Repik File REQUEST FOR CONSIDERATION (04/30/2018) To: Bids and Purchases Committee From: Kathy Frame, Assistant Procurement Officer Project Manager: Hillary Repik, Stormwater Division Chief SUBJECT: Snee Farm Drainage Improvements Construction Administration and Oversight BACKGROUND: The Town previously contracted with Woolpert, Inc., to provide consulting services for the Snee Farm watershed. This work included performing a comprehensive watershed assessment and developing final design drawings and documents necessary to solicit bids for the Town’s Snee Farm drainage improvements project. RECOMMENDATION: Staff requests approval of a change order to Woolpert, Inc.’s, existing contract to provide additional consulting services in the amount of four hundred eighty-one thousand, seven hundred and thirty and 00/100 ($481,730.00) dollars for construction administration and oversight of the Snee Farm drainage improvement project. cc: E. Jones Center Storefront and Lobby Area Request For Qualifications # 1718-109-RM BACKGROUND: The proposal opening was held on March 22, 2018, as scheduled with two (2) responses received from the following firms: Rosenblum Coe Architects, Inc. Stubbs Muldrow Herin Architects The three (3) member Selection Committee, made up of James Millar, Stacey Harrington and Molly Hubbard, all from the Recreation Department, reviewed the proposals. The criteria used by the Committee to evaluate the proposals were: interpretation of project and methodology and scope of services; similar project experience and performance; availability of and proximity of staff to site; professional qualifications and management capabilities; references of projects similar in design or application; demonstrated ability to complete projects similar in magnitude within the allocated time and budget; management techniques which clearly demonstrate quality control; and overall ability to prepare a brief, concise, meaningful response to the solicitation. On April 9, 2018, the Selection Committee met with procurement staff to submit their evaluations. Once the evaluations were tabulated and the results were reviewed by the Selection Committee, the Committee unanimously voted to submit a recommendation to the Bids and Purchases Committee that staff enter into negotiations with Stubbs Muldrow Herin Architects for this project. RECOMMENDATION: Based on the Selection Committee’s recommendation, staff requests permission to enter into negotiations with Stubbs Muldrow Herin Architects to provide professional services for the design of interior renovations of the Park West Pool Restrooms and R.L. Jones Center Storefront and Lobby area. Should the negotiations be successful, staff further request permission to contract with this firm. THE PLAN (cont.) • Starting on 14 May approximately 1000 cans will be collected and replaced per day. Absent: Peter Lehman, DeAudre Gregg (both excused) Staff: Jeff Ulma, David Pagliarini, Michele Canon, Liz Boyles, Austin Rutherford, Lynnette Lynes Mr. Wren called the meeting to order at 5:00 pm and welcomed Mr. Gates as newest Commission member. 1. Approval of Minutes from March 21, 2018 Meeting Mr. Millet moved for approval of the minutes. Mr. Neal seconded the motion. All in favor. 2. Update on Planning Commission Recommendations Ms. Canon reviewed Town Council decisions with the Commission. Mr. McNeill asked about the changes to the tree and buffer ordinances. Ms. Canon answered that the Planning Committee asked staff to make some additional changes. She stated that there would be continued discussion with the Planning Committee at the May meetings being held on April 30th. Mr. McNeill asked what concerns of the Planning Committee had. Ms. Canon answered that the Planning Committee wanted to see some changes to the buffer requirements and some changes on the species and size of protected trees. Mr. Neal asked about the Medal of Honor Museum. Ms. Canon answered that the Planning Committee deferred the request for 60 days. Mr. Neal asked if the request would come back to the Commission. Ms. Canon answered that if there are significant changes, there is the possibility that the request would come back to the Commission for an additional public hearing. 3. Staff Update on the 2018 Comprehensive Plan Process Ms. Boyles updated that Commission on the Comprehensive Plan update process. She stated that the next forum meeting would be held on May 1 st. She stated that there would be an additional open house on June 5th and would focus on LRTP and land use issues. Mr. McNeill asked about financial resiliency. Ms. Boyles answered that it refers to long-term financial implications on the recommendations within the Comprehensive Plan. She stated that one issue is how the Town would maintain financial stability as the growth of the Town slows. Mr. Wren asked about the Long Range Transportation Plan (LRTP) and how this would be handled. Ms. Boyles answered that it is a separate plan being completed in conjunction with the Comprehensive Plan. She stated that because of the land use implications, the LRTP logistically is completed after the Comprehensive Plan. Mr. McNeill asked about the timeframe for approval of the Comprehensive Plan. Ms. Boyles answered that the plan will be drafted over the summer after the open house in June. She stated that once the draft plan is completed, another open house would be held and then the draft plan would go to the Commission for a public hearing and review. She stated that the Commission might need additional meetings to review the entire document. Ms. Smith agreed that there should be sufficient review time and suggested that any special meetings should be considered well in advance. Mr. Wren agreed. 5. Requests A. Case #R-10-18, Rezone two parcels from AB, Areawide Business District, to AB-2, Areawide Business-2 District. Also request to remove both parcels from the Hungryneck Boulevard-Venning Road Overlay District (HNB-VR- OD), located at 1124 and 1126 Venning Road Parcel ID (TMS No.): 558-00- 00-192 and 558-00-00-052 Mr. Rutherford reviewed the staff report with the Commission. Planning Commission April 18, 2018 Page 3 of 7 Mr. Neal asked about if the two adjacent roads are town roads and fully constructed and does Lacannon connect to Hungryneck Blvd. Mr. Rutherford answered that the roads are county roads and Lacannon does not connect to Hungryneck Blvd. He stated that both roadways are not fully constructed. Ms. Smith asked how the violation was determined. Mr. Rutherford answered that it was determined through a windshield survey of the property. Ms. Smith asked if there have been any neighborhood complaints. Mr. Rutherford answered in the negative. Ms. Smith asked how long the violation has occurred. Mr. Rutherford answered that based on aerial photos, it appears the violation has occurred for the past couple of years. Mr. Millet asked if the construction business was located on the property when annexed. Ms. Canon answered that in reviewing the county tax records, it appears that there was an office use at the time of annexation. Mr. Millet asked when the HNB-VR-OD was established. Mr. Rutherford answered that it was established in 2006. Mr. Millet asked the reason for approval of the AB zoning. Mr. Rutherford answered that the AB zoning was consistent with the existing use of the property at that time. Mr. Millet asked what the underlying zoning is. Mr. Rutherford answered that it is AB. Mr. McNeill asked what is located adjacent to the property. Mr. Rutherford answered that it is an orthodontist office. Mr. McNeill noted that there are commercial uses surrounding this property. He stated that a special exception would be needed from the Board of Zoning Appeals (BOZA) for the outdoor storage. Ms. Smith asked about outdoor storage on some properties on the same road. Mr. Rutherford answered that the property is in the county. Mr. Gates asked if the submittal should be accurate and are considered legal documents. Mr. Pagliarini answered that staff reviews the submittal to determine if the application is complete. Mr. Greg St. Pierre, applicant, reviewed the request with the Commission. He stated that they are not opposed to remaining in the HNB-VR-OD. He stated that there have been no complaints from the neighbors on the current use of Planning Commission April 18, 2018 Page 4 of 7 the property. He stated that they are requesting the rezoning to bring the property into compliance. Mr. Neal asked if the reason for the request is because of a code violation. Mr. St. Pierre answered in the affirmative. Mr. Neal asked if there is a privacy fence around the property. Mr. St. Pierre answered in the affirmative and stated that there is an eight-foot privacy fence with landscaping. Mr. Neal asked how the property is accessed. Mr. St. Pierre answered that there is access from Venning Road and Lacannon Lane. Mr. Neal asked if the access is paved. Mr. St. Pierre answered in the negative and stated that it is a gravel road. Mr. Millet asked about the boat storage. Mr. St. Pierre answered that they allow boat storage in the overflow parking areas. Mr. Millet asked if they charge for the boat storage fee. Mr. St. Pierre answered in the negative. Mr. Neal stated that he is supportive of the request as it would bring the property into compliance. Mr. Millet asked about the removal from the HNB-VR-OD. Ms. Canon answered that staff explained the requirements of the HNB-VR-OD with the applicant prior to their submittal. She stated that because the request does not meet the intent of the HNB-VR-OD, staff recommended not including the property in the HNB- VR-OD; however, there is nothing in the overlay provisions that would prohibit the applicant from conducting the business as it is if it were to remain in the overlay. There being no comments, Mr. Wren closed the public hearing. Ms. Smith expressed concern with AB-2 as it would allow self-storage units. Mr. Rutherford answered that self-storage would require a conditional use approval. Mr. Millet asked if there are restrictions on what type of storage is included in the special exception for the outdoor storage. Ms. Canon answered in the negative and stated that the special exception would be tied to a site plan and a specific use. Mr. Rutherford answered in the affirmative and stated that the overlay does restrict commercial building size to 15,000 square feet. Mr. McNeill asked if a special exception and DRB approval would still be required. Mr. Rutherford answered in the affirmative. Mr. Gates asked if the uses would be restricted according to the corporate documents and the uses allowed under the corporate documents. Mr. Pagliarini answered that the zoning would be approved for the property and not the specific user or owner. The zoning would dictate the types of uses allowed. Mr. Millet moved for approval of the request. Mr. Neal seconded the motion. Mr. Wren asked if the property should remain in the HNB-VR-OD. Mr. Millet withdrew his motion. Mr. Neal withdrew his second. Mr. Millet moved for approval of the rezoning request including all staff comments and denial of the request to remove the property from the HNB-VR- OD. Mr. Pagliarini clarified that this was initiated by Town Council. Mr. McNeill asked for clarification on the language “appears imminent”. Mr. Pagliarini agreed that this language is not clear and could be changed. Mr. McNeill asked if the excused absence would count toward the 75% attendance. Mr. Pagliarini answered that this is still to be determined, but once determined that the attendance has not been met, the Town Administrator would be responsible for notifying the commission member of their removal. Mr. Millet asked if the attendance would include special meetings. Mr. Pagliarini answered that the attendance pertains to all called meetings. Ms. Smith asked how many Commissioners have not met the 75% attendance to date. Mr. Pagliarini answered that he was not sure. Mr. Wren asked if the special meetings would be included and suggested that this could be problematic as these meetings are not regularly scheduled. He expressed concern that the special meetings are not advertised in advance and based on when scheduled could be a conflict with commission member work schedules. He suggested that it should be clarified who would keep track of the absences and suggested that the chair and a staff person should be responsible for tracking the absences. Mr. Pagliarini stated that this recommendation could be forwarded for consideration. Mr. McNeill suggested that the commission members should be notified when they are in danger of not meeting the attendance requirement. Mr. Cuttino asked when the ordinance would take effect. Mr. Pagliarini answered that this would need to be clarified by Town Council as to what the effective date would be and if it would apply retroactively. Mr. Gates suggested that attendance should be tracked by Human Resources. Mr. Neal asked if it is clarified what is considered attending a meeting. Mr. Pagliarini answered in the negative and stated that this is not clarified in the current ordinance. There being no comments, Mr. Wren closed the public hearing. Although not consistent with the then-current FLUM recommendation of ARC, Agricultural Residential Community, a precursor to the current CC designation, the properties were zoned Residential Office (OR) and General Office (OG), respectively, in Charleston County, and utilized for office/commercial uses. The HNB-VR-OD was applied during the annexation and zoning into the Town. 4. The properties have recently come to the attention of the Town Code Enforcement Officer regarding the use of the property in a manner that is not consistent with the current AB zoning. The existing use has outdoor storage associated with it, which requires AB-2 zoning and a Special Exception through the Board of Zoning Appeals. 5. Nearby properties are either zoned AB in the Town or are zoned R-4, Single Family Residential in the County, with most being included in the HNB-VR-OD. 6. (3) If removal for cause due to attendance appears imminent, the staff person appointed to represent the Commission shall contact the Planning Director, who shall report the information to the Town Administrator. (3) If removal for cause due to attendance appears imminent, the Town Administrator shall then remove that member from the Commission prior to the next scheduled meeting and notify Town Council. This allows an opportunity to enhance enforcement in the County areas and to also provide for greater consistency throughout the Town with enforcement. • The County would still permit all permanent signs. • The enforcement would only apply to prohibited signs. • To ensure consistency between both the County and Town ordinances, the County may amend the Mount Pleasant Overlay District in their Zoning ordinance to incorporate the Town’s prohibited sign ordinance. This would ensure that the Town is able to enforce the same ordinance throughout the entire Mount Pleasant area rather than enforcing two different sets of regulations. • The Town would handle enforcement of sign violations in the County as we do now in the Town. This process typically begins with a verbal warning followed by a written warning. If a ticket must be written, then the violation will be brought before the East Cooper Magistrate court, not the Town of Mount Pleasant. If the Committee supports this agreement then staff will begin coordinating with the County on the appropriate ordinance amendments and details associated with finalizing the agreement. Telephone (843) 884-8517 - Fax (843) 856-2180 www.tompsc.com ORDINANCE NO. _____ STATE OF SOUTH CAROLINA ) ORDINANCE AUTHORIZING THE ) ISSUANCE OF A NOT EXCEEDING COUNTY OF CHARLESTON ) $10,000,000 STORMWATER UTILITY ) SYSTEM REVENUE BOND, SERIES TOWN OF MOUNT PLEASANT ) 2018 OF THE TOWN OF MOUNT ) PLEASANT, SOUTH CAROLINA ARTICLE I RECITALS BE IT ORDAINED by the Town Council of the Town of Mount Pleasant, South Carolina, in meeting duly assembled: WHEREAS, by ordinance (the “Master Bond Ordinance”) enacted November 15, 2017, the Town Council of the Town of Mount Pleasant, South Carolina (the “Council”), the governing body of the Town of Mount Pleasant, a municipal corporation located in Charleston County, South Carolina (“Mount Pleasant”), established the terms and conditions under which Mount Pleasant may, by ordinances supplemental to the Master Bond Ordinance, issue revenue bonds payable both as to principal and interest from the revenues to be derived from the operation of the stormwater utility system of Mount Pleasant (the “System”); WHEREAS, Mount Pleasant finds it necessary make improvements to the Snee Farm stormwater rehabilitation system component of the System (the “Project”), the estimated cost of which, including interest during the construction period, is not exceeding $10,000,000; and WHEREAS, Mount Pleasant is a municipality created pursuant to the laws of the State of South Carolina and is empowered by the provisions of Title 48, Chapter 5, Code of Laws of South Carolina 1976, as amended (the “Act”) (i) to undertake a water pollution control project as defined and approved pursuant to the Federal Clean Water Act, 33 U.S.C.A. subsection 1381 et seq.; (ii) to make application for and to receive assistance; (iii) to comply with regulations relating to the receipt and disposition of money of the State Water Pollution Control Revolving Fund created by the Act; (iv) to apply for and receive state grants; (v) to enter into loan agreements; and (vi) to comply with all terms and conditions of any loan agreement; and WHEREAS, the Council has heretofore authorized application to the South Carolina Water Quality Revolving Fund Authority (the “State Authority”) for a loan from the State Water Pollution Control Revolving Fund created by the Act (the “Loan”), to provide for the financing of the Project; and WHEREAS, the State Authority upon review of Mount Pleasant's loan application conditionally approved the Loan; and WHEREAS, the funds are loaned and secured pursuant to a loan agreement (the “Loan Agreement”) between Mount Pleasant and the State Authority, and a promissory note executed and delivered by Mount Pleasant registered in the name of the State Authority (the “Note”). Pursuant to the Loan Agreement Mount Pleasant will agree to use the Loan proceeds only to pay the actual eligible costs of the Project, and Mount Pleasant will agree to pay to the State Authority such amounts as shall be required to provide for the payment of all amounts due with respect to the repayment of the Loan. To secure its obligations Mount Pleasant will grant to the State Authority a pledge of, and lien upon, all revenues derived from the operation of the System and all fund accounts from such revenues. Upon any failure of Mount Pleasant to make any payments to the State Authority pursuant to the Loan Agreement or the Note, the State Authority shall require the State Treasurer to pay to the State Authority, subject to the provisions of the Act, the amount from state appropriations to which Mount Pleasant may be or become entitled as may be necessary to provide for the payment of all amounts due with respect to the Note; NOW, THEREFORE, on the basis of the foregoing, the Council is adopting this Ordinance in order to: (i) authorize the execution and delivery on behalf of Mount Pleasant of the Loan Agreement and the Note; (ii) evidence the approval of the Project and the Loan by Mount Pleasant; and (iii) authorize the execution and delivery by, and on behalf of, Mount Pleasant of such other agreements and certificates and the taking of such other action by Mount Pleasant and its officers as shall be necessary or desirable in connection with the financing of the Project in order to carry out the intent of this Ordinance. ARTICLE II ISSUANCE OF BOND; THE LOAN Section 2.01 (a) Pursuant to the terms of the Master Bond Ordinance and in order to defray the cost of the Project, there shall be issued a not exceeding TEN MILLION and no/100 ($10,000,000) DOLLARS Stormwater Utility System Revenue Bond, Series 2018 of the Town of Mount Pleasant, South Carolina, in the form of the Note hereinabove described. The exact principal amount of the Note, its date of original issue, interest rate and repayment provisions shall be determined pursuant to the Loan Agreement. Section 2.02 The Council hereby authorizes Mount Pleasant's acceptance of the Loan from the State Authority in the amount of not exceeding $10,000,000, pursuant to and in accordance with the provisions of the Loan Agreement. Section 2.03 The Council hereby authorizes the repayment of the Loan by Mount Pleasant to the State Authority from revenues of the System or, if such revenues are not sufficient, from state appropriations as Mount Pleasant may become entitled to, pursuant to and in accordance with the provisions of the Loan Agreement and the Note. 2 (Ord. ______) ARTICLE III LOAN AGREEMENT AND NOTE Section 3.01 The Loan Agreement, with the Note attached thereto, in substantially the form attached hereto as Exhibit “A”, with such changes as the executing officers shall approve (the execution to be conclusive evidence of such approval) is hereby approved, and the execution and delivery of the Loan Agreement and the Note on behalf of Mount Pleasant are hereby authorized and directed. The Loan Agreement and the Note shall be executed on behalf of Mount Pleasant by the Mayor of the Town of Mount Pleasant and attested by the Clerk of Council of the Town of Mount Pleasant. ARTICLE IV MISCELLANEOUS Section 4.01 In order to implement the Loan pursuant to the Loan Agreement and Note and to give full effect to the intent and meaning of this Ordinance and the agreements and actions herein authorized, the Mayor, Chief Financial Officer and Clerk of Council of the Town of Mount Pleasant are hereby authorized to execute and deliver such certificates, showings, instruments and agreements and to take such further action as the Mayor, Chief Financial Officer and Clerk of Council shall deem necessary or desirable. Section 4.02 This Ordinance shall be a contract between Mount Pleasant and the State Authority and shall be enforceable as such against Mount Pleasant. Section 4.03 This Ordinance shall become effective upon receiving approval on second reading by the Council. ARTICLE V MASTER BOND ORDINANCE AS MODIFIED TO REMAIN IN FULL FORCE AND EFFECT Section 5.01 As supplemented herein, the Master Bond Ordinance remains in full force and effect and shall govern the issuance of the Note.
