Plains, stated she also concurs with Ms. Parmigiani’s statement. Ms. Rebecca Higgins, 27 West Hanover Avenue, Morris Plains, also supports Ms. Parmigiani’s position. Ms. Pam Dellorto, 27 Hillview Avenue, Morris Plains, concurred with the statements of the other members of public. All members of the public who spoke support the flying of the rainbow flag. REPORTS OF COMMITTEES AND/OR DEPARTMENT HEADS Finance Councilmember Bruhn reported on the electric vehicle charging station and on the work being done by the Clerk’s Office. Councilmember Bruhn reported that Interviews were held for the part-time Clerk-Typist position in the Borough Clerk’s Office. Public Safety Councilmember Cortese yielded to Chief Koroski. Police Department’s Report Police Chief Koroski reported that the Police Department is planning for the upcoming Memorial Day Parade. Chief Koroski reported on the body- worn camera project and reported that the County will be replacing 4,800 portable and mobile radios at no cost to the Borough. Chief Koroski reported on Office of Emergency Management issues, including anticipated reimbursements. Chief Koroski recognized Emergency Medical Services Appreciation Week, thanking all the Morris Minutemen. Mayor Karr reported on an award given to Chief Koroski in Mount Olive in connection with being a witness and first responder to a serious accident where he performed life- saving techniques until EMTs arrived. Chief Koroski reported on details about this accident. Public Works Councilmember Wagner reported on projects the Department of Public Works staff are working on, including the Pool and the pump house. Councilmember Wagner reported on a recent Go Morris Plains meeting and updated on their activities. Councilmember Wagner reported on current work and plans of the Business Development Committee and spoke about a recent visit to Morris Plains by Mikie Sherrill. Mikie Sherrill was wonderful; had good ideas and information for the business owners, on the American Recovery Act and on the Restaurant Revitalization Act. Mayor Karr said this visit was last-minute, but it turned out to be a wonderful one on one time with Mikie Sherrill. Borough Engineer’s Report Mr. Hall reported on various development projects ongoing in the Borough. Mr. Hall reported on specific improvement work being performed by Department of Transportation (DOT) on the Route 53 right- of-way. Mr. Hall reported on the work done at the VFW regarding the cell tower. Mr. Hall reported on a pre-construction meeting with the general contractor (Harrington & Sons) at the Kohl’s shopping center in connection with the Uncle Giuseppe’s grocery store. The Littleton Road driveway will be entirely reconstructed so there will be a need for cooperation and coordination with the Police Department and Morris County. M & M is very anxious to secure a building permit for their affordable housing building. Public Buildings & Grounds Councilmember Kelly reported the Pool looks “really, really good.” Opening day is still to be determined. The Swim Team still has registrations available. Councilmember Kelly reported on a blood drive that will be held on Thursday, May 27th 2021. The last drive on May 8th had 70 donors, 15 of whom were new donors. Councilmember reported on Family Day and the fireworks. Mayor Karr said the Memorial Day Parade will be live streamed and there will be no gathering at the end nor handouts of any kind. Public Health, Sanitation & Sewers Councilmember Goddard reported that the Rabies Clinic will be held on Saturday, May 22nd 2021 at Community Park near the Pool parking lot. Forms are available on the website for registration. Councilmember Goddard reported on coyote sightings and tips for co-existing with them. Councilmember Goddard reported on the upcoming hazardous waste drop-off on Saturday, May 22nd 2021. Councilmember Goddard voiced strong support for Ms. Parmigiani’s request, concerns and the flying of the rainbow flag. Ordinance & Public Utilities Councilmember Verga reported on the new Borough website, including the new information-only Facebook page and on the cannabis business license ordinance. Councilmember Verga reported the first meeting of the cannabis working group was held Thursday, May 13th 2021 and listed the members of this group and reported on the work they have been doing. Councilmember Verga reported on the minor site plan ordinance that will be voted on later. Councilmember Verga reported on the yellow flags that are marking gas mains near the train underpass and spoke about the recent Planning Board meeting. Councilmember Verga strongly supported Ms. Parmigiani’s comments, requests and concerns and thanked everyone for their support. PRESENTATION OF COMMUNICATIONS, PETITIONS, ETC. Mayor Karr asked if anyone had any communications, petitions or anything else to present. Seeing no one he closed this portion of the meeting. INTRODUCTION OF ORDINANCES Councilmember Verga introduced the following ordinance and read the same by title and moved that it be passed on First Reading. ORDINANCE NO. 9-2021 AN ORDINANCE REVISING THE STORMWATER CONTROL ORDINANCE, SECTION 13-4.16 OF THE CODE OF THE BOROUGH OF MORRIS PLAINS Councilmember Kelly seconded the motion. Mr. Knapp advised of a correction to change “County of Union” to “County of Morris.” Mayor Karr announced that the meeting is open for a public hearing on the ordinance. Mr. Knapp advised of a change to Section 1, Paragraph 3. Date was changed – July 1, 2021 was changed to September 1, 2021.
