TOWN OF MOUNT PLEASANT, SOUTH CAROLINA BOARD OF ZONING APPEALS MAY 22, 2023 MINUTES STAFF REPORT Present: Stephen Wood, Chair, Giles Branch, Megan Stevens, Elliott Barrow, Aaron Butner, Julian Hopkins. Absent: Molly Hall (excused) Staff: Chris Swalhah, David Pagliarini, Lynnette Lynes Mr. Wood called the meeting to order at 6:00 pm. A. Approval of Agenda Mr. Butner moved for approval of the agenda. Mr. Branch seconded the motion. All in favor. B. Approval of Minutes Ms. Stevens moved for approval of the minutes. Mr. Branch seconded the motion. All in favor. C. Public Comment D. General Correspondence There being no comments or correspondence, Mr. Wood continued with the agenda. E. Explanation of Procedures F. Administration of Oath Mr. Wood reviewed the procedures with the public and administered the oath to those speaking. G. Business 1. Case V-16-23, 1078 Johnnie Dodds Boulevard, TMS #535-00-00- 141. Request for relief from the strict application of §156.140(D)(5) to allow improvements upon the existing nonconforming use; Board of Zoning Appeals May 22, 2023 Page 2 of 4 where the value of said improvements exceeds 50% of the property’s assessed value. Mr. Swalhah reviewed staff comments with the Board. Mr. Branch moved for deferral to the next meeting as the applicant is not present. Ms. Stevens seconded the motion. All in favor. 2. Case V-17-23, 754 Atlantic, TMS #532-06-00-097. Request for relief from the strict application of §156.111(A) to allow the existence of an Accessory Dwelling Unit before the construction of the Principal Dwelling. The ordinance requires principal structures/buildings to be in place before the construction of accessory structure/buildings. Mr. Swalhah reviewed staff comments with the Board. Ms. Alex Crosby and Mr. Davis Crosby, owners, reviewed the request with the Board. There being no comments, Mr. Wood moved to Board questions. Mr. Wood closed public comment. Ms. Stevens moved for approval with removal of the laundry room and porch to meet the 850 square footage requirement for an ADU based on the findings that the request meets the criteria as there are extraordinary circumstances as the home was built years ago and is 895 square feet and they want to build another structure and remain in the existing home during construction of the new structure; home is in good condition and they would like to maintain it as an ADU; there is no detriment to the public if approved; and the new structure would meet all requirements. Mr. Hopkins seconded the motion. All in favor. Board of Zoning Appeals May 22, 2023 Page 3 of 4 3. Case S-01-23, 1149 Russell Drive, Christ Our King, TMS #532-03-00- 040. Request for a Special Exception to construct an addition onto the sanctuary at Christ Our King in accordance with §156.326(C). Mr. Swalhah reviewed staff comments with the Board. Mr. Tony Woody, Thomas & Hutton, reviewed the request with the Board. There being no comments, Mr. Wood moved to Board questions and closed public comment. Mr. Branch moved for approval based on the findings that the request meets all criteria for the special exception. Mr. Hopkins seconded the motion. All in favor. 4. Case V-18-23, 813 Geddings Way, TMS #514-12-00-148. Request for relief from the strict application of 156.303(Table) to allow a 4-inch encroachment into the front setback. Mr. Swalhah reviewed staff comments with the Board. Ms. Meghan Hodapp, owner, reviewed the request with the Board. Mr. Byron Geddings, 464 Mathis Ferry Road, and previous owner of 813 Geddings Way, stated that the owners have been diligent owners and have followed their development plans. He suggested that the encroachment was not intentional and asked that the variance be granted. There being no further comments, Mr. Wood moved to Board questions. Mr. Wood closed public comment. Mr. Barrow moved for approval based on the findings that the plans were approved by the Town, approval would not be a detriment to the neighborhood, denial would prohibit use as it would mean deconstruction Board of Zoning Appeals May 22, 2023 Page 4 of 4 of the structure and the foundation being changed.
