Ms. Landing called the meeting to order at 11:13 a.m.
1. Approval of Minutes from the August 5, 2019 meeting
Mr. Crosby moved for approval; seconded by Mr. Bustos. All present
voted in favor.
2. Public Comments
G. M. Whitley, 809 Post Oak Drive, addressed the agenda item
pertaining to FOIA (Freedom of Information Act) Compliance and the
Mayor’s Business and Economic Development panel. She explained a
string of emails between Council members and stated that she initially
thought this was a legal issue and suggested that it be placed on the
Police, Judicial and Legal Committee; however, Mayor Haynie suggested
that it be placed on this Committee agenda as a subject matter. She said
that although the Mayor’s panel was convened without a vote from Town
Council, she believes he was within his purview to create the panel as has

been done in the past with the Shem Creek Taskforce. She also believes
that the Mayor created this panel with the best intentions for the
betterment of our Town. She also expressed a hope that in the future all
Town Council members are afforded an opportunity to observe these
meetings, especially since the Mayor stated in his recent editorial in the
Post and Courier that he has tasked this panel with drafting a Strategic
Economic Development Plan for the Town which could have a great
impact on upcoming decisions regarding our Town’s financial future. She
was informed that there have been four meetings of the panel thus far
and members of the Economic Development Committee were invited and
she is not sure who has attended. She said in her emails she also
expressed concern about the lack of an executive session on this issue on
the agenda as it is a legal question and in the absence of an ability to
receive legal advice in executive session, she asked the Town Attorneys
to prepare a memorandum on the issue along with a suggested course of
action should any be necessary.
Kevin Cunnane, stated that he raised this issue with Council in the
last week or more, which is the same issue Council member Whitley just
addressed. He said he read in the newspaper about this panel to create a
plan. He said the members of this panel are impressive. He asked for the
minutes of the discussions and was advised that minutes were not
recorded. He also asked for a list of the meetings and agendas. He said he
discovered that four meetings have already taken place. He said the last
meeting was in May and wondered if this was more of a public relations
item or an economic development item. He said this is what raised his
suspicion. He added that he did some legal research and said there is a
case of Quality Towing vs. The City of Myrtle Beach and it is very clear
that any body that is created to provide input to a public official or a
public body is subject to FOIA laws. He said the responses to emails were
offensive just because a case law was brought up that was direct and
from the State Supreme Court. He said a body such as this (Economic
Development panel), should be subject to FOIA just as the Shem Creek
Taskforce was. He said there were deflections attempting to blame him
personally for creating issues; however, the fact of the matter is that the

panel is subject to FOIA. He said we can own up to it and admit that the
Mayor’s panel on Economic and Business Development needs to be
reworked in order to comply with the law. He stated that the public is
entitled to know what is going on.
3. Discussion of Harbor Accelerator
Patrick Bryant, 665 Johnnie Dodds Boulevard, stated that he wanted
to provide information regarding the Harbor Entrepreneur Center (HEC)
and its work. He said the HEC is a 501c3 non-profit created in the Town
six years ago when the Town had an incubator space that was not
producing the results the Town wished. He said ultimately the HEC ended
up creating a non-profit that services the entire entrepreneurial spectrum
in all of the Charleston region. He wanted to ensure that the Committee
was aware that the effect of the HEC is vast and critically important to
the Town of Mount Pleasant. He said it surpasses any amount of results
that were ever produced by any incubator in the Town of Mount
Pleasant, ever. He said the Harbor Accelerator, which is one component
of the HEC has helped launch 87 businesses into the Charleston market
and each of those businesses has one to two leaders behind them who
have been trained on entrepreneurship through the accelerator program.
He said it is free and provides them free space, free curriculum, free
mentorship and many resources to connect with investors. He said the
accelerator is an amazing product that is helping Charleston’s
community. He said they also have a forum program that takes
entrepreneurs that already have a business with three or more
employees, along with $250,000 in revenue and connects them with
other forum members so this group is comprised of many people that live
and work in Mount Pleasant. He said they are helping those existing
business owners grow the Town’s entrepreneurial economy whether
there is a site in Mount Pleasant or not. He said he would also like to
echo a new program that was just integrated this year, which is the JRS
Coding School. He said this school takes anyone, with the average age
being 25 years old, and trains them to code computer skills that the tech
companies need. He said of the first cohort that graduated, there were

eight students, five of which were hired within one week of the end of
their expo, making more than $50,000 a year. He said they were ex-
military, a firefighter, a weatherman, and many who are being retrained
in computer skills and then put into the tech economy, which is one of
their number one issues as entrepreneurs. He said this is the impact the
HEC is making on the economy. He said finally, he would like to discuss
the network effect of the HEC, which is far beyond an incubator space,
forums and their programs. He told the story of Rich Estes who created a
business called “Home Tracker”. He said because of the Harbor, one of
the individuals he met went on to work on Home Tracker for a little
longer and then closed it. He said they both continued on and together
found “Punch List”, which is now in the Town of Mount Pleasant with
over 20 employees, which all happened through the Accelerator. He said
this is entrepreneurial network affect, which is what they do. He said he
would like to complete his presentation with their request of this
committee. He would like to ask this Committee to make a five year
commitment for a Harbor Entrepreneur Center site in the Town of
Mount Pleasant. He said they began here in one of the Town’s sites and
would like to have a site here once again. He said they would like to
request a five year commitment of $50,000 per year, which would allow
them to rent a facility, operate all of their programs out of that facility
and be located here in the Town providing incubator space to businesses.
He said the #1 problem in entrepreneurship is that if they are in a
position to start a business and want to do so in the corridor of Mount
Pleasant, you need to be renting 1,000 square feet and have a five year
lease. He said they are unable to do this, because it is not how start-ups
begin. He said instead, they are going to begin these start-ups elsewhere
where those opportunities exist. He said this then looses the Town of
Mount Pleasant’s ability to recruit and make entrepreneurship happen in
this corridor. He said with this space, they will be able to offer those
programs in addition to renting that space and filling that need. He
presented the following.

Mr. Crosby asked how much space was needed.
Mr. Bryant stated between 5,000 and 10,000 square feet. He said they do
have a space at this time at 65 Gadsden Street near MUSC that is 10,000
square feet and is operating very well. He said they will need at least
6,000 square feet to do programmatic activity and also rentable office
spaces to all the entrepreneurs.
Mr. Crosby asked about their timeline.
Mr. Bryant said their goal would be sometime in 2020 to launch the
center in Mount Pleasant. He said they came before the Finance
Committee earlier in the year. He said they need to secure a five year
rental term in order to make this work.
Mr. Bustos asked what the funding will be used for.
Mr. Bryant said it will be used for the operation and maintenance of that
particular facility; directly to provide incubator space to start-ups and
have programmatic space.
Mr. Bustos asked how Mr. Bryant came up with $50,000 per year.
Mr. Bryant stated that it is to support the base rent of the facility. He said
this is the amount needed to rent this space in the urban corridor; and
not a class A office space.

Mr. Bustos asked if any of the funding would be used for salaries.
Mr. Bryant responded in the negative. It would be used to fund the rental
of a space. He said they started in a space that the Town provided, which
is why they stayed with that model.
Mr. Bustos asked at what point this would be taken into the budget
process.
Mr. DeMoura stated that for most items, staff attempts to make it part of
the budget process which begins in February; however, there have been
several adjustments to the budget post July 1st that have occurred. He
stated that if Council wishes to do so, it should go to Finance Committee
to identify funding along with other priorities and if the decision is to
move forward at the Council level, then the adjustments will be made.
Mr. Bustos stated that he would rather it enter the budget process at the
time the budget is being considered.
Mr. Bryant stated that this is why they started with the Economic
Development today. He said they currently have a site in downtown
Charleston and are working on a site in North Charleston and would like
to have a site in Mount Pleasant.
Mr. Bustos asked if Mr. Bryant is requesting this to go to the Finance
Committee.
Mr. Bryant responded in the affirmative.
Ms. Landing thanked Mr. Bryant for illustrating the impact that the HEC
has been making. She said as a Town, Council members recognize that
one of our most important jobs is to bring jobs to Mount Pleasant and
preferably higher paying jobs that help those afford to live on this side of
the bridge in order to shorten car trips to lessen traffic. She said it is a
focus area. She said the Town is currently working on a project that will
encompass high tech. She would like to suggest this go to Finance in
November. She asked if the coding school requires a college degree.
Mr. Bryant responded in the negative. Generally speaking the program
lasts approximately 12 weeks and most come in knowing a baseline of

JavaScript. They then go through the course which is from 9 am to 5 pm
for 12 weeks and at the end, they are ready for a $50,000 per year job.
Ms. Landings stated that high school students in the advanced studies
program could be prepared to go into this coding school.
Mr. Bryant stated that this has already happened. He said he would like
to acknowledge that this is mostly an adult program, but students may go
directly through the program. He stated that he operates a software firm
and hiring people is their #1 struggle.
Mr. Crosby stated that if $50,000 a year is too much for the Town, do
they have other sources to make up the difference.
Mr. Bryant stated that they could leverage local corporations, if they
were specifically Mount Pleasant backed corporations.
Mr. Crosby stated that the HEC came before the Town previously and
asked if the Town provided seed monies.
Mr. Bryant responded in the affirmative.
Mr. DeMoura stated that the Town has provided $255,000 over the last
five years.
Mr. Bryant stated that in the last two years there has been no funding at
all.
Ms. Landing stated that the mentors mentioned are very interested in
seeing Mount Pleasant bring high paying jobs to the Town and suggests
that Mr. Bryant speak to the Finance Committee next month.
Mr. Bryant introduced Daniel Stern, the executive director of the Harbor
Entrepreneur Center. The former executive director is doing very well
and created Good Growth Capital that came directly from relationships
gathered from the HEC.
4. Discussion of and possible action with regard to the Mayor’s
Economic Development Advisory Panel and its compliance with the
Freedom of Information Act (FOIA)

Ms. Landing stated that after being appointed to chair the Economic
Development Committee, Mayor Haynie had a concept that he worked
on and did some research on and to her understanding, found that it was
possible to have a panel that was made up primarily of individual private
citizens. The purpose at that time was to allow people of all different
levels of work backgrounds, large and small, to have a free flow of brain
storming. She stated that Mayor Haynie did invite her to join the panel so
there would be someone working directly with economic development.
She has attended all four meetings and all the discussions have been
theoretical. She said they brought up certain concepts such as what
industries would fit well in a Town our size. She said there has never been
anything recommended to Council nor was there any intention to do so.
She said Mayor Haynie has never stated this and it has never been stated
in any of the meetings. She stated that this panel was comprised of a very
strong list of business professionals and was an opportunity for these
individuals to speak freely and have brainstorming sessions. She stated
that if this panel were to be made into a Committee format and be
subject to FOIA, then it would take away the spirit of the corporate and
business owners being able to speak freely.
Mayor Will Haynie stated that the first time he mentioned this idea to
Council was in his State of the Town Address in June 2018 and had he
been advised what this panel had to do in order to comply with FOIA,
they would have done so. He said the same statute that Councilman
Cunnane mentioned earlier applies to any groups that receive any
funding in part or in total from a government body. He said if $50,000 is
given to the Harbor Entrepreneur Center, then their meetings under a
strict interpretation of the law would be public as well. He suggested
obtaining a comprehensive look at FOIA and its applications. He said he
has been part of meetings recently with Councilman Owens with Legal
Counsel present that was called an Ad-Hoc Committee where advice was
provided to the Town. He said no issues were raised that it was not in
compliance with FOIA. He added that he would be happy to do this
anyway it needs to be done; however, he cannot besmirch the names of
the business leaders and largest employers of the Town of Mount

Pleasant in an effort to play games on Council. He said the point is to
obtain economic development in the Town. He said these business
professional’s time is very valuable and they are not taking part in any
publicity or public relations. He said what came out of the group was that
the Town needs a comprehensive economic development strategy, and
this is what the Town will work towards.
Council member Kevin Cunnane, stated that with regards to non profit
entities, it is not the same as a body created by the Town to give advice
back to the public body. He provided an example of a case out of
Beaufort County. He said Quality Towing vs. The City of Myrtle Beach
clearly states that if the body is bringing information back to the public
body, then they are subject to FOIA because they become part of the
public body under the law.
Mr. Bustos stated that he is confused because there is a Council member
who is an attorney who is taking the place of the staff attorneys. He
asked if the Town is supposed to take legal advice from Mr. Cunnane or
Town attorneys that the Town pays to give legal advice. He said the Town
attorneys are present and this is wrong for a Council member to be
practicing law in front of Council members.
Ms. Landing stated that she is not aware that the Mayor’s Economic
Advisory Panel received funds.
Mr. Crosby stated that he anticipated that this group would go on for two
years or so and be purely strategic brainstorming. He did not foresee any
action coming from this group for an extended period of time. He said it
is ongoing and exceedingly informal, but it has been beneficial.
Ms. Landing stated that if she did not sit on this panel, there would only
be one Council member, which would be Mayor Haynie. She asked if a
private group of owners and business professionals from various
companies could come together on Town property without being subject
to FOIA.

Ms. Landing asked if the potential perceived issue is because there are
two Council members on the panel.
Mr. Pagliarini stated that the issue, should there be one, is solely related
to the purpose and intent of a gathering. He said any Council member
and perhaps all, have spoken in front of different groups for citizens. He
said the issue is whether the purpose and intent of that group is to
provide feedback and response, recommendations and the like. This is
where the line is drawn and what the difference is. He said to answer Ms.
Landing’s question, all of this would change if there is a quorum of a
Council or Committee which starts the discussion of whether there is
actually a public meeting.
Mr. Crosby stated that he believes the panel was merely an exchange of
ideas.
Mr. Bustos stated that the agenda indicates that this is a discussion and
believes a discussion has taken place and recommended moving on to
the next item.
5. Consideration of an economic development incentive grant

Mr. Bustos moved to go into executive session for the stated
purpose; seconded by Mr. Crosby. All present voted in favor.
Committee adjourned into executive session at 11:51 a.m. and
reconvened at 11:58 a.m.
Mr. Bustos made a motion to recommend to full Council to
approve the economic incentive discussed in executive session;
seconded by Mr. Crosby. All present voted in favor.

4. Review of Planning Commission recommendations from the August 21,
2019 meeting
a. Proposal to amend Zoning Code Section 156.007, Definitions, by
adding “Story, Half (1/2)” as a definition; Amend Zoning Code
Section 156.313, Old Village Historic District, by modifying the
boundaries of the district to do the following: i) adding a map to
graphically depict the boundaries of the district; ii) prohibiting
roofed structures on docks; iii) redefining the calculation for
impervious lot coverage and building area ratio to only include high
ground; iv) providing clarification on the location of accessory
structures; and v) permitting required off-street parking to park in
tandem and encroach within required yard setbacks. Also amend
Zoning Code Sections 156.430, 156.431, 156.432, and 156.433, which
provide for the Organization, Definitions, Power and Duties, and

Procedures of the Old Village Historic District Commission, and
elsewhere within Chapter 156, to do the following: i) rename the Old
Village Historic District Commission as the Historic District
Preservation Commission; ii) clarify the requirements of membership
for the Commission; iii) clarify the duties of Town staff; iv) add
Freedom of Information Act requirements; v) change the date for the
consideration of historic properties and structures from 1936 to a
rolling fifty (50) years; vi) clarify their certificate of appropriateness
oversight; vii) clarify requirements for requests for demolition; viii)
clarify the Vested Rights for previous approvals; ix) change and
clarify the requirements for applications to the Commission; and x)
clarify the requirements of municipal and public utilities.
5. Review of Planning Commission recommendations from the September
18, 2019 meeting
a. R-21-19: 1190 Shadow Drive. Request to rezone one parcel from OP,
Office Professional District, to AB-2, Areawide Business-2 District.

b. R-22-19: North Highway 17 and South Morgans Point Road / Lowes
Home Improvement Center. Request to amend the Oakland
Plantation PD, Planned Development District Ordinance (Ordinance
No. 04014, as amended) pertaining to the treatment of signs on five
certain development parcels identified on the Sign Exhibit by
proposing an additional 150 square foot monument sign on Highway
17, and classifying two existing legal nonconforming signs to be
conforming.
c. R-23-19: 1432 Hale Road / Rifle Range Road / Hale Road. Request to
amend the Central Mount Pleasant PD-MU-SU, Planned
Development-Mixed Use Suburban-Urban District Ordinance
(Ordinance No. 07030, as amended), by rezoning an approximately
1.99 acre parcel from R-1, Low Density Residential District, and
incorporating it into the PD as part of the School Tract. TMS No. 560-

d. Zoning Code Text Amendment: Proposal to amend Paragraph (3) of
section 156.102(A), of Chapter 156, Zoning Code, of the Mount
Pleasant Code of Ordinances pertaining to the height of certain
structures. Proposed changes include making the list of exclusions

suggestive as to like-kind items, rather than definitive and mutually
exclusive.
e. Zoning Code Text Amendment: Proposal to amend Paragraph (1) of
section 156.107(A), of Chapter 156, Zoning Code, of the Mount
Pleasant Code of Ordinances pertaining to the encroachment of
certain accessory structures in setbacks. Proposed changes include
making the list of exclusions suggestive as to like-kind items, rather
than definitive and mutually exclusive.
f. Zoning Code Text Amendment: Proposal to amend the Building
Permit Allocation Ordinance (Ordinance No. 18097), to increase the
number of Accessory Dwelling Unit (ADU) permits from 10 to 25
permits annually, with these additional 15 permits coming out of a
reduction to the single family residential dwelling allocation.
6. R-20-19: 1218-1220 Schirmer Avenue. Request to rezone one parcel
from NC, Neighborhood Commercial District, to R-1, Low Density
Residential District. Subject parcel is proposed to remain in the BOD,
Boulevard Overlay District. TMS No. 532-07-00-142
7. Continued discussion of building heights in the Johnnie Dodds and
Chuck Dawley portions of the Boulevard Overlay District
