TOWN OF MOUNT PLEASANT, SOUTH CAROLINA PLANNING COMMISSION OCTOBER 18, 2017 DRAFT MINUTES Present: Joseph Wren, Chair, Roy Neal, Kathy Smith, Alys Campaigne, Tripp Cuttino, Peter Lehman, DeAudre Gregg. Absent: John McNeill, Rodly Millet. Staff: Jeff Ulma, Lee Cave, Kent Prause, Michele Canon, Lynnette Lynes Mr. Wren called the meeting to order at 5:00 pm. 1. Approval of Minutes Mr. Neal moved for approval of the minutes. Ms. Campaigne seconded the motion. All in favor. 2. Update on Planning Commission recommendations Ms. Canon reviewed the Town Council decisions with the Commission (attachment 1). 3. Correspondence and Public Comments There being no comments, Mr. Wren continued with the agenda. A. Request to rezone from R-1, Low Density Residential District, to CC, Community Conservation District., located at 301 7th Avenue, Scanlonville. TMS # 514-00-00-032 Mr. Prause stated that the applicant would like an opportunity to meet with the neighborhood and would like to request a deferral to the next meeting. Mr. Neal asked if the staff comments and applicant presentation can be heard at next month’s meeting. Mr. Pagliarini answered that the public hearing can be opened and kept open to the next meeting or the entire issue can be deferred. Mr. Neal moved for deferral of this issue to the next meeting. Ms. Smith seconded the motion. All in favor. Planning Commission October 18, 2017 Page 2 of 8 B. Request approval of Sketch Plan for Schirmer Avenue Subdivision, four single family residential lots zoned R-1, Low Density Residential District, and UC-OD, Urban Corridor Overlay District, located at 1238 & 1242 Schirmer Avenue. TMS # 532-07-00-138 Mr. Bernard reviewed staff comments with the Commission (attachments 1 & 2). Mr. Neal asked if the request is to subdivide the property into four lots. Mr. Bernard answered in the affirmative. Mr. Neal asked what the density is for the property. Mr. Bernard answered that it would be 16 units per acre since it is in the UC-OD. Mr. Neal asked about drainage for the area. Mr. Mitchell answered that there is a sizable ditch and showed it on the map for the Commission. He stated that the onsite drainage would be handled through that detention system. Mr. Pagliarini stated that he received correspondence from Coen Company, LLC dated October 18, 2017, and read it for the record. Mr. Eric Draper, representative for the applicant, reviewed the request. Mr. Neal asked if the trees recommended for preservation would be saved. Mr. Draper answered in the affirmative. Mr. Neal asked how access would be handled with the shared driveway. Mr. Draper answered that it would be a one- way drive. Mr. Neal asked about drainage. Mr. Draper answered the drainage plan has not been finalized. Mr. Neal asked if the applicant was amenable to the interconnectivity. Mr. Draper answered in the affirmative. Mr. Wren asked if the existing structures would be removed. Mr. Draper answered in the affirmative. Ms. Smith moved for approval of the request including all staff comments. Ms. Smith thanked staff for their specific comments. Mr. Wren called for a vote on the motion. All in favor. C. Request approval of Sketch Plan for Hamlin Road Subdivision, two single family residential lots zoned CC, Community Conservation District, and SB- Planning Commission October 18, 2017 Page 3 of 8 OD, Sweetgrass Basket Overlay District, located at 1271 Hamlin Road. TMS #578-00-00-195. Mr. Mitchell reviewed staff comments with the Commission (attachments 1 & 2). Mr. Wren asked if only one access would be allowed from Hamlin Road. Mr. Mitchell answered in the affirmative. Mr. Neal asked about sidewalks. Mr. Mitchell answered that sidewalks are only required on one side of the road. Mr. Doug Berringer, representative for the applicant, reviewed the request with the Commission. Mr. Neal asked if sidewalks could be installed on both sides. Mr. Berringer answered that he would be amenable to having sidewalks on both sides of the road. Mr. Neal moved for approval of the request including all staff comments with addition of sidewalks on both sides of roadway with the permission from SCDOT. Ms. Campaigne seconded the motion. All in favor. D. Request approval of Sketch Plan for Lieben Forest Subdivision, 18 single family residential lots zoned R3, Medium Density Residential District, located on Lieben Road. TMS # 614-00-00-025 Mr. Mitchell reviewed staff comments with the Commission (attachments 1 & 2). Mr. Wren asked the width of the open space behind the right lots. Mr. Mitchell answered that it is approximately 20 feet. Mr. Neal asked if all issues of concern have been addressed. Mr. Mitchell answered in the affirmative. Mr. Chris Young reviewed the request with the Commission. Planning Commission October 18, 2017 Page 4 of 8 Mr. Neal suggested that the open space behind the lots be deeded to the HOA. Mr. Young agreed and stated that there would be some trails within the open space as well. Ms. Smith commended the applicant for incorporating the Commission comments into the plan. Mr. Neal moved for approval of the request including all staff comments. Mr. Cuttino seconded the motion. All in favor. E. Request approval of Sketch Plan for Tupelo Row Phase 3, 20 single family residential lots zoned PD, Planned Development District, located at End of Triple Crown Court. TMS # 615-00-00-173 and -047 (partial) Mr. Mitchell reviewed staff comments with the Commission (attachments 1 & 2). Mr. Tim Cook, applicant, reviewed the request with the Commission. Mr. Neal asked which lots require the Land Development Regulation (LDR) waiver. Mr. Cook answered that lots 4-7 require a LDR waiver and showed them on the sketch plan for the Commission. Mr. Neal asked if there would be any trails. Mr. Cook answered in the affirmative and showed the locations of the trails for the Commission. Mr. Neal asked if the open space property could be placed in an HOA. Mr. Cook answered in the affirmative. Mr. Neal asked if Mr. Cook is amenable to all staff comments. Mr. Cook answered in the affirmative and distributed a plan (attachment 3) that addresses staff comments 5-8 to the Commission. Mr. Wren asked about the LDR waiver. Ms. Canon stated that the process changed last year regarding how LDR waivers are requested and the reason that the previous requests for this subdivision did not come before the Commission. Ms. Smith asked about staff comments 5-8. Mr. Cook reviewed these with the Commission. Planning Commission October 18, 2017 Page 5 of 8 Ms. Campaigne asked if Mr. Cook would be amenable to removing lot 18 to preserve the trees, have additional open space, better connectivity to the trail system. Mr. Neal agreed that the trees should be preserved. Mr. Cook asked if the parcel adjacent to lot 18 could be allowed to be developed and the interconnectivity removed. He stated because the adjacent property is not being developed, the interconnectivity is no longer required. Mr. Neal asked if interconnectivity is not required, could the proposed sketch plan be approved. Mr. Pagliarini answered that he was not sure that the sketch plan could be approved with that condition. Mr. Prause answered that if it was part of the planned development ordinance, then an ordinance amendment would be necessary. He suggested that the best course of action would be to submit a new sketch plan. Ms. Gregg asked about the connectivity and when it was approved. Ms. Canon answered that she would need to confirm whether it was part of the Bartone Tract request, which was not approved, or was a condition of the subject parcel coming into the Pepper PD. Mr. Pagliarini stated that the new submittal would have to be reviewed on its own merits. He stated that only requirements included within the planned development ordinance can be required and enforced. Ms. Campaigne moved for denial of the sketch plan and LDR waiver request. Mr. Cuttino seconded the motion. Ms. Campaigne stated that there have been several issues that need to be addressed, so she would like to see a different sketch plan. Mr. Neal stated that he is not concerned if there is connectivity with this property. Mr. Wren called for a vote on the motion. All in favor. F. Request to annex and zone TH, Townhouse District, an approximately 11.99 tract of land comprised of 77 parcels, located along Dingle Road, known as the Royal Palms Townhomes. Development is not proposed to be included in the SB-OD, Sweetgrass Basket Overlay District, located on Dingle Road. Mr. Wren asked if not being in SB-OD was a staff recommendation. Mr. Rutherford answered in the affirmative. There being no comments, Mr. Wren closed the public hearing. Ms. Gregg asked if there is precedent for projects completed in the County and then annexed. Mr. Prause answered that this is the first 75% annexation completed under the new system and requested within the last 20 years. Mr. Neal asked if they would have public water and sewer. Mr. Prause answered that they already have water and sewer. Ms. Smith asked if this would set a precedent for future townhome development in the area. Mr. Prause answered that it is possible to develop in the county and then annex into the Town. He stated that if the property is contiguous to the Town, they are required to annex in order to receive water and sewer service. Mr. Wren asked the reason for not taking ownership of the roadway. Mr. Rutherford answered that the roadway is not built to town or county standards; therefore, the roadway would remain a private road. Ms. Smith moved for approval including all staff comments. Ms. Campaigne seconded the motion. Ms. Gregg expressed concern with establishing a precedent by approving a non- conforming development. Ms. Campaigne stated that she appreciates the property not being included in the overlay district, so that the neighborhood character is maintained. Motion carried on a 6 to 1 vote, with Ms. Campaigne, Mr. Wren, Ms. Smith, Mr. Lehman, Mr. Neal, and Mr. Cuttino in favor; Ms. Gregg opposed. G. Proposal to amend Chapter 156 of the Mount Pleasant Code of Ordinances by adding new section 156.321 establishing an Impervious Surface Lot Coverage Overlay District (ISLC-OD) for certain residential properties located within the area described in the document entitled “Old Village Watershed Study – Phase One”, released August 2, 2017. Also proposal to amend Chapter 156 of Mount Pleasant Code of Ordinances, Section 156.313 establishing standards for determining impervious surface consistent with the new Section 156.321. Mr. Prause reviewed staff comments with the Commission (attachments 1 & 2). Ms. Campaigne asked the reason for the Shem Creek area not being included. Mr. Prause answered that it was not included in the study area. There being no comments, Mr. Wren closed public comments. Ms. Campaigne stated that this is a sensible remedy in addressing the stormwater. Ms. Smith agreed. Ms. Campaigne moved for approval including all staff comments. Mr. Neal seconded the motion. All in favor. H. Request approval of street names for streets located in The Grove at Carolina Park. Street names to include Classic Court, Hackberry Avenue and Prominent Way. Ms. Smith moved for approval of the street names as proposed. Mr. Neal seconded the motion. All in favor. 4. Staff Update on the 2018 Comprehensive Plan Process Ms. Boyles updated the Commission on the Comprehensive Plan process. She stated that the open house was held on Tuesday, Oct 17th and was well attended by the public. She stated that the same topics were presented to the public as was Planning Commission October 18, 2017 Page 8 of 8 discussed with the Comprehensive Plan forum. She stated that there is a survey that the public can complete and the survey and all information presented at the open house is on the website.
